H.R. 4754 — Department of the Interior, Environment, and Related Agencies Appropriations Act, 2026

This section authorizes the Secretary of the Interior to expend or transfer appropriations made available in this title—within each bureau or office—for emergency reconstruction, replacement, or repair of aircraft, buildings, utilities, or other facilities or equipment damaged or destroyed by fire, flood, storm, or other unavoidable causes, after funds specifically appropriated to the Department of the Interior for emergencies are exhausted and subject to replenishment by a supplemental appropriation requested as promptly as possible.

This section authorizes the Secretary of the Interior to expend or transfer any no-year appropriations in this title, in addition to budgeted amounts, for (1) suppression or emergency prevention of wildland fires on or threatening Department of the Interior (DOI) lands; (2) emergency rehabilitation of burned-over DOI lands; (3) emergency actions related to earthquakes, floods, volcanoes, storms, or other unavoidable causes; (4) contingency planning after oil spills; (5) response and natural resource damage assessment for oil spills or hazardous substance releases; (6) prevention, suppression, and control of grasshopper and Mormon cricket outbreaks on DOI lands; (7) emergency reclamation projects under §410 of the Surface Mining Control and Reclamation Act of 1977; and (8) transfers from Office of Surface Mining Reclamation and Enforcement no-year funds to assume regulatory authority if a primacy state fails to comply with the Surface Mining Control and Reclamation Act. Appropriations for wildland fire operations are available for obligations incurred in the prior fiscal year and to reimburse other federal agencies for equipment destroyed in such operations (with reimbursements credited to current appropriations). For wildland fire operations, funds may not be used until the Secretary certifies that "wildland fire suppression" appropriations will be exhausted within 30 days, and all transferred funds must be replenished via supplemental appropriation requested promptly, with replenishment reimbursing source accounts on a pro rata basis.

This section makes appropriations to the Department of the Interior in this title available for (1) services as authorized by 5 U.S.C. § 3109 (i.e., temporary employment of experts or consultants), when authorized by the Secretary of the Interior, in a total amount not to exceed $500,000; (2) purchase and replacement of motor vehicles, including specially equipped law enforcement vehicles; (3) hire, maintenance, and operation of aircraft; (4) hire of passenger motor vehicles; (5) purchase of reprints; (6) telephone service in private residences in the field, when authorized under regulations approved by the Secretary; and (7) dues, when authorized by the Secretary, for library membership in societies or associations that issue publications to members only or at a price to members lower than to nonmember subscribers.

This section makes appropriations in this Act under the headings "Bureau of Indian Affairs and Bureau of Indian Education" and "Bureau of Trust Funds Administration"—as well as any prior-year unobligated balances under those headings—available for expenditure or transfer for Indian trust management and reform activities. Total funding for settlement support activities may not exceed amounts specifically designated in this Act for such purpose, and the Secretary must notify the House and Senate Committees on Appropriations within 60 days of any expenditure or transfer, including the amount and intended use.

This section authorizes the Secretary of the Interior to redistribute Tribal Priority Allocation (TPA) funds—including Tribal base funds—notwithstanding other law, to address Tribal funding inequities from identified unmet needs, dual enrollment, overlapping service areas, or inaccurate distribution methodologies. (TPA funds are the primary mechanism for the Bureau of Indian Affairs to allocate discretionary appropriations to tribes for core services such as public safety, natural resources, and human services.) No tribe's TPA funds may be reduced by more than 10% in FY2026, except in cases of dual enrollment, overlapping service areas, or inaccurate distribution methodologies.

This section requires the Secretary of the Interior to collect nonrefundable inspection fees in FY2026 from designated operators for facilities subject to inspection under 43 U.S.C. 1348(c) (i.e., Outer Continental Shelf oil and gas facilities), depositing fees into the Offshore Safety and Environmental Enforcement account. Annual fees apply to above-waterline facilities (excluding drilling rigs) in place at the start of FY2026 as follows: (1) $10,500 for facilities with no wells but with processing equipment or gathering lines; (2) $17,000 for facilities with 1 to 10 wells (active or inactive); and (3) $31,500 for facilities with more than 10 wells (active or inactive). Per-inspection fees apply in FY2026 to (1) drilling rigs at $30,500 for water depths of 500 feet or more and $16,700 for less than 500 feet; and (2) non-rig well operations (per 30 C.F.R. pt. 250, subpts. D, E, F, and Q) at $13,260 for water depths of 2,500 feet or more, $11,530 for 500 to 2,499 feet, and $4,470 for less than 500 feet. The Secretary must bill operators quarterly for annual facility fees (payment due within 30 days), within 30 days after the inspection month for drilling rigs (payment due within 30 days), and by the end of the following quarter for non-rig units (payment due by quarter end).

This section authorizes the Secretary of the Interior to enter into multiyear cooperative agreements with nonprofit organizations and other appropriate entities, and multiyear contracts under 41 U.S.C. § 3903 (waiving the five-year term limit of subsection (a)), for the long-term care and maintenance of excess wild free-roaming horses and burros on private land. Such agreements and contracts may not exceed 10 years, subject to renewal at the Secretary's discretion.

This section directs the United States Fish and Wildlife Service, in carrying out its responsibilities to protect threatened and endangered salmon species, to implement a system of mass marking for salmonid stocks (e.g., coho, chinook, steelhead) intended for harvest that are released from federally operated or federally financed hatcheries. (As background, mass marking—typically adipose fin clipping—distinguishes hatchery fish from wild stocks.) Marked fish must have a visible mark readily identifiable by commercial and recreational fishers. (Thus, such fishers can preferentially harvest hatchery-origin fish, reducing incidental catch of protected wild salmon.)

This section authorizes Indian Affairs, during FY2026, to record obligations against accounts receivable from state, local, and Tribal governments—or their political subdivisions—in carrying out cooperative work, provided that total obligations at fiscal year-end do not exceed total budgetary resources available at fiscal year-end.

This section authorizes the Secretary of the Interior, notwithstanding other federal grant and cooperative agreement laws, to make grants to or enter into cooperative agreements with private nonprofit organizations designated by the Secretary of Labor under title V of the Older Americans Act of 1965 (i.e., Community Service Employment for Older Americans program, which provides part-time community service employment to low-income individuals age 55 and older) to utilize older Americans in programs administered by the Secretary and consistent with those programs' laws. Prior to any such award, the Secretary must ensure it does not (1) displace current Department of the Interior employees, including partial displacement through reduced non-overtime hours, wages, or benefits; (2) use a program participant for a job or function where a federal employee is in layoff status from the same or substantially equivalent job; or (3) affect existing contracts for services.

This section authorizes the Secretary of the Interior to transfer funds among and between the Bureau of Indian Affairs, the Bureau of Indian Education, and successor offices and bureaus affected by the reorganization to implement an orderly transition to separate accounts, subject to the reprogramming guidelines specified in this Act.

