H.R. 4583 — Living Donor Protection Act of 2025

This section prohibits insurers from denying coverage, canceling coverage, refusing to issue a policy, adjusting premiums, or otherwise varying terms of a life insurance policy (i.e., a contract paying a beneficiary upon the insured's death), disability insurance policy (i.e., a contract paying for disability from illness or injury preventing work), or long-term care insurance policy (i.e., a contract covering qualified long-term care services) based solely on an individual's status as a living organ donor (i.e., an individual who has donated all or part of an organ while alive), absent any actual, unique, and material actuarial risks. State insurance regulators may enforce this prohibition as authorized under state law.

This section directs the Secretary of Health and Human Services (HHS), not later than six months after enactment, to review and update public educational materials on living organ donation to cover (1) the benefits and risks of living organ donation and (2) the impact of living organ donation on a donor's access to insurance, including information on changes made by section 2. In doing so, HHS must update, as appropriate, (1) previously provided public service announcements, (2) publicly accessible websites such as organdonor.gov, and (3) other media determined appropriate by the Secretary.
