H.R. 4552 — Transportation, Housing and Urban Development, and Related Agencies Appropriations Act, 2026

This section prohibits the Office of the Secretary of Transportation from obligating funds appropriated by this Act to approve assessments or reimbursable agreements (i.e., mechanisms for headquarters to charge or shift funds from) operating administrations, except for activities underway on the date of enactment or those that have completed the normal congressional reprogramming notification process.

This section requires the Secretary of Transportation to post on the Department of Transportation website a schedule of all meetings of the Council on Credit and Finance, including each meeting's agenda, and to require the council to record its decisions and actions from each meeting.

This section authorizes the Department of Transportation's Working Capital Fund, in addition to authority under 49 U.S.C. §327, to provide partial or full advance payments from available funds and accept subsequent reimbursements from all federal agencies for transit benefit distribution services under the Federal transit pass transportation fringe benefit program (established by E.O. 13150 and SAFETEA-LU §3049, 5 U.S.C. 7905 note). It further requires the Department to maintain an operating reserve in the fund not exceeding one month of benefits payable, to be used solely for uninterrupted transit benefits to government employees, with full reimbursement from each customer agency for actual costs.

This section makes available until expended receipts collected in the Department of Transportation's Working Capital Fund for unused transit and van pool benefits, in an amount not to exceed 10 percent of fiscal year 2026 collections, to provide contractual services in support of section 189 of this Act. Obligations of such receipts in fiscal year 2026 are limited to $1,000,000.

This section prohibits the obligation or expenditure of funds in this title for retention or senior executive bonuses for Department of Transportation employees without the prior written approval of the Assistant Secretary for Administration.

This section authorizes the Department of Transportation's Administrative Working Capital Fund, in addition to existing authorities under 49 U.S.C. § 327, to transfer information technology equipment, software, and systems from departmental sources or other entities and to collect and maintain a reserve at rates that recover the full cost of transferred assets.

This section requires the Secretary of Transportation to notify specified congressional committees at least three days before approving credit assistance under the Transportation Infrastructure Finance and Innovation Act (TIFIA) program (23 U.S.C. §§ 603, 604). The notification must include the project sponsor's name, project description, type of assistance (direct loan, loan guarantee, or line of credit), and amount of assistance.

This section authorizes the transfer of amounts made available in this Act to the Secretary of Transportation or Department of Transportation (DOT) operating administrations for award, administration, or oversight costs of financial assistance under (1) the university transportation centers program (49 U.S.C. §5505), which supports university-led research, education, and technology transfer in surface transportation, and (2) the drone infrastructure inspection grant program (P.L. 118-63, title IX §912), which funds drone-based inspections of transportation infrastructure such as highways, bridges, rail, and airports. Transferred amounts, to a designated DOT account established by P.L. 117-58, div. J §801 (as amended), remain available until expended for necessary expenses of award, administration, or oversight of any DOT financial assistance programs and are available in addition to other funds for such purposes.

This section authorizes the Secretary of Transportation to transfer amounts awarded to federally recognized tribes under funding agreements in the Department of Transportation Tribal Self-Governance Program (49 CFR pt. 29) from DOT operating administrations to the Office of Tribal Government Affairs. It further authorizes the transfer back to the appropriate operating administration of any such amounts that are retroceded or reassumed by the tribe.

This section rescinds $10 million of unobligated balances from prior-year appropriations for the Advanced Research Projects Agency—Infrastructure (ARPA-I).

This section limits compensation under the Federal Aviation Administration's federally funded research and development center contract with the Center for Advanced Aviation Systems Development to 600 technical staff-years in FY2026.

This section prohibits the use of funds appropriated by this Act to pursue or adopt guidelines or regulations requiring airport sponsors to provide to the Federal Aviation Administration (FAA), without cost, building construction, maintenance, utilities and expenses—including related accommodation services—or space in airport sponsor-owned buildings for air traffic control, air navigation, or weather reporting services. The prohibition does not apply to negotiations between the FAA and airport sponsors to achieve agreement on below-market rates for such items or to grant assurances requiring airport sponsors to provide land without cost to the FAA for air traffic control facilities.

This section authorizes the Federal Aviation Administration (FAA) Administrator to reimburse Essential Air Service (EAS) obligations under 49 U.S.C. §41742(a)(1)—which subsidizes commercial air service to eligible small communities—from aircraft registration and recordation fees credited under 49 U.S.C. §45303. It further permits any unexpended balance in such account at the end of a fiscal year to remain available for EAS obligations in the subsequent fiscal year.

This section directs that amounts collected as overflight fees under 49 U.S.C. 40113(e) be credited to the appropriation current at the time of collection, to be merged with and available for the same purposes as such appropriation (previously, to the Airport and Airway Trust Fund). (As background, overflight fees compensate the Federal Aviation Administration for air navigation services provided to aircraft transiting U.S.-controlled airspace without landing in the United States.)

This section prohibits the use of funds appropriated by this Act to pay premium pay under 5 U.S.C. § 5546(a)—which compensates certain federal employees (e.g., law enforcement officers and firefighters) for overtime work on holidays, Sundays, and nights—to any Federal Aviation Administration employee unless the employee actually performed work during the corresponding time.

This section prohibits Federal Aviation Administration employees from using government-issued credit cards, funded by this Act, to purchase store gift cards or gift certificates.

This section prohibits the use of funds appropriated by this Act or prior Acts to implement or enforce any limitation on a private aircraft owner or operator's ability to request the Federal Aviation Administration (FAA) Administrator to block public ground-based display of the aircraft's registration number, Mode S transponder code, flight identification, call sign, or similar identifying information that enables real-time or near-real-time flight tracking, for noncommercial flights. (Thus, such data remains available to government agencies.)

This section prohibits the use of funds appropriated by this Act to increase fees pursuant to 49 U.S.C. §44721 (i.e., aircraft registration and recordation fees) until the Federal Aviation Administration provides the House and Senate Committees on Appropriations a report justifying all fees related to aeronautical navigation products (e.g., charts and publications) and explaining their consistency with Executive Order No. 13642.

This section prohibits the use of funds appropriated by this Act to close a Federal Aviation Administration regional operations center or reduce its services unless the FAA Administrator notifies the House and Senate Committees on Appropriations at least 90 full business days in advance.