This section authorizes federally recognized Indian tribes and authorized tribal organizations receiving Tribally Controlled School Grants under the Tribally Controlled Schools Act of 1988 (25 U.S.C. 2501 et seq.)—which support the operation of elementary and secondary schools serving Indian students—to obtain interagency motor vehicles and related services for grant activities to the same extent as contractors under the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5301 et seq.). (Thus, these grantees gain access to the federal interagency motor pool previously available only to certain tribal contractors.)

This section authorizes the Secretary of the Interior to use FY2026 funds available to the Department of the Interior's Appraisal and Valuation Services Office to establish minimum basic pay rates for Appraiser (GS-1171) employees at grades 11 through 15 that are up to 15% above the normally scheduled minimum rates. These higher rates apply to employees conducting real property appraisals and appraisal reviews in support of the Department's realty programs (i.e., acquisition, management, and disposal of federal lands and facilities) and must be consistent with 5 U.S.C. § 5305(e)-(h).

This section prohibits the Secretary of the Interior from using appropriated funds under the Endangered Species Act of 1973 to (1) write or issue a proposed or final rule regarding the greater sage-grouse or any distinct population segment of the species; or (2) implement, administer, or enforce any threatened or endangered species status for the greater sage-grouse or any distinct population segment. (Thus, the provision blocks federal regulatory actions on the species—a ground-nesting bird inhabiting sagebrush ecosystems across 11 western states—pending future appropriations or legislative changes.)

This section prohibits the use of funds appropriated by this or any other Act to finalize, implement, administer, or enforce the Draft Resource Management Plan Amendment or Draft Environmental Impact Statement for Greater Sage-Grouse Rangewide Planning, as referenced in 89 Fed. Reg. 18963 (March 15, 2024).

This section authorizes the National Park Service to retain up to 7% of State Conservation Grants program funds (54 U.S.C. § 200305) to provide matching grants to states, the District of Columbia, and insular areas for administrative costs of those state programs. (The program supports state and local land acquisition, development, and recreation planning.)

This section authorizes the Secretary of the Interior, in FY2026 and FY2027, to execute agreements among Department of the Interior bureaus and offices (e.g., Bureau of Land Management, National Park Service) to achieve operating efficiencies through (1) co-locating in shared facilities, utilities, and equipment; (2) nonreimbursably detailing or assigning staff for up to five business days; and (3) sharing staff and equipment to meet mission requirements. Such agreements must support mission alignment or geographic proximity, with costs allocated proportional to benefits (potentially including indirect costs), and the Secretary may transfer funds in advance or on a reimbursable basis to implement cost-sharing.

This section prohibits the obligation or expenditure of funds appropriated by this Act to process or approve any notice to proceed with construction activities for the Lava Ridge Wind Project right-of-way authorization until the Secretary of the Interior reviews the Department of the Interior's Record of Decision authorizing the project and, as appropriate, conducts a new comprehensive analysis pursuant to Section 2(b) of the Presidential Memorandum titled “Temporary Withdrawal of All Areas on the Outer Continental Shelf from Offshore Wind Leasing and Review of the Federal Government's Leasing and Permitting Practices for Wind Projects,” dated January 20, 2025.

This section directs the Bureau of Land Management, upon request by the claimant of a mining claim located within the area covered by Public Land Order 7921, to prioritize completion of a validity determination for such claim (i.e., an assessment of whether the claim demonstrates discovery of a valuable mineral deposit) and to strive to complete the determination not later than three years after receipt of the request.

This section prohibits the use of appropriated funds to ban lead ammunition or tackle, or to regulate lead levels therein, on federal lands or waters available for hunting or fishing unless (1) the Secretary of the Interior determines, based on field data from the specific site, that a wildlife population decline there is primarily caused by lead in such ammunition or tackle; and (2) the prohibition or regulation is consistent with applicable state law or fish and wildlife department policy or is approved by that state's fish and wildlife department. If the Secretary makes such a determination, the section requires a Federal Register notice explaining how the action meets these requirements.

This section prohibits the use of any federal funds to implement, administer, or enforce the November 25, 2022, Fish and Wildlife Service final rule listing the northern distinct population segment of the lesser prairie-chicken as threatened under the Endangered Species Act with a section 4(d) rule and the southern distinct population segment as endangered. (Thus, the rule's ESA protections—which restrict activities affecting the species' habitat in Kansas, Colorado, Oklahoma, Texas, and New Mexico—cannot be carried out.)

This section prohibits the use of any funds appropriated by this or any other Act to implement, administer, or enforce the final rule listing the northern long-eared bat as an endangered species under the Endangered Species Act (87 Fed. Reg. 73488, Nov. 30, 2022). (Thus, federal protections stemming from this listing cannot be carried out.)

This section directs the Secretary of the Interior to reissue, not later than 60 days after enactment, the November 3, 2020, final rule removing the gray wolf (*Canis lupus*) from the federal list of endangered and threatened wildlife under the Endangered Species Act. (Thus, the delisting—previously vacated by court order—takes effect upon reissuance.)

This section prohibits the use of funds appropriated by this or any other Act to implement, administer, or enforce the final rule titled “Endangered and Threatened Wildlife and Plants; Threatened Species Status With Section 4(d) Rule for North American Wolverine” (88 Fed. Reg. 83726 (November 30, 2023)), which designates the contiguous U.S. distinct population segment of the North American wolverine as a threatened species under the Endangered Species Act (ESA) and provides a section 4(d) rule specifying allowable management measures (e.g., incidental take authorizations).

This section prohibits the use of any federal funds to implement, administer, or enforce the final rule establishing a nonessential experimental population of grizzly bears in the North Cascades Ecosystem in Washington State (89 Fed. Reg. 36982, May 3, 2024). (Thus, the U.S. Fish and Wildlife Service cannot proceed with reintroducing grizzly bears to the area using appropriated funds.)

This section prohibits the Secretary of the Interior from using any funds to establish an experimental population of grizzly bears (*Ursus arctos horribilis*) in the Bitterroot Ecosystem of Montana and Idaho under the Endangered Species Act. (Thus, the U.S. Fish and Wildlife Service cannot designate or reintroduce grizzly bears to that area as a nonessential experimental population, which allows flexible management rules compared to full endangered status.)

This section prohibits the Secretary of the Interior from using appropriated funds to implement, administer, or enforce any proposed or final rule under the Endangered Species Act of 1973 with respect to fish legally held in captivity or in a controlled environment that maintains physical separation from wild populations of the same species.

This section prohibits the Secretary of the Interior from using funds appropriated by this or any other Act to facilitate or allow the introduction of American bison on the Charles M. Russell National Wildlife Refuge in Montana.

