H.R. 4518 — Cooper Davis and Devin Norring Act

This section amends the Controlled Substances Act (21 U.S.C. 871 et seq.) by adding a new section 521 to establish reporting requirements for electronic communication service providers and remote computing services (as defined in 18 U.S.C. §§ 2510 and 2711) regarding certain controlled substances violations. It requires such providers to report to the Attorney General, as soon as reasonably possible but no later than 60 days after obtaining actual knowledge, facts or circumstances indicating commission of a crime involving (1) creating, manufacturing, distributing, dispensing, or possession with intent to manufacture, distribute, or dispense fentanyl or methamphetamine; (2) the same acts involving a counterfeit substance, including one purporting to be a prescription drug; or (3) the same acts involving an actual or purported prescription pain medication or prescription stimulant by an unauthorized individual or entity (including one falsely claiming to be a practitioner). (Thus, the requirement aims to reduce proliferation of unlawful sales, distribution, or manufacture of these substances.) Reports must include the provider's contact information and, to the extent available, account details such as name, address, electronic mail address, IP address, URL, and screen names (excluding wire or electronic communication contents except as optionally provided); providers may also report based on reasonable belief and include optional details such as timestamps, geographic location, related data (e.g., photos, videos), or complete communications.

This section includes a severability clause, providing that if any provision of the Act or its amendments, or its application to any person or circumstance, is held unconstitutional, the remaining provisions and their applications to other persons or circumstances shall not be affected.
