§2. Eviction right to counsel fund
This section establishes the Eviction Right to Counsel Fund in the U.S. Treasury and authorizes appropriations of $100 million for each of FY2026 through 2030 to fund grants by the Secretary of Housing and Urban Development. The grants go to state, local, or Indian tribal governments (as defined in 42 U.S.C. 5122) that enact or are fiscally responsible for implementing right-to-counsel legislation providing full legal representation at no cost to covered individuals—tenants with incomes at or below 200% of the federal poverty line—in covered proceedings, i.e., civil actions for eviction from a primary residence or termination of a housing subsidy. In awarding grants, the Secretary prioritizes applicants with laws limiting no-fault evictions, requiring at least 30 days' written notice for evictions, establishing eviction diversion programs, or providing emergency rental assistance, or those prioritizing attorney training and recruitment; recipients may use funds for costs of such legislation, including attorney training resources.