This section prohibits the use of funds appropriated by this Act to implement, administer, or enforce three final rules issued on April 5, 2024, revising regulations under the Endangered Species Act: (1) “Endangered and Threatened Wildlife and Plants; Regulations Pertaining to Endangered and Threatened Wildlife and Plants” (89 Fed. Reg. 23919); (2) “Endangered and Threatened Wildlife and Plants; Listing Endangered and Threatened Species and Designating Critical Habitat” (89 Fed. Reg. 24300); and (3) “Endangered and Threatened Wildlife and Plants; Regulations for Interagency Cooperation” (89 Fed. Reg. 24268).

This section directs the Secretary of the Interior, not later than 60 days after enactment, to reissue and implement Secretary's Order No. 3368 (dated September 11, 2018), which promotes transparency and accountability in Department of the Interior consent decrees and settlement agreements (e.g., by requiring public notice of proposed settlements and limiting payments to third parties). The section further prohibits use of funds appropriated by this Act to (1) rescind the reissued Order 3368; (2) reissue, enforce, administer, or implement Secretary's Order No. 3408 (dated June 17, 2022, which rescinded Order 3368); or (3) issue, enforce, administer, or implement any substantially similar order.

This section prohibits the use of any appropriated funds to implement, administer, or enforce the Bureau of Land Management final rule titled “Conservation and Landscape Health,” published in the Federal Register on May 9, 2024 (89 Fed. Reg. 40308). (Thus, the rule—which designates conservation as a use on public lands eligible for leasing alongside energy development, grazing, and recreation—is effectively blocked.)

This section prohibits the use of any appropriated funds for management of the Grand Staircase-Escalante National Monument except in compliance with the document titled “Record of Decision and Approved Resource Management Plans for the Grand Staircase-Escalante National Monument” (February 2020). (Thus, the Bureau of Land Management must adhere to that resource management plan for the approximately 1.87-million-acre monument in southern Utah.)

This section directs the Secretary of the Interior, not later than 60 days after the date of enactment of this Act, to issue as final the rule titled “Endangered and Threatened Wildlife and Plants; Regulations for Interagency Cooperation” (86 Fed. Reg. 2373 (January 12, 2021)). (As background, the rule revises regulations under section 7 of the Endangered Species Act governing federal interagency consultation on actions that may affect endangered or threatened species and critical habitat.)

This section prohibits the National Park Service from using funds appropriated by this Act to provide housing to an alien without lawful status under the immigration laws (as defined in section 101 of the Immigration and Nationality Act (8 U.S.C. 1101)).

This section requires the Secretary of the Interior, acting through the Director of the National Park Service, to prepare an environmental impact statement under the National Environmental Policy Act of 1969 prior to approving an operations permit under 36 C.F.R. subpart B §§9.80-9.90 for non-federal oil or gas operations within Big Cypress National Preserve. (Big Cypress National Preserve is a Florida unit of the National Park System containing pre-existing non-federal oil and gas rights subject to NPS regulation.)

This section directs the Secretary of the Interior, notwithstanding other law and except within areas subject to existing oil and gas leasing moratoria, to annually conduct, beginning in FY2026, a minimum of two region-wide oil and gas lease sales in the Gulf of America region's Central Planning Area and Western Planning Area and one such lease sale in the Alaska region of the Outer Continental Shelf, as described in the 2017–2022 Outer Continental Shelf Oil and Gas Leasing Proposed Final Program (November 2016). The section further requires such lease sales to comply with the Outer Continental Shelf Lands Act and to include all unleased areas not subject to a moratorium as of the lease sale date.

This section provides that nothing in this Act or its amendments affects four existing Outer Continental Shelf (OCS) leasing withdrawals and bans: (1) the September 8, 2020, presidential memorandum withdrawing certain U.S. OCS areas from leasing disposition; (2) the September 25, 2020, presidential memorandum withdrawing certain U.S. OCS areas from leasing disposition; (3) the December 20, 2016, presidential memorandum withdrawing certain areas off the Atlantic Coast OCS from leasing disposition; or (4) the ban on oil and gas development in the Great Lakes under section 386 of the Energy Policy Act of 2005.

This section directs the Secretary of the Interior to immediately resume quarterly onshore oil and gas lease sales under the Mineral Leasing Act (MLA, 30 U.S.C. 181 et seq.) upon completion of applicable scoping, public comment, and environmental review requirements under the MLA and National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.). It also amends MLA §17(b)(1)(A) (30 U.S.C. 226(b)(1)(A)) to define eligible lands as all lands subject to leasing under the MLA not excluded by statute or regulation and available lands as those designated open under land use plans, nominated via expressions of interest, subject to drainage without leasing, or otherwise designated by regulation. The section further requires the Secretary to conduct a minimum of four oil and gas lease sales each fiscal year in each of Wyoming, New Mexico, Colorado, Utah, Montana, North Dakota, Oklahoma, Nevada, Alaska, and any other state with available lands under the MLA or other mineral leasing laws, offering all nominated and eligible parcels under the applicable resource management plan. (Thus, these sales support oil and gas exploration, development, and production on federal lands managed principally by the Bureau of Land Management.) If a required sale is canceled, delayed, deferred (including for lack of eligible parcels), or results in 25% or more of offered acreage receiving no bids, the Secretary must conduct a replacement sale in the same fiscal year. If any such sale is missed, the Secretary must submit a report to the House and Senate Appropriations and Natural Resources and Energy and Natural Resources Committees within 30 days detailing the missed sale and reasons therefor.

This section prohibits the use of funds provided by this Act to implement, administer, or enforce the final rule titled “Ten-Day Notices and Corrective Action for State Regulatory Program Issues” (89 Fed. Reg. 24714 (April 9, 2024)). (The rule, issued by the Department of the Interior's Office of Surface Mining Reclamation and Enforcement, revises procedures under the Surface Mining Control and Reclamation Act of 1977 for addressing deficiencies in approved state regulatory programs by shortening the notice period for corrective action from 60 days to 10 days.)

This section prohibits the use of funds made available by this or any other Act to implement, administer, or enforce the Bureau of Land Management final rule titled “Management and Protection of the National Petroleum Reserve in Alaska,” published May 7, 2024 (89 Fed. Reg. 38712), or any successor or substantially similar rule.

This section directs the Secretary of the Interior to reissue, not later than 180 days after enactment, the 2017 final rule removing the Greater Yellowstone Ecosystem population of grizzly bears from the federal list of endangered and threatened wildlife under the Endangered Species Act (i.e., delisting them), without regard to any other applicable law. The reissuance, including this section, is not subject to judicial review.

This section prohibits the National Park Service from using any funds to designate or manage Big Cypress National Preserve as wilderness or as a component of the National Wilderness Preservation System.

