H.R. 4658 — STUDENT Act

This section states congressional findings regarding the National Education Association (NEA), chartered by Congress in 1906 under 36 U.S.C. 151102 as the only federally chartered labor union. The findings include that (1) the NEA's federal charter implies congressional approval of its actions and advocacy; (2) the NEA has deviated from its core mission of elevating teaching and promoting education to become a political operation dedicated to electing Democrats and imposing a progressive agenda; (3) in July 2019, NEA members voted against prioritizing student learning; (4) at that assembly, NEA members supported abortion rights, illegal immigration, and educator training for Gender Sexuality Alliance clubs; (5) from September 2019 to August 2021, the NEA spent over $116,700,000 on political activities and lobbying, with 95.7% of its 2020 election cycle candidate contributions to Democrats; (6) in July 2021, the NEA supported critical race theory as reasonable and allocated $56,500 to research organizations opposing it in schools; (7) the NEA opposed school reopenings in 2020-2021 through strikes, donations, and CDC influence; (8) in July 2025, NEA members voted to end ties with the Anti-Defamation League over its positions on Israel and antisemitism, ceasing use of its antisemitism and Holocaust education materials; and (9) at that assembly, NEA members characterized former President Trump's policies as "fascism."

This section revises the membership eligibility provision (36 U.S.C. 151103) of the National Conference of State Legislatures by retaining the general rule that eligibility, rights, obligations, and classes of members are as provided in the bylaws while adding restrictions on dues collection from state or local government employees (as defined in 5 U.S.C. 3371). For such employees, the corporation and its state and local affiliates may accept dues or fees paid directly by the employee or indirectly via per capita taxes or other affiliate fees only if (1) the employee is notified of their First Amendment right to refrain from membership and payment; (2) the employee clearly and affirmatively consents to membership and payment; and (3) the employee authorizes transmittal of dues or fees without direct or indirect use of payroll deduction. The section further requires the corporation and affiliates to process and honor membership and dues cancellation requests as soon as practicable after receipt.

This section amends 36 U.S.C. 151105, concerning powers of the National Federation of Federal Employees, by (1) designating the existing introductory text as subsection (a) Powers and (2) adding subsection (b) Requirements imposing 16 obligations on the corporation and, as applicable, its state and local affiliates. Those requirements prohibit political activity or influencing legislation; discrimination or quotas based on race, color, religion, sex, disability, age, or national origin; promoting specified race- or sex-based beliefs, antisemitism, or related concepts; and strikes, work stoppages, or slowdowns against state or local governments. They further require U.S. citizenship for officers; maintenance of tax-exempt status under the Internal Revenue Code of 1986; representative governance without concentrated control; liability for acts of officers and agents; compliance with service-of-process laws; recordkeeping and inspection rights; annual reports to Congress; restrictions on compensation derived from government payments to certain officers and representatives; and asset disposition upon dissolution to the U.S. Treasury or equally among certain members. The Attorney General may seek equitable relief in federal court for noncompliance, and the corporation and affiliates are deemed labor organizations under the Labor-Management Reporting and Disclosure Act of 1959 (29 U.S.C. 402 et seq.) and must comply with all applicable provisions of that Act.

This section repeals the exemption from District of Columbia taxation for real property of the National Education Association of the United States located in the District of Columbia, used for the corporation's chartered purposes, and not used to produce income; and for personal property used for those purposes or to produce income for them. It also terminates the requirement for the corporation to submit annual reports to the Secretary of Education detailing its property holdings, income, and uses.
