This section establishes a federal right for producers of covered livestock—defined as domestic animals raised for slaughter for human consumption or to produce milk products for human consumption (excluding those raised primarily for egg production)—to raise and market such livestock and their derived products in interstate commerce. It prohibits any state or political subdivision from directly or indirectly enacting or enforcing production standards (i.e., related to raising or breeding) on covered livestock or their derived products that were not physically raised in that state, including as a condition of sale or consumption if such standards are additional to or different from those in the state of production. (Thus, states may regulate only livestock physically raised within their borders and cannot impose a patchwork of production requirements that restrict access to a national market.)
