H.R. 4697 — Justice for American Victims of Illegal Aliens Act

This section adds a new aggravating factor in federal death penalty cases for a defendant who is an alien unlawfully present in the United States (i.e., who came to, entered, or remains in violation of federal law) and has been convicted of killing, attempting to kill, or conspiring to kill a U.S. citizen. (As background, 18 U.S.C. 3592(c) lists statutory aggravating factors that the government may allege to justify a death sentence where otherwise authorized by federal law.)
