H.R. 4550 — United States Grain Standards Reauthorization Act of 2025

This section amends the declaration of policy in the United States Grain Standards Act by adding a new paragraph (4) requiring the Secretary to prioritize the adoption of improved grain grading technology to provide for efficient, accurate, and consistent grading of grain. (As background, the policy statement guides USDA's establishment of official grain standards and inspection system to facilitate orderly marketing in interstate and foreign commerce.)

This section amends official grain inspection authorities under the United States Grain Standards Act (USGSA) by (1) authorizing the Secretary of Agriculture to require inspection of domestic non-export grain loaded or unloaded at export port locations into or out of rail cars, barges, trucks, or other containers, as determined to best meet USGSA objectives (new subsection (e)(5)); (2) updating terminology in subsections (g)(2) and (j) from "fund" or "fund created" to "trust fund" or "trust fund created," and from "credited to the fund" to "credited to the trust fund account"; and (3) extending the availability or authority related to the grain inspection trust fund account through 2030 (from 2025) (subsection (j)(5)). (USGSA inspections ensure uniform grain quality standards, with export port inspections generally performed by federal personnel or delegated state agencies and funded by user fees deposited into the trust fund account.)

This section amends section 7A of the United States Grain Standards Act (7 U.S.C. 79a) by (1) authorizing the Secretary, at export port locations, to delegate official weighing authority to official agencies in addition to state agencies; (2) revising two references in subsection (l) from "fund created" to "trust fund created"; and (3) extending a date in subsection (l)(4) to 2030 (from 2025).

This section (1) expands the exclusions from services performed for the administrative and supervisory cost limitation under the United States Grain Standards Act—previously standardization, compliance, and foreign monitoring activities—to also include equipment and development of technology and (2) extends that limitation through FY2030 (from FY2025). (The United States Grain Standards Act authorizes the Department of Agriculture to establish U.S. standards for grain and provide official inspection, classing, and weighing services, funded primarily by user fees paid by grain industry participants.)

This section amends section 16 of the United States Grain Standards Act (1) in subsection (e), to refer to the Department of Agriculture and official agencies (from the Department of Agriculture); and (2) in subsection (j), to a trust fund created (from fund created).

This section revises reporting requirements under section 17B(e) of the United States Grain Standards Act by (1) requiring the Secretary of Agriculture to submit the report on December 1 each year (previously at the Secretary's discretion, to the extent deemed appropriate), and (2) adding a required analysis of deficiencies in the technology evaluation process, with recommendations to improve the efficiency, accuracy, and consistency of grain grading while minimizing costs to the federal government and grain export industry. (The United States Grain Standards Act establishes uniform quality standards and inspection processes for grain to facilitate domestic and international trade.)

This section (1) extends authorization of appropriations of $23 million annually for standardization and compliance activities, monitoring in foreign ports of grain officially inspected and weighed under the United States Grain Standards Act, and other necessary expenses (to the extent not covered by fees) through FY2030 (from FY2025); and (2) excludes grading services performed under the Agricultural Marketing Act of 1946 from the definition of official inspection or weighing services whose costs may be covered by user fees.

This section (1) extends the Secretary of Agriculture's authority to establish and maintain the advisory committee under the United States Grain Standards Act through September 30, 2030 (from September 30, 2025); and (2) permits members of the 15-member committee—who represent grain industry segments, inspection agencies, and relevant scientists—to continue serving after their three-year terms expire (including after a second successive term) until new appointments are made. (As background, the committee advises the Secretary on implementing the Act, which establishes uniform grain quality standards to facilitate domestic and export trade.)