This section prohibits the Federal Aviation Administration (FAA) from using funds appropriated by this Act to withhold consideration or approval of new applications for the contract tower program (i.e., FAA program under which contractors operate air traffic control towers at smaller airports)—or to reevaluate cost-share participants in that program—provided the FAA has received an application from the airport and determines the tower meets FAA-published eligibility criteria.

This section prohibits the use of funds appropriated by this Act to open, close, redesignate as a lesser office, or reorganize a Federal Aviation Administration (FAA) regional office, the aeronautical center, or the technical center unless the FAA Administrator complies with section 405 of this Act.

This section exempts Federal Aviation Administration (FAA) activities creating, reorganizing, or restructuring an organizational unit from the requirements of section 405, notwithstanding paragraph (7) of that section, unless those activities change the organization chart provided as an exhibit to section 1 of the President’s Budget justification.

This section provides up to $3.5 million from Airport Improvement Program (AIP) grants to reimburse airport sponsors not providing gateway operations (i.e., major commercial hub services), general aviation ground support providers, and other aviation tenants for direct and incremental financial losses from airport closures due solely to federal temporary flight restrictions (TFRs) around presidential residences secured by the U.S. Secret Service. Funds may not be obligated or distributed until an independent audit and verification regime are completed; losses from violations of law, fault, or negligence by operators, providers, third parties, or airports are ineligible; and reimbursement requires a full release of all claims against the U.S. government.

This section directs the Secretary of Transportation to distribute the obligation limitation for Federal-aid highways for FY2026 proportionally among eligible Federal-aid highway and highway safety construction programs—after excluding amounts for administrative expenses under 23 U.S.C. §104(a), the Bureau of Transportation Statistics, and certain prior-year unobligated balances—according to a specified formula that first allocates to Secretary-allocated or apportioned programs under §§202 or 204 and then pro rata to remaining state-apportioned programs (excluding specified amounts). The section exempts from the limitation obligations for specified programs and activities (e.g., emergency relief under 23 U.S.C. §125, certain prior discretionary grants) and, for FY2026, up to $639 million for the National Highway Performance Program (NHPP) under 23 U.S.C. §119. It further authorizes the Secretary to redistribute unused limitation after August 1, prioritizing states with large unobligated balances, and applies the limitation to contract authority for transportation research programs under specified authorities (e.g., 23 U.S.C. ch. 5).

This section authorizes the Bureau of Transportation Statistics (BTS) to credit funds received from the sale of data products to the Federal-aid highways account to reimburse BTS for expenses incurred under 49 U.S.C. chapter 63 (i.e., transportation statistics collection, analysis, and dissemination), notwithstanding 31 U.S.C. 3302 (Miscellaneous Receipts Act). (Thus, BTS may retain and use such proceeds rather than depositing them into the Treasury.)

This section requires the Secretary of Transportation, prior to waiving any Buy America requirement (i.e., domestic content rules for steel, iron, and manufactured products) for federal-aid highway projects, to provide at least 15 days' informal public notice and comment opportunity on the intent to issue such waiver and the reasons therefor. The section further requires the Secretary to post on a website any waivers granted under those requirements.

This section prohibits the use of funds appropriated by this Act for grants under the Nationally Significant Federal Lands and Tribal Projects program (23 U.S.C. §117)—which provides discretionary grants for multimodal transportation infrastructure projects of national significance on federal or tribal lands—unless the Secretary notifies the House and Senate Committees on Appropriations in writing at least 60 days prior to the grant award, including an evaluation and justification for the project and the proposed grant amount.

This section authorizes a state or territory to redirect any "earmarked amount" (i.e., congressionally directed spending or earmark administered by the Federal Highway Administration from more than 10 fiscal years prior) with less than 10% obligated as of October 1 of the current fiscal year, plus associated obligation limitation, to any project eligible under the surface transportation block grant program (23 U.S.C. 133(b)) or territorial highway program (23 U.S.C. 165) within the state or territory's boundaries and the same general geographic area (within 25 miles), or to unexpended balances from certified closed projects. To exercise this authority, the relevant state department of transportation must notify the Secretary of Transportation and submit an annual report identifying funded projects; such funds remain available for obligation for three fiscal years after notification, with the same federal share as the original earmark. The Secretary must submit consolidated annual reports to the House and Senate Committees on Appropriations.

This section prohibits the use of funds appropriated by this Act or any other Act for activities related to implementing priced zones (cordon pricing) under the Value Pricing Pilot Program or New York City’s Central Business District Tolling Program. (As background, the Value Pricing Pilot Program, authorized under 23 U.S.C. § 1703, supports up to 15 demonstration projects testing highway pricing strategies, including congestion pricing via tolls on vehicles entering designated zones, to manage traffic demand; New York City’s program would impose variable tolls on most vehicles entering Manhattan below 60th Street during peak hours.)

This section requires the Federal Motor Carrier Safety Administration to send notices of violations under 49 CFR §385.308 (i.e., reapplication for a safety rating after downgrade to inadequate status) by certified mail, registered mail, or another delivery method that records receipt by the responsible persons.

This section prohibits the Department of Transportation from obligating or expending appropriated funds to implement, administer, or enforce electronic logging device requirements under 49 U.S.C. 31137 for operators of commercial motor vehicles transporting livestock (as defined in 7 U.S.C. 1471) or insects. (Thus, such operators are exempt from federal enforcement of ELD mandates for hours-of-service compliance.)

This section prohibits the use of funds to (1) require the use of inward-facing cameras or (2) require a motor carrier to register an apprenticeship program with the Department of Labor as a condition for participation in the safe driver apprenticeship pilot program.

This section prohibits the use of funds appropriated by this Act or any other Act to promulgate any rule or regulation requiring vehicles with a gross vehicle weight of more than 26,000 pounds operating in interstate commerce to be equipped with a speed limiting device set to a maximum speed.

This section prohibits the use of funds appropriated by this or any other Act to modify, rescind, or grant waivers from two Federal Motor Carrier Safety Administration (FMCSA) preemption determinations published at 83 FR 67470 (Dec. 28, 2018), regarding California's meal and rest break rules for commercial motor vehicle (CMV) drivers, and 85 FR 73335 (Nov. 17, 2020), regarding Washington's. It further directs the Secretary of Transportation, notwithstanding 49 U.S.C. 31141(d)(2), to deny without a hearing on the record any petitions for waivers of those determinations that are pending on the date of enactment or received thereafter. (Thus, these preemption determinations—which find the state rules incompatible with federal hours-of-service regulations—remain in effect indefinitely.)

