H.R. 4596 — McCarran-Walter Technical Corrections Act

This section revises INA §289(a) (8 U.S.C. 1359(a)) to expand the right of American Indians born in Canada to pass U.S. borders from possessing at least 50% American Indian blood to persons who (1) are members or eligible members of a federally recognized Indian tribe in the United States or (2) possess Indian status under Canada's Indian Act or hold membership in a self-governing First Nation in Canada; and adds subsection (b) to grant such persons lawful permanent resident status upon admission. (As background, INA §289 implements certain border-crossing rights under the Jay Treaty of 1794 for indigenous peoples along the U.S.-Canada border.)
