H.R. 4651 — Immigration Enforcement Staff Body Camera Accountability Act

This section requires the Director of U.S. Immigration and Customs Enforcement (ICE) and the Commissioner of U.S. Customs and Border Protection (CBP) to ensure, not later than the finalization of a required Department of Homeland Security (DHS) rule, that all immigration enforcement staff—defined as all CBP and ICE agents and officers and all staff at immigration detention facilities who interact with detainees—wear body cameras during official operations and shifts. The section mandates that body cameras remain on for entire shifts; directs ICE and CBP to establish policies, procedures, and best practices for body camera use (including training), artificial intelligence and facial recognition review of footage (acknowledging technology limitations), and adverse actions; requires DHS to commence rulemaking within 60 days of enactment consistent with specified civil rights principles and model acts; makes footage available to parties in related administrative, civil, or criminal proceedings (with notification triggering potential adverse action if unavailable); subjects non-compliant staff to furlough, pay or grade reduction, or suspension up to 30 days (with malfunctions allowed only upon sufficient evidence); directs the DHS Inspector General to conduct annual privacy impact assessments of footage handling; and prohibits new appropriations, requiring implementation with existing funds.