This section excludes from the limitations on obligations for National Highway Traffic Safety Administration (NHTSA) programs any obligation authority provided in prior public laws to the extent it has not lapsed or been used. (Thus, carryover contract authority for NHTSA highway safety grants and other programs remains available notwithstanding limitations imposed by this Act.)

This section authorizes transfers to the Federal Railroad Administration’s Financial Assistance Oversight and Technical Assistance account of amounts appropriated to the Secretary or the Federal Railroad Administration (FRA) in this and prior acts for award, administration, and project management oversight costs of FRA-administered financial assistance, for use in the same manner for those costs plus technical assistance (excluding amounts Congress designated as an emergency requirement pursuant to a concurrent resolution on the budget or the Balanced Budget and Emergency Deficit Control Act of 1985).

This section prohibits the use of federal funds appropriated to Amtrak from paying overtime costs exceeding $35,000 for any individual employee, authorizes the President of Amtrak to waive this cap for specific employees if necessary for system safety or operational efficiency, and requires the President to report to the House and Senate Committees on Appropriations within 60 days of enactment a summary of all Amtrak overtime payments for calendar year 2025 and the three prior calendar years—including, for each month in those periods, the number of employees receiving waivers and total overtime payments to them.

This section prohibits the use of funds appropriated under the headings “Northeast Corridor Grants to the National Railroad Passenger Corporation” and “National Network Grants to the National Railroad Passenger Corporation” to reduce Amtrak Police Department uniformed officer staffing for patrols on passenger trains, stations, facilities, or rights-of-way below the level on May 1, 2019.

This section prohibits the provision of funds appropriated or otherwise made available under this Act or any other Act to the State of California for a high-speed rail corridor development project that is the same or substantially similar to the project that is the subject of Cooperative Agreement No. FR–HSR–0118–12–01–01 or Cooperative Agreement No. 69A36524521070 FSPCA between the California High-Speed Rail Authority and the Federal Railroad Administration.

This section directs not less than $15 million of FY2026 funds available under the Federal-State Partnership for Intercity Passenger Rail heading in division J of P.L. 117-58 (Infrastructure Investment and Jobs Act)—a program that provides grants to states and Amtrak for intercity passenger rail capital projects—to the Union Station Redevelopment Corporation for rehabilitating and repairing the Washington Union Station complex (a major national rail hub). The section further (1) specifies that such repurposed amounts remain treated as specified in section 103(b) of division A of P.L. 118-5; (2) requires the Union Station Redevelopment Corporation Board of Directors to include designees from Virginia and Maryland; and (3) directs the Corporation and the National Railroad Passenger Corporation (Amtrak) to adhere to P.L. 97-125 (Union Station Redevelopment Act of 1981) in pursuing historic preservation and improvements with maximum private sector reliance and minimum federal assistance.

This section rescinds $75 million of unobligated balances from prior-year appropriations for the Federal Railroad Administration's Federal-State Partnership for Intercity Passenger Rail program, as provided in the FY2025 Department of Transportation appropriations act (P.L. 119–4). (The program provides competitive grants to states and rail carriers to develop, improve, or expand intercity passenger rail corridors.)

This section prohibits federal funds appropriated or otherwise made available under this Act or any other Act from being provided to the State of Texas for a high-speed rail corridor development project that is the same or substantially similar to the Amtrak Texas High-Speed Rail Corridor previously known as the Texas Central Railway project.

This section prohibits the provision of any funds appropriated under this Act or any other Act to the State of Minnesota for an intercity rail corridor development project that is the same or substantially similar to the Northern Lights Express Intercity Passenger Rail Project.

This section waives obligation limitations applicable to Federal Transit Administration programs for any obligation authority previously made available under 49 U.S.C. 5338 (i.e., formula grants for public transportation) or other previously available authority.

This section directs unobligated funds appropriated or limited by this Act under the Federal Transit Administration's Capital Investment Grants heading for specified projects—including recoveries as of September 30, 2029—to other projects eligible for the original purposes. (Thus, such funds remain available within the Capital Investment Grants program, which supports major new fixed guideway transit and bus rapid transit projects.)

This section authorizes the transfer, notwithstanding other law, of funds appropriated before October 1, 2025, under any section of 49 U.S.C. chapter 53 (public transportation programs) that remain available for expenditure to the most recent appropriation heading for that section.

This section prohibits the use of any federal funds to adjust apportionments or withhold funds from apportionments under section 9503(e)(4) of the Internal Revenue Code of 1986 (26 U.S.C. 9503(e)(4)), which authorizes such actions from the Mass Transit Account of the Highway Trust Fund for state noncompliance with certain public transportation requirements.

This section rescinds $40 million of unobligated balances from prior-year appropriations for Federal Transit Administration Transit Infrastructure Grants provided in paragraphs (1) and (5) of the FY2025 Department of Transportation appropriations act (P.L. 119–4).

This section authorizes the Maritime Administration, notwithstanding other provisions of the Act and in addition to existing authority, to furnish utilities and services and make necessary repairs in connection with any lease, contract, or occupancy involving government property under its control. Payments received for such utilities, services, or repairs are credited to the appropriation charged with the costs and remain available until expended, while other rental payments are deposited into the Treasury as miscellaneous receipts.

This section makes applicable appropriations to the Department of Transportation available during the current fiscal year for (1) maintenance and operation of aircraft; hire of passenger motor vehicles and aircraft; purchase of liability insurance for motor vehicles operating in foreign countries on official department business; and uniforms or allowances therefor, as authorized by 5 U.S.C. §§5901-5902; (2) purchase, maintenance, operation, and deployment of unmanned aircraft systems that advance departmental or operating administration missions; and (3) deems any such system purchased, procured, or contracted for prior to enactment as congressionally authorized.

This section authorizes appropriations for the Department of Transportation to be used for expert and consultant services under 5 U.S.C. 3109 at rates not to exceed the per diem equivalent of the Executive Level IV rate.

This section prohibits recipients of amounts made available by this Act from disseminating personal information obtained by a state department of motor vehicles in connection with a motor vehicle record, except for uses permitted under the Driver's Privacy Protection Act (18 U.S.C. § 2721 et seq.). Notwithstanding this prohibition, the Secretary shall not withhold such amounts from any grantee due to a state's noncompliance.

This section limits the use of funds provided by this Act for salaries and expenses to 125 political and Presidential appointees in the Department of Transportation and prohibits the temporary detail of such appointees outside the department.

