H.R. 4569 — Supporting Premature Infant Nutrition Act of 2025

This section requires state Medicaid programs to cover human milk fortifier—defined as a donor human milk-derived product determined medically necessary by a specified professional (i.e., physician, nurse practitioner, physician assistant, registered dietitian, or other licensed professional under state law) for infants under 1 year of age who (A) were born at a gestational age of 34 weeks or less, (B) had a birth weight under 1,800 grams or have below-healthy body weight, or (C) have a congenital or acquired condition that the product will improve or aid recovery from—as a mandatory benefit without cost-sharing beginning January 1, 2026. Coverage is required for mandatory eligibility groups, medically needy individuals, and benchmark/benchmark-equivalent plans under Medicaid; the provision adds human milk fortifier to the statutory definition of medical assistance in section 1905(a) as paragraph (32). This section also requires state Children's Health Insurance Program (CHIP) plans to cover human milk fortifier without cost-sharing for targeted low-income children beginning January 1, 2026 (with a delay until the first quarter after the next state legislative session if state legislation is required). (Thus, the changes expand no-cost access to this specialized nutrition for at-risk newborns and infants in both programs.)