This section prohibits the use of funds appropriated by this Act for any activity or the publication or distribution of literature that promotes public support for or opposition to any legislative proposal on which congressional action is not complete, other than communications to Members of Congress as described in 18 U.S.C. 1913.

This section requires the amount and basis of estimated overhead charges, deductions, reserves, or holdbacks—including working capital fund charges—from programs, projects, activities, and subactivities to support government-wide, departmental, agency, or bureau administrative functions or headquarters, regional, or central operations to be presented in annual budget justifications for approval by the House and Senate Committees on Appropriations. It further requires changes to such estimates to be presented to those committees for approval.

This section prohibits the obligation or expenditure of funds appropriated by this Act to accept or process applications for patents for mining or mill site claims located under the general mining laws (i.e., 30 U.S.C. ch. 2). It provides exceptions for claims where (1) a patent application was filed with the Secretary of the Interior on or before September 30, 1994, and (2) all applicable statutory requirements for vein or lode, placer, or mill site claims were fully complied with by that date. The section further directs the Secretary to submit a report by September 30, 2027, to the House and Senate Committees on Appropriations and the House Committee on Natural Resources and the Senate Committee on Energy and Natural Resources on actions taken pursuant to the plan required by section 314(c) of the Department of the Interior and Related Agencies Appropriations Act, 1997 (P.L. 104-208). Finally, it authorizes eligible patent applicants to fund qualified third-party contractors—selected by the Bureau of Land Management (BLM) Director and paid by BLM using standard procedures—to conduct mineral examinations of claims or mill sites in a patent application.

This section limits contract support costs funding for fiscal year 2026—provided under specified headings for the Department of Health and Human Services, Indian Health Service, and Department of the Interior, Bureau of Indian Affairs and Bureau of Indian Education—to those amounts only, for costs arising from self-determination or self-governance contracts, grants, compacts, or annual funding agreements with the Indian Health Service, Bureau of Indian Affairs, or Bureau of Indian Education. (Contract support costs reimburse tribes for indirect administrative expenses when they operate federal programs.) Such funds are not available for claims, settlements, or judgments related to contract support costs for prior fiscal years.

This section exempts the Secretary of Agriculture from violating the National Forest Management Act of 1976 (NFMA) solely for failing to revise a National Forest System unit's land management plan within 15 years. (As background, NFMA requires the Forest Service to develop land and resource management plans for each National Forest System unit and revise them at least every 15 years.) The exemption does not apply to other NFMA requirements or laws and is void for any plan if the Secretary fails to act expeditiously and in good faith, within available funding, to revise it, in which case a court may order accelerated completion.

This section prohibits the expenditure of funds provided in this Act for preleasing, leasing, and related activities under the Mineral Leasing Act (i.e., onshore federal minerals) or the Outer Continental Shelf Lands Act (i.e., offshore oil and gas) within boundaries of National Monuments established under the Antiquities Act as of January 20, 2001, except where authorized by the establishing Presidential proclamation.

This section prohibits the use of funds appropriated in this Act for filing declarations of taking or complaints in condemnation to acquire lands or interests in lands without approval of the House and Senate Committees on Appropriations, except for funds to implement the Everglades National Park Protection and Expansion Act of 1989 or for federal assistance to Florida to acquire lands for Everglades restoration purposes.

This section prohibits executive branch agencies from using funds appropriated or otherwise made available by this Act to enter into any federal contract unless the contract complies with Chapter 33 of title 41, United States Code; Chapter 137 of title 10, United States Code; and the Federal Acquisition Regulation. Exceptions apply to (1) contracts specifically authorized by federal law without regard to these requirements, including formula grants to states or federally recognized Indian tribes; (2) contracts authorized by the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5301 et seq.) or other federal laws authorizing contracts within an Indian tribe as defined in section 4(e) of that Act (25 U.S.C. 5304(e)); and (3) contracts awarded prior to the date of enactment of this Act.

This section requires any agency receiving funds under this Act to post on its public website any report required to be submitted to Congress in this or any other Act, upon the agency head's determination that it serves the national interest. The requirement does not apply if posting the report would compromise national security or reveal proprietary information (subsection (b)); further, the agency must make the report available to the requesting congressional committee or committees for at least 45 days prior to posting (subsection (c)).

This section restricts grants from funds provided to the National Endowment for the Arts (NEA) as follows: (1) limits individual grants to literature fellowships, National Heritage Fellowships, or American Jazz Masters Fellowships; (2) requires procedures ensuring that no grantee—except a state or local arts agency or regional group—may subgrant funds to another organization or individual for independent activities (while allowing payments for goods and services); and (3) prohibits grants for seasonal support to a group unless the application specifies the season's contents, including identified programs or projects.

This section directs the Chairperson of the National Endowment for the Arts (NEA), in providing services or awarding financial assistance under the National Foundation on the Arts and the Humanities Act of 1965 using funds appropriated under this Act, to (1) give priority to projects, productions, workshops, or programs serving underserved populations (i.e., urban minorities historically outside arts programs due to poverty or geographic isolation); and (2) give priority to projects, productions, workshops, or programs encouraging public knowledge, education, understanding, and appreciation of the arts. With respect to funds appropriated to carry out section 5 of such Act, the section further directs the Chairperson to (1) establish a grant category for projects, productions, workshops, or programs of national impact or availability or able to tour several states; (2) limit grants to any single state to no more than 15%, in the aggregate, of such funds (excluding grants under the new category); (3) report annually to Congress on grants awarded, by state and grant category; and (4) encourage grants to improve and support community-based music performance and education.

This section directs the Department of the Interior, the Environmental Protection Agency, the Forest Service, and the Indian Health Service to submit quarterly reports to the House and Senate Committees on Appropriations on the status of their appropriation balances, including all uncommitted, committed, and unobligated funds in each program and activity, with the first report due within 60 days of enactment.

This section provides that the terms and conditions of section 325 of Public Law 108-108—prohibiting the Forest Service from unilaterally changing the terms of existing grazing permits on National Forest System lands not administered under section 402 of the Federal Lands Policy and Management Act (i.e., non-BLM lands)—remain in effect for FY2026.

This section prohibits the use of funds made available by this Act to maintain or establish a computer network unless the network is designed to block access to pornography websites. Subsection (b) exempts from this prohibition funds necessary for federal, state, tribal, or local law enforcement agencies or other entities carrying out criminal investigations, prosecutions, or adjudications.

This section authorizes the Secretary of the Interior, with respect to Bureau of Land Management lands, or the Secretary of Agriculture, with respect to Forest Service lands (referred to as the "Secretary concerned"), to transfer excess wild horses and burros removed from such lands to other Federal, State, or local government agencies for use as work animals, immediately upon agency request. Transferred animals lose their status as wild free-roaming horses or burros under the Wild Free-Roaming Horses and Burros Act (16 U.S.C. 1332). Receiving agencies are prohibited from (1) destroying the animals into a commercial product; (2) selling or transferring them in a manner resulting in commercial processing; or (3) euthanizing except on a licensed veterinarian's recommendation for severe injury, illness, or advanced age. Amounts appropriated by this Act are unavailable for (1) destruction of healthy, unadopted wild horses or burros under the Secretary concerned's jurisdiction (including contractors); or (2) sales of wild horses or burros resulting in commercial processing.