This section authorizes the Federal Highway Administration to credit funds received from states, counties, municipalities, other public authorities, and private sources for training expenses to its Federal-aid Highways account and the Federal Railroad Administration to credit such funds to its Safety and Operations account, except for state rail safety inspectors participating in training under 49 U.S.C. 20105.

This section prohibits the Department of Transportation from using funds appropriated by this Act or in title VIII of division J of Public Law 117-58 to make a loan, loan guarantee, line of credit, letter of intent, federally funded cooperative agreement, full funding grant agreement, or discretionary grant unless the Secretary notifies the House and Senate Committees on Appropriations at least three full business days before announcing any competitively selected project and provides those committees with a comprehensive list of all such awards beforehand. The section further requires concurrent notification to those committees for any quick release of funds from the emergency relief program and exempts funds not available for obligation from the notification requirement.

This section directs the Department of Transportation to credit rebates, refunds, incentive payments, minor fees, and other funds received from travel management centers, charge card programs, subleasing of building space, and miscellaneous sources to its appropriations for allocation to organizational units using fair and equitable criteria, with such funds available until expended.

This section limits reprogramming notices and approvals for funds provided or limited by this Act to solely the House and Senate Committees on Appropriations. The Secretary of Transportation may notify other congressional committees of the Appropriations Committees' action on such reprogramming no sooner than 30 days after approval or denial.

This section limits obligations of funds appropriated by this Act to Department of Transportation operating administrations for assessments or reimbursable agreements with the Office of the Secretary to costs of goods and services that provide a direct benefit to those administrations.

This section authorizes the Secretary of Transportation to carry out a program establishing uniform standards for developing and supporting agency transit passes and transit benefits under 5 U.S.C. §7905 (i.e., federal employee commuting benefits such as vouchers or passes for public transportation), including distribution by paper and electronic media.

This section authorizes the Department of Transportation to use funds to assist contracts under titles 23 or 49, U.S. Code, that utilize geographic, economic, or other hiring preferences not otherwise authorized by law, or to amend rules prohibiting Federal Highway Administration or Federal Transit Administration grant recipients from imposing such preferences on assisted contracts or projects, if the grant recipient certifies (1) a pool of readily available but unemployed individuals possessing the requisite knowledge, skill, and ability exists in the jurisdiction (except apprentices or trainees); (2) bid documents prevent contractors from displacing existing employees to meet the preference; and (3) any resulting increases in labor, training costs, or delays do not delay or displace projects in the applicable statewide transportation improvement program or transportation improvement program.

This section directs the Secretary of Transportation, in coordination with the Secretary of Homeland Security, to ensure that best practices for Industrial Control Systems procurement are up-to-date and that systems procured with funds provided under this title comply with such practices.

This section prohibits the use of appropriated funds to license, facilitate, coordinate, or otherwise allow officials of a country designated as a state sponsor of terrorism within the past three fiscal years to observe, tour, visit, or confer with Department of Transportation (DOT) employees, including the Federal Aviation Administration (FAA), in their official capacity. It defines "state sponsor of terrorism" as a country the Secretary of State determines has repeatedly provided support for international terrorism under section 1754(c)(1)(A) of the Export Control Reform Act of 2018, section 620A of the Foreign Assistance Act of 1961, section 40 of the Arms Export Control Act, or any other provision of law.

This section reduces funding for the Office of the Secretary—Salaries and Expenses—Office of the General Counsel by $10 million and transfers that amount to the Federal Highway Administration—Highway Infrastructure Programs for the Regional Infrastructure Accelerator program (i.e., grants to regional consortia to coordinate and accelerate priority infrastructure projects).

This section requires rescission or remittance to the Treasury of 50% of budget authority or cash recaptured from projects described in section 1012(a) of the Stewart B. McKinney Homeless Assistance Amendments Act of 1988 (i.e., multifamily housing projects that provided units for homeless persons in connection with approved mortgage prepayments or refinancings). The remainder is available for use by state housing finance agencies, local governments, or local housing agencies for HUD-approved projects with settlements after January 1, 1992, in accordance with that section. (Thus, up to 85% of recaptured amounts may be reused for such projects.) Notwithstanding the foregoing, the Secretary of Housing and Urban Development may award up to 15% of the remainder to project owners as incentives to refinance at lower interest rates.

This section prohibits the use of funds appropriated by this Act to investigate or prosecute under the Fair Housing Act (i.e., law prohibiting housing discrimination based on protected characteristics such as race, religion, sex, familial status, or disability) any otherwise lawful activity—including the filing or maintaining of a nonfrivolous legal action—engaged in solely for the purpose of achieving or preventing action by a government official or entity, or a court of competent jurisdiction.

This section requires grants, cooperative agreements, or other assistance under title II of this Act to be made on a competitive basis, except as explicitly provided in law, and in accordance with section 102 of the Department of Housing and Urban Development Reform Act of 1989 (42 U.S.C. 3545).

This section makes funds of the Department of Housing and Urban Development (HUD) subject to the Government Corporation Control Act or section 402 of the Housing Act of 1950 available, without regard to administrative expense limitations, for legal services on a contract or fee basis and for services and facilities of the Federal National Mortgage Association (Fannie Mae), Government National Mortgage Association (Ginnie Mae), Federal Home Loan Mortgage Corporation (Freddie Mac), Federal Financing Bank, Federal Reserve banks or members thereof, Federal Home Loan banks, and FDIC-insured banks.

This section prohibits the Department of Housing and Urban Development from obligating any appropriated funds for a program, project, or activity in excess of amounts set forth in budget estimates submitted to Congress, unless otherwise provided in this Act or through a reprogramming of funds.

This section authorizes corporations and agencies of the Department of Housing and Urban Development subject to the Government Corporation Control Act to make expenditures within available funds and borrowing authority, and to enter contracts and commitments without regard to fiscal year limitations under section 104 of that Act, as necessary to carry out their FY2026 budgeted programs. It further restricts use of such entities' collections for new loan or mortgage purchase commitments except as expressly provided in this Act (unless supporting other assistance in this or prior appropriations Acts), with exceptions for mortgage insurance or guaranty operations and actions necessary to protect the financial interests of the U.S. government.

This section directs the Secretary to provide quarterly reports to the House and Senate Committees on Appropriations on all uncommitted, unobligated, recaptured, and excess funds in each program and activity within the Department's jurisdiction and to submit additional updated budget information to those committees upon request.

