H.R. 473 — SHOW UP Act of 2025

This section requires each executive agency, not later than 30 days after the date of enactment, to adopt and apply telework policies, practices, and levels equivalent to, or permitting no more telework than, those in effect on December 31, 2019. Agencies may not expand any such policy, practice, or level until submitting to Congress an agency plan certified by the Director of the Office of Personnel Management under section 3.

This section directs the head of each Executive agency (i.e., an Executive department, Government corporation, or independent establishment per 5 U.S.C. 105, excluding the Government Accountability Office), in consultation with the Director of the Office of Personnel Management, to submit to Congress not later than 6 months after enactment (1) a study analyzing specified impacts of the agency's expansion and maintenance of employee telework during the 2019 SARS-CoV-2 pandemic—including adverse effects on mission and customer service performance, costs from underutilized real property or excess locality pay, deficiencies in secure tools and equipment, workforce dispersal nationwide, and other relevant factors; (2) any plan to expand telework policies, practices, or levels beyond those established by section 2; and (3) a certification by the OPM Director that the plan will substantially improve agency mission and customer service performance, increase nationwide workforce dispersal (reversing any prior adverse dispersal effects), reduce real property costs and locality pay costs for employees outside their official worksite's pay locality, and ensure teleworkers' full productivity via secure network capacity, communications tools, data access, Federal records, and equipment without substantially raising overall such costs. It prohibits implementation of any such plan without the OPM Director's certification (allowing submission of subsequent plans for certification) and defines key terms, including "agency," "Director," "locality pay" (per 5 U.S.C. 5304 or 5304a), and "telework" or "teleworking" (per 5 U.S.C. 6501, including remote work).