This section prohibits the use of funds from state drinking water state revolving funds (DWSRFs), as authorized by §1452 of the Safe Drinking Water Act (42 U.S.C. 300j–12), for public water system or treatment works projects unless all iron and steel products—defined to include pipes and fittings, manhole covers, hydrants, tanks, flanges, pipe clamps, valves, structural steel, reinforced precast concrete, and construction materials—are produced in the United States. (As background, DWSRFs provide subsidized loans and grants to states and localities for drinking water infrastructure.) It authorizes the EPA Administrator to waive this requirement if (1) applying it is inconsistent with the public interest, (2) such products are not produced in the United States in sufficient and reasonably available quantities and of satisfactory quality, or (3) their use increases overall project costs by more than 25 percent; requires the Administrator to post waiver requests online and allow at least 15 days for informal public input prior to deciding. This section requires application consistent with U.S. international obligations and permits EPA to retain up to 0.25% of appropriations for clean water and drinking water SRFs for management and oversight.

This section authorizes the Secretary of the Interior to enter into grants and cooperative agreements with volunteer fire departments, rural fire departments, rangeland fire protection associations, and similar organizations to provide wildland fire training and equipment, including supplies and communication devices. The section further authorizes the Secretary to transfer title to excess Department of the Interior firefighting equipment no longer needed for the department's wildland fire management program to such organizations, notwithstanding certain federal property management requirements (40 U.S.C. §§121(c), 521).

This section prohibits reprogramming of funds made available by this Act or prior fiscal years without advance approval from the House and Senate Committees on Appropriations, in accordance with reprogramming procedures specified in the report accompanying this Act.

This section extends through FY2026 (from FY2019) the authority to use 75% of timber sale receipts from the 18 western Oregon national forests for National Forest System road and trail construction, reconstruction, and maintenance (with the remainder to the U.S. Treasury). (The provision stems from Section 339 of the FY2000 Interior Appropriations Act.)

This section modifies leases under section 105(l) of the Indian Self-Determination and Education Assistance Act (ISDEAA), which allow the Departments of the Interior (Bureau of Indian Affairs) and Health and Human Services (Indian Health Service) to lease tribally owned facilities for administering federal programs serving tribes, with tribes receiving fair market rent. Specifically, it (1) requires the initial lease term to commence no earlier than the date of receipt of the lease proposal, notwithstanding other law; and (2) directs the Secretaries of the Interior and Health and Human Services, jointly or separately, to consult with tribes and tribal organizations during FY2026 through public solicitation and other means on implementing a consistent and transparent process for such lease payments.

This section extends the Forest Ecosystem Health and Recovery Fund—established for Forest Service projects to restore forest ecosystems, reduce hazardous fuels, and improve resilience to wildfires and insects—through FY2026 (from FY2020).

This section directs the Secretaries of the Interior and Agriculture to allocate Land and Water Conservation Fund (LWCF) amounts for FY2026—pursuant to 54 U.S.C. §200303(a)—within specified timelines and for projects listed in a table titled “Allocation of Funds: Land and Water Conservation Fund Fiscal Year 2026” in the accompanying report, as follows: (1) within 45 days of enactment, to Forest Service “Land Acquisition Projects” and “Forest Legacy Projects” accounts (excluding Bureau of Land Management, U.S. Fish and Wildlife Service, and National Park Service “Land Acquisition Projects”); and (2) for the latter three agencies’ “Land Acquisition Projects,” following congressional approval of project lists and supplementary allocation lists (totaling at least half the table amounts for each agency) submitted by the Secretary of the Interior within 30 days of enactment as reprogrammings under section 421, with final allocations within 45 days of approval. It further requires 30-day prior notice to the House and Senate Committees on Appropriations for any expenditures on portions of specified projects outside listed tracts but within unit boundaries; prohibits the President or designee from allocating FY2026 LWCF amounts other than as specified (except for continuing program administration up to those amounts); and directs the Secretary of Agriculture, with the FY2027 budget request, to submit prioritized supplementary allocation lists for Forest Service federal land acquisition and Forest Legacy Projects totaling at least half the allocated amounts (identifying any unneeded prior allocations). (The LWCF supports federal and state land acquisition for recreation, wildlife habitat, and public access.)

This section directs the Secretary of Energy, the Secretary of Agriculture, and the EPA Administrator to jointly (1) ensure consistent federal policy on forest bioenergy across agencies that recognizes its benefits for energy production, conservation, and responsible forest management; and (2) establish clear policies for forest biomass as an energy solution that (A) reflect its carbon neutrality as a renewable energy source (provided it does not cause conversion of forests to non-forest use), (B) encourage private investment throughout the supply chain (e.g., working forests, harvesting, bioenergy production), (C) promote forest management to improve forest health, and (D) recognize state initiatives.

This section prohibits the use of funds appropriated by this Act to implement or enforce the March 21, 2011, regulation at 40 CFR part 60, subparts CCCC and DDDD—New Source Performance Standards for commercial and industrial solid waste incineration units—with respect to small, remote incinerator units (as defined therein) in Alaska. Until a subsequent regulation is issued, it requires the EPA Administrator to implement the law and regulations in effect prior to that date for such units.

This section prohibits the advertisement of timber sales in Alaska’s Region 10 (i.e., Tongass National Forest) if the indicated rate is a deficit—defined as the timber value being insufficient to cover all logging and stumpage costs plus a normal profit and risk allowance—when appraised using a residual value appraisal. For western red cedar surplus to Alaska domestic processors’ needs, the section (1) requires availability to domestic processors in the contiguous 48 states at prevailing domestic prices, (2) allows additional volume not sold domestically to be exported to foreign markets at the timber sale holder’s election, and (3) permits all Alaska yellow cedar to be sold at prevailing export prices at the holder’s election.

This section authorizes the further allocation or reallocation of funds made available or allocated in this Act to the Department of the Interior or Department of Agriculture—funds subject to allocations and limitations in 54 U.S.C. 200402(e) and prohibitions in 54 U.S.C. 200402(f)—to the Federal Highway Administration for transportation projects of covered agencies defined in 54 U.S.C. 200401(2) (i.e., National Park Service, U.S. Fish and Wildlife Service, Bureau of Land Management, and Forest Service). (Thus, the provision provides flexibility to bypass certain statutory restrictions on Federal Lands Transportation Program funds for DOI- and USDA-managed infrastructure.)