This section prohibits the use of funds appropriated by this title for an audit of the Government National Mortgage Association (Ginnie Mae) that applies requirements of the Federal Credit Reform Act of 1990.

This section authorizes the Secretary of Housing and Urban Development, notwithstanding other laws and subject to specified conditions, to transfer for FY2026 and FY2027 some or all project-based assistance (i.e., rental subsidies tied to units in multifamily properties, including under Section 8 of the U.S. Housing Act of 1937, rent supplements, Section 236 interest reductions, Section 202 elderly housing, and Section 811 supportive housing for disabled persons), debt held or insured by the Secretary, and statutorily required low-income and very low-income use restrictions from one or more multifamily housing projects (i.e., FHA-insured or assisted properties) to another or others, including in phases to facilitate rehabilitation or construction. (Thus, the authority enables preservation of federal assistance levels by relocating them from physically obsolete, economically nonviable, or deconcentrating projects to viable ones meeting or exceeding HUD physical standards, without increasing costs or displacing eligible tenants prematurely.) The transfer is conditioned on the following: (1) for occupied units in the transferring project, no reduction in low-income/very low-income units, bedroom configuration, or net federal assistance dollars in the receiving project(s); for unoccupied units, possible reduction in units for bedroom reconfiguration to meet market demands without increasing assistance; (2) the transferring project is obsolete/nonviable or expected to become so due to state/federal integration requirements; (3) tenant notification/consultation, local official approval, and Secretary determination that the transfer serves tenants' best interests; (4) no tenant vacating until receiving units are ready; (5) any new liens on receiving project(s) subordinate to FHA mortgage liens (waivable if needed for financing); (6) continuation or new use agreement on receiving project(s) with use restrictions at least as long as existing; and (7) no increase in FHA-insured mortgage costs without prior appropriations.

This section prohibits Section 8 housing choice voucher assistance (i.e., tenant-based rental assistance for low-income families, seniors, and persons with disabilities) to individuals enrolled as students at institutions of higher education who are under 24 years of age, unmarried, without dependent children, not veterans, not persons with disabilities (as defined in the U.S. Housing Act of 1937) or receiving such assistance as of November 30, 2005, not youth who left foster care at age 14 or older and at risk of homelessness, and not otherwise individually eligible or with eligible parents. It further requires that financial assistance under the Higher Education Act of 1965, from private sources, or from institutions of higher education (beyond tuition, fees, and required charges) be counted as income for Section 8 eligibility determinations, except for persons over age 23 with dependent children.

This section directs that funds made available for Native Alaskans under paragraph (1) of the "Native American Programs" heading in title II be allocated to the same Native Alaskan housing block grant recipients that received funds in FY2005 and limits eligibility to apply for funds under paragraph (2) of such heading to only those recipients.

This section requires the Secretary of Housing and Urban Development, in FY2026, to maintain rental assistance payments under section 8 of the United States Housing Act of 1937 (i.e., project-based Section 8 rental assistance) and other federal programs attached to dwelling units in multifamily properties owned or mortgaged by the department during management, disposal, or foreclosure. If the Secretary determines—in consultation with tenants and local government—that continued assistance on such a property is not feasible due to rehabilitation and operating costs (considering all available resources, including rent adjustments under section 524 of the Multifamily Assisted Housing Reform and Affordability Act of 1997 (MAHRAA)) or unremediable environmental conditions, the Secretary may, in consultation with tenants, contract for project-based rental assistance with owners of other existing properties or provide other rental assistance. The section further requires project-based contracts to remain in effect prior to foreclosure (subject to limited abatement remedies for health and safety threats after tenant notice and consent, partial abatements, or receivership) and subjects contracts and rent levels on disposed properties to MAHRAA section 524 requirements.

This section permits public housing agencies owning and operating 400 or fewer public housing units to elect exemption from asset management requirements imposed by HUD under the public housing operating fund rule, except for agencies seeking discontinuance of a subsidy reduction under that formula.

This section prohibits the Secretary of Housing and Urban Development (HUD) from imposing any asset management requirement or guideline that restricts public housing agencies' (PHAs) use of Capital Fund amounts, authorized under section 9(d) of the United States Housing Act of 1937, for central office costs as permitted under section 9(g)(1) or (2) of that Act. (The Capital Fund supports major physical improvements and development of public housing, while section 9(g) allows PHAs to use limited amounts of capital or operating funds for central administrative costs.) It further provides that PHAs may not use Capital Funds for activities eligible for operating fund assistance under section 9(e) in excess of the amounts allowed under section 9(g)(1) or (2).

This section prohibits the Department of Housing and Urban Development (HUD) from designating any official or employee as an allotment holder unless the Office of the Chief Financial Officer determines that the individual has implemented an adequate system of funds control and received training in funds control procedures and directives. The section requires the Chief Financial Officer to ensure a trained allotment holder is designated for each HUD appropriation under the Executive Offices, Administrative Support Offices, Program Offices, Government National Mortgage Association—Guarantees of Mortgage-Backed Securities Loan Guarantee Program Account, and Office of Inspector General accounts.

This section directs the Secretary, for FY2026, to notify the public through the Federal Register and other means, as determined appropriate, of the issuance of a notice of the availability of assistance or notice of funding opportunity (NOFO) for any competitively awarded program or discretionary fund administered by the Secretary. Notwithstanding any other provision of law, it further authorizes the Secretary, for FY2026, to make such NOFOs available only on the appropriate government website or through other electronic media, as determined by the Secretary.

This section authorizes the Secretary to transfer up to 10 percent or $5 million (whichever is less) of funds appropriated for any office under the headings “Administrative Support Offices” or “Program Offices” to any other such office. No appropriation for any such office may be increased or decreased by more than 10 percent or $5 million (whichever is less) without prior written approval of the House and Senate Committees on Appropriations, and the Secretary must notify those Committees at least three business days in advance of any such transfer.

This section requires any entity receiving housing assistance payments to maintain decent, safe, and sanitary conditions in covered properties, as determined by the Secretary of Housing and Urban Development (HUD), and to comply with applicable state or local standards relating to physical condition. The section further directs the Secretary to take action under subsection (c) when a multifamily housing project with a project-based section 8 contract under the United States Housing Act of 1937 or similar project-based assistance (1) receives a failing score under the Uniform Physical Condition Standards (UPCS) or successor standard, or (2) fails to certify in writing to the Secretary within three days that all exigent health and safety deficiencies—those requiring correction within 24 hours—identified by an inspector have been corrected.

