H.R. 4770 — RESTART SUNSET Act of 2025

This section provides the short title of the Act as the “Regulatory Evidence-based Standards for Thorough Accountability and Reassuring Tests—Securing Updated and Necessary Statutory Evaluations Timely Act of 2025” or the “RESTART SUNSET Act of 2025”.

This section revises agency periodic review requirements under the Regulatory Flexibility Act (RFA) for rules with a significant economic impact on a substantial number of small entities (i.e., SEISNOSE rules). Specifically, it (1) eliminates the requirement to publish a plan for such reviews within 180 days of the RFA's effective date (or amendments thereto), (2) mandates review of all existing SEISNOSE rules within 10 years of enactment of this Act and new SEISNOSE rules within 10 years of final rule publication (resetting prior timelines tied to the RFA's 1980 effective date), and (3) requires annual Federal Register publication of rules determined not to be SEISNOSE rules, including the basis for that conclusion. The section further amends judicial review provisions to authorize courts to prohibit enforcement of any rule if an agency fails to comply with these review requirements. (Thus, noncompliance triggers an automatic enforcement ban rather than discretionary relief.)