This section prohibits the use of any federal funds to promulgate or implement regulations requiring Clean Air Act title V operating permits for carbon dioxide, nitrous oxide, water vapor, or methane emissions resulting from biological processes associated with livestock production. (Title V, 42 U.S.C. 7661 et seq., requires federally enforceable operating permits for major stationary sources of regulated air pollutants.)

This section prohibits the use of any federal funds to implement rule provisions requiring mandatory reporting of greenhouse gas emissions from manure management systems.

This section prohibits the use of federal funds to regulate the lead content of ammunition, ammunition components, or fishing tackle under the Toxic Substances Control Act (TSCA, 15 U.S.C. 2601 et seq.) or any other law.

This section (1) revises the premium pay cap waivers for federal employees by disregarding, in applying subsection (a)(1), services performed in a given calendar year that generate payments payable in the subsequent calendar year; and (2) applies the waivers authorized in subsections (a) through (c) in FY2026. (The waivers suspend the aggregate pay limitation under 5 U.S.C. 5547 for eligible employees such as law enforcement officers and firefighters, allowing full premium and overtime pay.)

This section revises reporting requirements under sec. 104 of the Wildfire Suppression Funding and Forest Management Activities Act—which established a reserve fund for large-scale wildfire suppression costs incurred by the Forest Service (USDA) and Department of the Interior—by (1) extending the deadline for the Secretaries of Agriculture and the Interior to submit the annual report on fund obligations to 180 days (from 90 days) after the end of the fiscal year; and (2) requiring the report to include an accounting of spending in the first two quarters of the succeeding fiscal year attributable to suppression operations in the fiscal year covered by the report.

This section prohibits the use of funds appropriated by this or any other Act for any fiscal year to restrict access to or use of Federal land (as defined in the Healthy Forests Restoration Act of 2003) for hunting, fishing, or recreational shooting if such activities were allowed and compliant with the applicable resource management plan as of January 1, 2013. The Secretaries of the Interior and Agriculture may temporarily close such land to these activities for up to 30 days for special events or public safety, with one additional 90-day extension for extraordinary weather or public safety. This section does not affect state authority to manage fish and resident wildlife.

This section prohibits the use of funds appropriated by this Act to implement, administer, apply, enforce, or carry out any office, program, or activity for diversity, equity, and inclusion (DEI) training or implementation.

This section prohibits the use of any funds made available by this Act to carry out any program, project, or activity that promotes or advances Critical Race Theory or any concept associated with Critical Race Theory.

This section prohibits the use of funds appropriated by this Act or prior appropriations Acts to take discriminatory action against any person wholly or partially on the basis that such person speaks or acts in accordance with a sincerely held religious belief or moral conviction that marriage is or should be recognized as a union of one man and one woman, notwithstanding 1 U.S.C. §7, 28 U.S.C. §1738C, or any other provision of law. Discriminatory action includes (1) altering federal tax treatment, assessing taxes or penalties, or denying tax-exempt status under IRC §501(a); (2) disallowing deductions for charitable contributions; (3) withholding, reducing, excluding, terminating, or denying federal grants, contracts, loans, employment, or similar benefits; (4) withholding, reducing, excluding, terminating, or denying entitlements or benefits under federal programs, including equal treatment in educational programs; or (5) withholding, reducing, excluding, terminating, or denying access to federal property, facilities, educational institutions, speech fora, or charitable fundraising. This section further requires the federal government to deem accredited, licensed, or certified for federal law purposes any person who would be so but for a determination based wholly or partially on such a belief or conviction.

This section amends Section 2337 of the Revised Statutes (30 U.S.C. 42) to authorize proprietors of lode or placer mining claims to locate additional mill sites, each not exceeding 5 acres, on public lands reasonably necessary for waste rock or tailings disposal or other operations incident to mineral development under an approved plan of operations; such mill sites convey no mineral rights, are ineligible for patenting, may overlap with the associated claim, and do not affect claim validity. (As background, traditional mill sites under the General Mining Law of 1872 support mining claims by providing locations for ore processing and related uses; plans of operations under 43 CFR part 3809 or 36 CFR part 228 are required for operations disturbing more than casual use levels on federal lands administered by the Bureau of Land Management or Forest Service.) The amendment includes multiple savings clauses preserving existing claim rights, federal regulatory authority (e.g., under the Federal Land Policy and Management Act and Endangered Species Act), and prior land withdrawals while not creating new rights on closed lands. This section establishes the Abandoned Hardrock Mine Fund in the Treasury, deposits claim maintenance fees assessed on these mill sites (under 30 U.S.C. 28f(a)(1)) into the fund, and authorizes the Secretary of the Interior to expend amounts without further appropriation solely for abandoned hardrock mine reclamation under section 40704 of the Infrastructure Investment and Jobs Act (30 U.S.C. 1245), with allocations and transfers per that section. (As background, section 40704 provides grants to eligible states, tribes, and the federal government to inventory, assess, and remediate abandoned hardrock mines that pose environmental, health, or safety hazards.) (Thus, mill site fees directly support nationwide hardrock cleanup efforts.) This section makes clerical amendments to the claim maintenance fee provision (30 U.S.C. 28f) by replacing references to the Mining Law of 1872 (30 U.S.C. 28–28e) with broader language encompassing mill sites.

This section directs the Secretary of the Interior to reinstate, not later than 30 days after enactment and notwithstanding any other provision of law, two hardrock mineral leases (MNES-01352 and MNES-01353) issued in 2019 for the Superior National Forest in Minnesota, with such action not subject to further judicial review.

This section prohibits the use of appropriated funds to consider or incorporate the social cost of carbon in (1) any cost-benefit analysis required or performed pursuant to any law, specified executive orders (Nos. 13990 and 14094), a specified presidential memorandum, revisions to OMB Circular A-4, or a specified 2021 technical support document; (2) any rulemaking; (3) issuance of any guidance; (4) any other agency action; or (5) as justification for any rulemaking, guidance, or agency action. (As background, the social cost of carbon is a government estimate of the economic damages per additional metric ton of carbon dioxide emissions, used to quantify climate-related costs and benefits in federal regulatory analyses.)

This section enacts into law H.R. 226 of the 119th Congress (Eastern Band of Cherokee Historic Lands Reacquisition Act), as passed by the House of Representatives on February 4, 2025. The section directs the Archivist of the United States to include the text of that bill in an appendix when publishing this Act in slip form and the United States Statutes at Large pursuant to 1 U.S.C. 112.

This section prohibits the obligation of appropriated funds to require or request, as a condition of issuing, renewing, or extending any Forest Service or Bureau of Land Management permit, lease, allotment, easement, or other land use authorization, the transfer or relinquishment of any water right granted under state law. (Thus, federal land managers may not condition such authorizations on water rights holders yielding their state-law rights.)