This section prohibits public housing agencies from using funds appropriated for the Section 8 tenant-based rental assistance program (i.e., Housing Choice Voucher program) or Section 9 public housing programs (i.e., operating and capital assistance) under the United States Housing Act of 1937 to pay salaries, including bonuses, exceeding the annual rate of basic pay for Executive Schedule Level IV to their chief executive officers or any other officials or employees during any public housing agency fiscal year 2026.

This section requires the Secretary of Housing and Urban Development to notify the House and Senate Committees on Appropriations at least three full business days before announcing any grant award made with funds provided by this Act to the department, with the notification listing each award by state and current congressional district.

This section prohibits the Federal Housing Administration (FHA), Government National Mortgage Association (Ginnie Mae), and Department of Housing and Urban Development (HUD) from using funds provided in this Act to insure, securitize, or guarantee any mortgage or mortgage-backed security that refinances or replaces a mortgage subject to eminent domain condemnation or seizure by a state, municipality, or other political subdivision.

This section prohibits the use of funds appropriated by this Act to terminate the status of any unit of general local government as a metropolitan city for purposes of Community Development Block Grant (CDBG) entitlement grants under the Housing and Community Development Act of 1974. (As background, metropolitan cities—generally, cities with populations of 50,000 or more within metropolitan areas—are among the entitlement communities eligible for annual formula CDBG grants to support housing, community development, and economic opportunity activities.)

This section permits the deobligation of unexpended amounts made available by this Act to the Office of Policy Development and Research (PD&R) of the Department of Housing and Urban Development (HUD) for research, evaluation, or statistical purposes upon completion of a contract, grant, or cooperative agreement. Such amounts become immediately available for reobligation in that fiscal year or the subsequent fiscal year for the same purposes, subject to reprogramming requirements in section 405 of this Act.

This section prohibits the use of funds appropriated in this Act or any other Act for performance, special act, or spot awards to any Department of Housing and Urban Development (HUD) employee subject to administrative discipline (including suspension from work) during this fiscal year. The prohibition applies from the effective date of such discipline until any final decision overturning it.

This section allows costs paid using program income of Continuum of Care (CoC) program grant recipients—under subtitle C of title IV of the McKinney-Vento Homeless Assistance Act—to count toward matching requirements for Homeless Assistance Grants awarded in FY2015 through FY2026, provided the costs are eligible CoC costs that supplement the recipient's program. (The CoC program coordinates housing and services to promote community-wide efforts to end homelessness.)

This section authorizes the Secretary to award one-year transition grants—from amounts available under Homeless Assistance Grants—to recipients under subtitle C of the McKinney-Vento Homeless Assistance Act (i.e., Continuum of Care program, which funds housing and services for homeless persons and families) to shift from one program component to another. To be eligible, recipients must obtain continuum of care consent and meet standards set by the Secretary.

This section provides that Promise Zone designations (i.e., HUD designations of high-poverty communities eligible for enhanced federal investment and support) and related designation agreements made by the Secretary in prior fiscal years remain in effect according to their terms and conditions.

This section authorizes public housing agencies designated as Moving to Work (MTW) agencies to use funds previously allocated under section 8 (tenant-based rental assistance, i.e., Housing Choice Vouchers) or section 9 (public housing capital and operating funds) of the U.S. Housing Act of 1937—including agency reserve funds or funds held by HUD—for any purpose notwithstanding original appropriations (except special purpose funding, including special purpose vouchers). (As background, the MTW demonstration program provides select agencies regulatory and funding flexibility to improve cost-efficiency and expand housing options for low-income households.)

This section prohibits the use of amounts appropriated by this Act to prevent public housing agencies under receivership or the direction of a federal monitor from applying for, receiving, or using Public Housing Fund competitive grants to evaluate and reduce lead-based paint hazards—including grants from this Act or remaining available from prior acts—or from using such funds to perform required work under a settlement agreement, consent decree, voluntary agreement, or similar document addressing violations of lead safe housing or lead disclosure rules.

This section authorizes the Secretary of Housing and Urban Development (HUD), for FY2026, to correct prior over-allocations in formula grants administered through HUD's Offices of Public and Indian Housing, Community Planning and Development, or Housing (e.g., public housing operating and capital funds, Community Development Block Grants) by adjusting the next applicable formula allocation cycle. Adjustments may include (1) offsetting each overpaid recipient's allocation by the error amount (if eligible), and (2) reallocating offset balances proportionately to underpaid recipients eligible in that cycle using funds available for it; upon recipient request and considering other federal resources, the Secretary may spread offsets over multiple cycles if a single-cycle offset would critically impair the recipient's ability to meet grant purposes.

This section authorizes the Secretary to transfer up to $5 million from amounts available for salaries and expenses under this title (excluding Office of Inspector General) to the Information Technology Fund for information technology needs, including development, modernization, and enhancement, with funds remaining available until September 30, 2028. The section prohibits use of the authority for projects or activities with known out-year development, modernization, or enhancement costs exceeding $500,000 and requires the Secretary to notify the House and Senate Committees on Appropriations at least three business days before any transfer.

This section prohibits the Department of Housing and Urban Development from using appropriated funds to issue a solicitation or accept bids on any solicitation substantially equivalent to the draft "Housing Assistance Payments (HAP) Contract Support Services (HAPSS)" solicitation posted on SAM.gov on July 27, 2022.

This section permanently rescinds (1) all unobligated balances made available in paragraph (5) under the Public Housing Fund heading from FY2025 appropriations for the Department of Housing and Urban Development (HUD); (2) all unobligated balances made available under the Choice Neighborhoods Initiative heading from FY2025 HUD appropriations, which supports transformation of distressed public and assisted housing into sustainable mixed-income communities; (3) all unobligated balances made available in paragraph (2) under the Community Development Fund heading from FY2025 HUD appropriations; (4) $15 million of amounts previously made available from the Manufactured Housing Fees Trust Fund; and (5) $417 million of unobligated balances made available under the Office of Lead Hazard Control and Healthy Homes heading from prior-year HUD appropriations, which funds grants to remediate lead-based paint hazards and improve housing health and safety.

This section prohibits the use of funds appropriated by this Act to provide federal funding to any local jurisdiction that refuses to comply with a Department of Homeland Security request for advance notice of the scheduled release date and time of a particular illegal alien from local custody.

