H.R. 4615 — Small Business Payment for Performance Act of 2025

This section requires federal agencies to provide a small business concern an interim partial payment of not less than 50% of the estimated additional costs requested in an equitable adjustment for a directed change to the terms of a construction contract awarded to that concern. Such payments (1) must flow down to first-tier and lower-tier subcontractors proportional to their increased costs from the change and (2) do not constitute definitization of the adjustment request. The Small Business Administration must implement this requirement by the earlier of the first day of the first full fiscal year after enactment or October 1, 2027.
