This section authorizes the Attorney General to provide incentive pay of up to 25% of basic pay to Department of Justice employees in positions requiring significant cyber skills (i.e., expertise in computers, computer networks, information technology, or the internet) to aid in detecting, preventing, or prosecuting fentanyl trafficking, subject to appropriations. Such pay is disregarded in calculating pay period and annual limitations on aggregate basic and premium pay under 5 U.S.C. 5547 (i.e., the statutory cap at the greater of GS-15 maximum rate or level V of the Executive Schedule) but treated as basic pay for retirement computation purposes under 5 U.S.C. 8331(3). (Thus, eligible employees may receive this incentive pay without it counting toward the premium pay cap.)