This section prohibits the Department of Housing and Urban Development (HUD) from using funds provided by this Act to update minimum energy efficiency standards for new housing financed by HUD, including as part of carrying out the notice entitled “Adoption of Energy Efficiency Standards for New Construction of HUD- and USDA-Financed Housing,” or otherwise.

This section prohibits the Department of Housing and Urban Development (HUD) from using funds appropriated by this Act to administer or enforce the final rule entitled “30-Day Notification Requirement Prior To Termination of Lease for Nonpayment of Rent,” published in the Federal Register on December 13, 2024 (89 Fed. Reg. 101270). (The rule requires property owners participating in certain HUD multifamily housing assistance programs to provide tenants with at least 30 days' written notice before terminating a lease or tenancy solely for nonpayment of rent.)

This section authorizes the Secretary of Housing and Urban Development (HUD) to permit one or more public housing agencies (PHAs) to apply PHA-determined requirements for total tenant payments, tenant rental payments, and housing assistance payment amounts when using funds for tenant-based rental assistance under section 8(o) of the U.S. Housing Act of 1937 (i.e., Housing Choice Voucher Program) and public housing operating funds under section 9(e), notwithstanding standard requirements in those sections. The Secretary may waive or establish alternative requirements under rent calculation provisions in sections 3(a), 3(b), or 8(o) if needed to implement this flexibility. (Thus, once granted to a PHA, this authority may not be rescinded for seven years.)

This section permits public housing agencies not designated as troubled under the United States Housing Act of 1937 and determined by the Secretary of Housing and Urban Development to be operating and maintaining their public housing in a safe, clean, and healthy condition to use funds allocated from the Public Housing Fund, Public Housing Operating Fund, or Public Housing Capital Fund—including prior-year appropriations and operating reserves—for any eligible activities under such Act's capital (sec. 9(d)(1)) or operating (sec. 9(e)(1)) provisions, regardless of the original fund source. (Thus, qualifying agencies gain flexibility to shift funds between operating subsidy and capital assistance eligible activities.)

This section prohibits the use of funds appropriated by this Act to pay the expenses of, or otherwise compensate, non-Federal parties intervening in regulatory or adjudicatory proceedings funded in this Act.

This section limits funds appropriated by this Act to obligation only during the current fiscal year and prohibits their transfer to other appropriations, unless expressly provided elsewhere in this Act.

This section limits expenditures of appropriations under this Act for consulting services procured pursuant to 5 U.S.C. 3109 to contracts where such expenditures are a matter of public record and available for public inspection, except as otherwise provided under existing law or executive order.

This section prohibits obligating or expending funds made available by this Act for any employee training that—(1) does not meet identified needs for knowledge, skills, and abilities bearing directly on the performance of official duties; (2) contains elements likely to induce high levels of emotional response or psychological stress in some participants; (3) does not require prior employee notification of the content and methods to be used and written end-of-course evaluation; (4) contains any methods or content associated with religious or quasi-religious belief systems or “new age” belief systems as defined in Equal Employment Opportunity Commission Notice N–915.022, dated September 2, 1988; or (5) is offensive to, or designed to change, participants' personal values or lifestyle outside the workplace. This section does not prohibit, restrict, or otherwise preclude agency training bearing directly on the performance of official duties.

This section restricts reprogramming of funds provided by this Act, prior-year appropriations available in FY2026, or agency fee collections by prohibiting such actions that (1) create a new program; (2) eliminate a program, project, or activity; (3) increase funds or personnel for any program, project, or activity denied or restricted by Congress; (4) use funds directed for a specific activity by the House or Senate Committees on Appropriations for a different purpose; (5) augment existing programs, projects, or activities by more than $5 million or 10 percent, whichever is less; (6) reduce existing programs, projects, or activities by $5 million or 10 percent, whichever is less; or (7) create, reorganize, or restructure offices or other organizational units beyond those in congressional budget justifications or committee report tables unless the Committees on Appropriations are notified at least 30 days in advance and provide prior approval. The section also requires each funded agency to submit to the Committees on Appropriations, within 60 days of enactment, a report establishing reprogramming and transfer baselines that includes (i) appropriation tables showing prior-year enacted levels, President's budget requests, congressional adjustments, rescissions, and FY2026 enacted levels; (ii) object class and program, project, or activity delineations matching the most detailed available sources; and (iii) items of special congressional interest.

This section authorizes up to 50% of unobligated balances remaining available at the end of FY2026 from appropriations made available for salaries and expenses for FY2026 in this Act to remain available through September 30, 2027, for authorized purposes in each such account, subject to reprogramming guidelines under section 405 of this Act.

This section prohibits the use of funds in this Act to support any federal, state, or local projects employing eminent domain unless used only for a public use, excluding economic development that primarily benefits private entities. Exceptions constituting public uses include mass transit, railroad, airport, seaport, or highway projects; utility projects (e.g., energy-, communication-, water-, or wastewater-related infrastructure) benefiting or serving the general public; structures designated for general public use or with common-carrier or public-utility functions subject to government regulation and oversight; and projects to remove an immediate threat to public health or safety or to address brownfields as defined in the Small Business Liability Relief and Brownfields Revitalization Act (Public Law 107-118).

This section prohibits the transfer of funds appropriated by this Act to any other department, agency, or instrumentality of the U.S. government, except as expressly authorized by this Act or another appropriations Act.

This section requires entities expending funds appropriated by this Act to comply with the Buy American Act (41 U.S.C. 8301-8305).

This section prohibits using funds appropriated by the Act to send or pay for the attendance of more than 50 employees of a single U.S. agency or department—who are stationed in the United States—at any single international conference unless the relevant secretary reports to the House and Senate Committees on Appropriations at least five days in advance that such attendance is important to the national interest. It defines an international conference as one occurring outside the United States attended by U.S. government representatives and representatives of foreign governments, international organizations, or nongovernmental organizations.

This section prohibits the Surface Transportation Board from using appropriated funds to charge or collect filing fees for rate or practice complaints exceeding the district court civil suit filing fee under 28 U.S.C. § 1914 (currently $405).

This section prohibits the use of funds appropriated by this Act to maintain or establish a computer network unless the network blocks the viewing, downloading, and exchanging of pornography. This prohibition does not apply to funds necessary for federal, state, tribal, or local law enforcement agencies or other entities carrying out criminal investigations, prosecutions, or adjudications.

