H.R. 4652 — Preventing Fraudulent ICE Impersonation Act of 2025

This section states congressional findings that unauthorized individuals have impersonated U.S. Immigration and Customs Enforcement (ICE) officers, causing fear and distrust; that unauthorized use of ICE insignia and apparel risks public safety, undermines law enforcement trust, and enables fraud; and that strengthening penalties and restricting sales of such items is necessary to protect communities.

This section establishes criminal and civil prohibitions on unauthorized use of U.S. Immigration and Customs Enforcement (ICE) apparel, badges, insignia, and related items. Specifically, it (1) makes it unlawful for non-DHS officers or employees to wear, display, or possess such items in a manner reasonably interpreted as impersonating a federal law enforcement officer, punishable by fine under title 18, United States Code, imprisonment for up to 7 years, or both; and (2) prohibits manufacturing, selling, offering for sale, or distributing such items without DHS authorization, subject to civil penalties of up to $100,000 per violation.

This section (1) subjects any unauthorized ICE apparel or insignia manufactured, sold, distributed, or possessed in violation of the Act to seizure and forfeiture, and (2) directs the United States Sentencing Commission to provide a sentencing enhancement of no less than six months' imprisonment for impersonation of an immigration official.

This section requires the Secretary of Homeland Security to (1) establish a public awareness campaign informing communities about dangers of individuals impersonating Immigration and Customs Enforcement (ICE) officers and providing reporting resources; and (2) establish a national reporting mechanism, including a dedicated hotline and online portal, for reporting such impersonations. It further requires the Comptroller General of the United States, not later than 180 days after enactment and every 180 days thereafter, to conduct a study on impersonation of immigration officials and underlying factors for potential solutions and submit a report to Congress.

This section defines, for purposes of this Act, (1) “ICE” as U.S. Immigration and Customs Enforcement and (2) “official” as (A) a public official or (B) a person selected to be a public official, as those terms are defined in 18 U.S.C. § 201(a)(1) and (2), respectively.