This section directs the Secretary of Agriculture to convey, by quitclaim deed, all U.S. right, title, and interest in specified National Forest System land in Riverside County, California (as generally depicted on the map entitled “Sunnymead Cactus Avenue Channel Proposed Land Conveyance,” dated May 13, 2024), to the Riverside County Flood Control and Water Conservation District upon the district's submission of a written request within 365 days of enactment. The conveyance requires a survey satisfactory to the Secretary to determine exact acreage and legal description; is subject to existing rights and terms protecting U.S. interests; obligates the district to pay fair market value (with proceeds deposited in the Sisk Act fund, 16 U.S.C. 484a, and available without further appropriation), all associated costs (including survey and any required environmental analysis), and limited CERCLA disclosure only (42 U.S.C. 9620(h), with no U.S. remediation obligation); and absolves the Secretary of any future costs for infrastructure, facilities, or improvements on the land.

This section prohibits the use of funds provided by this Act to withdraw federal lands from entry, appropriation, or disposal under public land laws; location, entry, or patent under general mining laws; or disposition under mineral leasing, mineral materials, or geothermal leasing laws unless such withdrawal is authorized by an Act of Congress.

This section prohibits the use of funds provided by this Act to issue or revise any regulation under Section 17(o) of the Mineral Leasing Act (30 U.S.C. 226(o)) concerning oil and gas development on outstanding and reserved mineral rights (i.e., privately held minerals underlying federal lands) within the Allegheny National Forest.

This section revises the valuation standard for payments under Section 5 of the Act of June 22, 1948 (16 U.S.C. 577g)—which authorizes the Secretary of Agriculture to make payments to Minnesota for certain lands conveyed to the United States for inclusion in the Superior National Forest—to the highest fair appraised value, including the historical fair appraised value, as determined by the Secretary (from the fair appraised value).

This section prohibits the use of appropriated funds to issue or adopt guidance or policy, take regulatory action, or approve pesticide labeling or changes to such labeling that is inconsistent with or differs from (a) a human health assessment under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) or (b) a carcinogenicity classification for a pesticide.

This section prohibits the Environmental Protection Agency from using any federal funds to approve a Clean Air Act waiver requested by California for amendments to the state's rule titled “Small Off-Road Engine Regulations: Transition to Zero Emissions.” (Thus, the amendments—which require small off-road engines such as those in lawnmowers and leaf blowers to transition to zero-emission technologies—cannot take effect unless California receives the waiver through non-federal means.)

This section prohibits the use of federal funds appropriated by this or any other Act to implement, administer, or enforce the EPA final rule titled “Federal ‘Good Neighbor Plan’ for the 2015 Ozone National Ambient Air Quality Standards,” published on June 5, 2023 (88 Fed. Reg. 36654). (The rule, issued under Clean Air Act good neighbor provisions, requires specified electric generating units and industrial sources in 23 upwind states to reduce nitrogen oxide emissions contributing to ozone nonattainment in downwind states.)

This section prohibits the use of any appropriated funds to implement, administer, or enforce the Environmental Protection Agency's final rule establishing new source performance standards for greenhouse gas emissions from new, modified, and reconstructed fossil fuel-fired electric generating units; emission guidelines for greenhouse gas emissions from existing such units; and repeal of the Affordable Clean Energy Rule, as published in the Federal Register on May 9, 2024 (89 Fed. Reg. 39798).

This section prohibits the use of funds appropriated by this Act to finalize, implement, administer, or enforce the Environmental Protection Agency's (EPA) proposed interim registration review decision and draft risk assessment addendum for ethylene oxide, as published in the Federal Register on April 13, 2023 (88 Fed. Reg. 22447). The prohibition does not apply if the Commissioner of Food and Drugs certifies that such actions will not adversely impact the availability of ethylene oxide to sterilize medical products in the United States or result in the movement of any sterilization capacity for such products outside the United States. (Ethylene oxide sterilizes approximately half of U.S. medical devices, which are often heat-sensitive.)

This section prohibits the use of any appropriated funds to implement, administer, or enforce the EPA final rule titled “Multi-Pollutant Emissions Standards for Model Years 2027 and Later Light-Duty and Medium-Duty Vehicles” (published April 18, 2024; 89 Fed. Reg. 27842), or any substantially similar rule. (Thus, the rule—which sets increasingly stringent greenhouse gas and criteria pollutant standards for passenger cars, light trucks, and medium-duty vehicles starting in model year 2027—cannot be carried out using federal funds.)

This section prohibits the use of funds appropriated by this or any other Act to implement, administer, or enforce the Environmental Protection Agency's final rule titled “Greenhouse Gas Emissions Standards for Heavy-Duty Vehicles-Phase 3,” published in the Federal Register on April 22, 2024 (89 Fed. Reg. 29440), or any substantially similar rule.

This section prohibits the use of federal funds to implement, administer, or enforce the Environmental Protection Agency's final rule titled “Clean Water Act Section 401 Water Quality Certification Improvement Rule” published on September 27, 2023 (88 Fed. Reg. 66558). (Thus, states' authority to review federal permits for water quality impacts under CWA §401 remains governed by the prior 2020 rule.)

This section prohibits the use of any appropriated funds to implement, administer, or enforce the EPA final rule titled “Standards of Performance for New, Reconstructed, and Modified Sources and Emissions Guidelines for Existing Sources: Oil and Natural Gas Sector Climate Review,” published March 8, 2024 (89 Fed. Reg. 16820). (The rule establishes methane emission standards for new, reconstructed, modified, and existing sources in the oil and natural gas sector.)

This section prohibits the use of federal funds to implement, administer, or enforce the EPA final rule titled “Greenhouse Gas Reporting Rule: Revisions and Confidentiality Determinations for Petroleum and Natural Gas Systems,” published May 14, 2024 (89 Fed. Reg. 42062). (The rule revises the Greenhouse Gas Reporting Program to expand direct measurement and emissions reporting requirements for petroleum and natural gas systems—covering sources such as equipment leaks and flaring—and clarifies confidentiality determinations for certain reported data.)

This section prohibits the use of appropriated funds to finalize, implement, administer, or enforce the Environmental Protection Agency's proposed rule titled “Clean Water Act Effluent Limitations Guidelines and Standards for the Meat and Poultry Products Point Source Category,” published in the Federal Register on January 23, 2024 (89 Fed. Reg. 4474). (As background, the proposed rule would update technology-based wastewater pollutant discharge limits for meat and poultry processing facilities.)

This section prohibits the use of any appropriated funds to implement, administer, or enforce the EPA final rule titled “Hazardous and Solid Waste Management System: Disposal of Coal Combustion Residuals From Electric Utilities; Legacy CCR Surface Impoundments,” published on May 8, 2024 (89 Fed. Reg. 38950). (As background, the rule requires assessments, groundwater monitoring, and closures for certain legacy CCR surface impoundments—i.e., older, unlined ponds holding coal ash wastes—at inactive electric utility facilities.)