This section prohibits the use of appropriated funds to deny an Inspector General timely access to any records, documents, or other materials available to the relevant department or agency, except as expressly limited by a law that refers to the Inspector General. It requires departments and agencies to provide such access in a timely manner, directs Inspectors General to comply with statutory disclosure limitations, and requires Inspectors General to report any failures to the House and Senate Appropriations Committees within five calendar days.

This section prohibits the use of appropriated funds to pay award or incentive fees for contractors whose performance has been judged below satisfactory, behind schedule, over budget, or failing to meet basic contract requirements, unless the agency determines such deviations result from unforeseeable events, government-driven scope changes, or are not significant within the overall project or program—or if the fees are consistent with Federal Acquisition Regulation 16.401(e)(2).

This section prohibits the use of any appropriation in this Act to pay the salary of any person filling a permanent position formerly held by an employee who left for U.S. Armed Forces service, satisfactorily completed active military or naval service, applied for restoration within 90 days after release (or hospitalization continuing after discharge for not more than one year), has been certified by the Office of Personnel Management (OPM) as still qualified for the position, and has not been restored thereto. (Thus, funds may be used only for temporary replacements in such cases.)

This section prohibits the use of funds appropriated by this Act to approve new foreign air carrier permits under 49 U.S.C. §§41301-41305 or exemption applications under 49 U.S.C. §40109 for air carriers already holding air operator certificates from countries party to the U.S.-E.U.-Iceland-Norway Air Transport Agreement if such approvals contravene U.S. law or Article 17 bis of the agreement. The prohibition does not preclude the Secretary of Transportation from granting such permits or exemptions consistent with the agreement and U.S. law.

This section prohibits the Secretary of Housing and Urban Development from using funds provided by this Act in violation of section 312 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (i.e., the prohibition against providing federal disaster assistance that duplicates insurance proceeds or other benefits available to disaster victims).

This section prohibits the use of funds appropriated by this Act in violation of federal laws restricting non-citizen eligibility for federally assisted housing programs or assistance under federal housing programs, including Section 214 of the Housing and Community Development Act of 1980 (42 U.S.C. 1436a)—which generally limits such assistance to U.S. citizens and eligible non-citizens (e.g., lawful permanent residents, refugees)—and Title IV of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (8 U.S.C. 1601 et seq.).

This section prohibits the use of appropriations in this Act or division J of Public Law 117-58—including funds for the National Passenger Railroad Corporation—from (1) preparing, distributing, or using kits, pamphlets, publications, electronic communications, radio, television, or video presentations designed to support or defeat legislation before Congress, except for presentations to Congress; or (2) paying salaries or expenses of grant or contract recipients, or their agents, for activities influencing legislation or appropriations pending before Congress, other than normal executive-legislative relationships. Amounts repurposed pursuant to these prohibitions continue to be treated as amounts specified in section 103(b) of division A of Public Law 118-5.

This section prohibits the use of funds appropriated by this or prior acts to take discriminatory actions against any person based wholly or partially on a sincerely held religious belief or moral conviction that marriage is or should be recognized as a union of one man and one woman, notwithstanding 1 U.S.C. §7, 28 U.S.C. §1738C, or other law. Discriminatory actions include (1) altering federal tax treatment or denying tax-exempt status under IRC §501(a); (2) disallowing deductions for charitable contributions; (3) withholding or denying federal grants, contracts, loans, employment, or similar benefits; (4) denying entitlements or benefits under federal programs, including equal treatment in educational programs; or (5) denying access to federal property, facilities, or speech fora. This section further requires the federal government to deem accredited, licensed, or certified any such person who meets other applicable requirements.

This section prohibits the use of funds appropriated by this Act to facilitate new scheduled air transportation originating from the United States if such flights would land on or pass through property confiscated by the Cuban Government—including property in which a minority interest was confiscated—as defined in the Cuban Liberty and Democratic Solidarity (LIBERTAD) Act of 1996. New scheduled air transportation includes any flights not regularly scheduled prior to May 2022.

This section makes technical amendments to project names and recipients in the Congressionally Directed Spending tables of explanatory statements accompanying the FY2022 (division L of P.L. 117-103), FY2023 (division L of P.L. 117-328), and FY2024 (division F of P.L. 118-42) Transportation, Housing and Urban Development appropriations acts—including, for example, changing "Acquisition of new commercial space" to "Renovation of commercial space" (FY2022); "Supportive Living, Community Day Services, and Housing Site Project for Adults with Intellectual and Developmental Disabilities" to "Community Day Services and Housing Expansion for Adults with Intellectual and Developmental Disabilities" (FY2023); and "Pawtucket Library, Sayles Building Re-Pointing" to "Pawtucket Library, Sayles Building Renovation" (FY2024). (Thus, these changes clarify or update designations without altering funding levels or eligibility.)

This section prohibits the use of funds made available by this Act in contravention of Executive Orders 14148, 14168, 14170, 14171, 14173, 14192, 14215, 14224, 14236, 14238, 14240, 14303, 14304, 14305, and 14307; notices published at 90 Fed. Reg. 8651 and 90 Fed. Reg. 23467; and the Presidential Memorandum entitled “Updating Permitting Technology for the 21st Century” issued on April 15, 2025, or any substantially similar rule or order.

This section prohibits the obligation or expenditure of funds provided by this Act to fly or display any flag over a facility of a department or agency funded by this Act other than (1) the flag of the United States; (2) the flag of a state, insular area, or the District of Columbia; (3) the flag of a federally recognized Tribal entity; (4) the official flag of the Secretary of Transportation or the Secretary of Housing and Urban Development; (5) the official flag of a U.S. department or agency; or (6) the POW/MIA flag.

This section prohibits the use of funds provided by this Act to purchase, install, maintain, or operate automated traffic enforcement cameras for red-light enforcement, speed enforcement, or stop sign enforcement.

This section prohibits the obligation or expenditure of funds appropriated for FY2026 to award any grant, contract, cooperative agreement, or other financial assistance to the Metropolitan Washington Airports Authority (MWAA)—which operates Ronald Reagan Washington National Airport and Washington Dulles International Airport—or the Washington Metropolitan Area Transit Authority (WMATA)—which operates the Metrorail and Metrobus systems—if either entity enters into a contract to disseminate advertisements for ByteDance or any of its subsidiaries (e.g., TikTok).
