H.R. 4554 — Restoring Biological Truth to the Workplace Act

This section establishes two new unlawful employment practices under Section 703 of the Civil Rights Act of 1964 by adding subsection (o). It prohibits employers from taking adverse actions described in subsection (a)—i.e., discrimination based on race, color, religion, sex, or national origin—(1) because an employee engages in "covered expression," defined as speech, writing, depictions, or pronoun use (inside or outside the workplace) that describes, asserts, or reinforces the binary or biological nature of sex, or (2) because an employee requests or uses a single-sex bathroom, changing area, or other area where physical privacy is desired. It further provides that job-relatedness for the position or business necessity is not a defense to these practices.
