H.R. 4711 — REMOVE Act

This section revises INA §239(d) (8 U.S.C. 1229(d)) by (1) requiring the Attorney General to commence removal proceedings as promptly as possible after U.S. Immigration and Customs Enforcement files a Notice to Appear served on an alien (previously limited to expeditiously after conviction for deportable offenses) and, for aliens convicted of an offense making them deportable under INA §237(a), as expeditiously as possible after conviction; and (2) requiring the Attorney General to complete all such proceedings within 15 days of commencement, notwithstanding other laws (e.g., INA §208(d)(5)(A) asylum deadlines), with the prior custody exception redesignated as paragraph (3). (Thus, these changes accelerate removal for all aliens subject to a Notice to Appear, including non-criminals.)