This section prohibits the use of funds appropriated by this Act to implement any California regulation of metal shredding facilities—issued under the 2009 Memorandum of Agreement between the California Department of Toxic Substances Control and EPA Region IX (or successor agreement)—that is inconsistent with or differs from requirements of the Solid Waste Disposal Act. (Thus, such funds cannot support enforcement of California's potentially stricter or divergent standards for these facilities, which process scrap metal and generate regulated wastes.)

This section directs the EPA Administrator, not later than 30 days after enactment, to submit to the House and Senate Appropriations Committees a report outlining a plan to qualify any fuel derived from waste plastic or waste tires as cellulosic biofuel under the Renewable Fuel Standard (CAA §211(o)). (As background, the Renewable Fuel Standard requires obligated parties such as refiners to blend specified volumes of renewable fuels into transportation fuel, with cellulosic biofuels eligible to generate higher-value renewable identification numbers.) In preparing the report, the Administrator must consult relevant stakeholders and incorporate any input deemed appropriate.

This section prohibits the use of funds appropriated by this Act to develop, propose, finalize, implement, or enforce regulations implementing the methane emissions charge under section 136(c) of the Clean Air Act (CAA), or to otherwise impose, collect, or enforce such charge. (As background, section 136(c), added by the Inflation Reduction Act of 2022, imposes an annual charge on excess methane emissions from petroleum and natural gas facilities—starting at $900 per metric ton in 2024 and increasing annually to $1,500 by 2026—with revenues deposited in the Methane Emissions Reduction Program Account to support emissions reduction.)

This section declares that the Environmental Protection Agency notice approving Florida's request to assume administration of the Clean Water Act Section 404 permit program for dredged or fill material discharges (33 U.S.C. 1344)—published December 22, 2020, at 85 Fed. Reg. 83553 (titled “EPA's Approval of Florida's Clean Water Act Section 404 Assumption Request”)—has the force and effect of law. (Thus, Florida administers these permits in lieu of the U.S. Army Corps of Engineers for waters within the state.)

This section prohibits the use of any federal funds to implement, administer, or enforce the Environmental Protection Agency's final rule titled “Reconsideration of the National Ambient Air Quality Standards for Particulate Matter,” published on March 6, 2024 (89 Fed. Reg. 16202). (National Ambient Air Quality Standards, or NAAQS, set permissible levels of criteria air pollutants such as fine particulate matter, or PM2.5, to protect public health under the Clean Air Act.)

This section prohibits the use of Abandoned Mine Reclamation Fund (AMRF) moneys—provided to states and federally recognized Indian tribes for reclaiming abandoned mine lands and related activities—for implementing, administering, or enforcing 2 CFR § 200.311 (real property requirements under the Uniform Guidance for federal awards). (Thus, such grantees are exempt from federal rules on the use and disposition of real property acquired with AMRF funds.)

This section prohibits the use of any federal funds to implement, administer, or enforce the June 4, 2024, final rule listing six mussel species—Guadalupe fatmucket, Texas fatmucket, Guadalupe orb, Texas pimpleback, Balcones spike, and false spike—as endangered with critical habitat, and Texas fawnsfoot as threatened with a section 4(d) rule and critical habitat, under the Endangered Species Act. (Thus, the U.S. Fish and Wildlife Service cannot enforce ESA protections for these Texas freshwater mussels using appropriated funds.)

This section prohibits the use of any federal funds to implement, administer, or enforce the Final Land Protection Plan & Environmental Assessment for Muleshoe National Wildlife Refuge, published by the U.S. Fish and Wildlife Service in February 2023. (Land protection plans identify priorities for acquiring land or easements to expand refuge boundaries and enhance habitat conservation.)

This section prohibits the use of funds appropriated by this or any other Act to implement, administer, or enforce the Bureau of Land Management final rule titled “Fluid Mineral Leases and Leasing Process” published in the Federal Register on April 23, 2024 (89 Fed. Reg. 30916). (As background, the rule revises oil and gas leasing regulations on public lands, including higher royalty rates of 12.5%-16.67% (from 12.5%), increased rental rates, and additional lease sale requirements.)

This section prohibits the use of any federal funds to implement, administer, or enforce the EPA final rule titled “Determinations of Attainment by the Attainment Date, Extensions of the Attainment Date, and Reclassification of Areas Classified as Marginal for the 2015 Ozone National Ambient Air Quality Standards” (published October 7, 2022, at 87 Fed. Reg. 60897) in Allegan County, Berrien County, or Muskegon County, Michigan. (Thus, preventing application of any attainment determinations, date extensions, or reclassifications under the rule to those marginal nonattainment areas.)

This section prohibits the use of any federal funds to implement or enforce the Environmental Protection Agency's (EPA) final rule titled "Control of Air Pollution From New Motor Vehicles: Heavy-Duty Engine and Vehicle Standards," published January 24, 2023 (88 Fed. Reg. 4296). (As background, the rule establishes Phase 3 greenhouse gas and criteria pollutant emission standards for heavy-duty vehicles and engines for model years 2027 through 2032.)

This section prohibits the use of federal funds to implement, administer, or enforce the Environmental Protection Agency's draft risk assessment titled “Draft Sewage Sludge Risk Assessment for Perfluorooctanoic Acid (PFOA) and Perfluorooctane Sulfonic Acid (PFOS),” published in the Federal Register on January 15, 2025 (90 Fed. Reg. 3859).

This section extends the directive for the Secretary of Agriculture to use $170 million of Commodity Credit Corporation funds for the Livestock Forage Disaster Program (LFP), Livestock Indemnity Program (LIP), Emergency Assistance for Livestock, Honeybees, and Farm-Raised Fish Program (ELAP), and Tree Assistance Program (TAP) during FY2012 and thereafter (from FY2012 and 2013 only). (As background, these programs provide financial assistance to eligible producers for specified disaster-related losses, including livestock mortality and forage shortages due to drought or other adverse weather.)

This section prohibits the obligation or expenditure of funds provided by this Act to restrict or impede public access to the Hetch Hetchy Reservoir and Lake Eleanor Basin areas for recreation, benefit, and use.

This section prohibits the use of funds appropriated or otherwise made available by this Act to procure computers, printers, or videoconferencing services—whether directly or by contract with a third party—if the manufacturer, bidder, or offeror, or any subsidiary or parent entity thereof, is an entity, or parent company of an entity, in which the People's Republic of China has any ownership stake.

This section prohibits the Smithsonian Institution from using funds provided in this Act to implement amendments made by Sec. 40005 of P.L. 119-21 to chapter 203 of title 51, United States Code, relating to space vehicle transfers.
