H.R. 4779 — National Security, Department of State, and Related Programs Appropriations Act, 2026

This section makes funds appropriated under title I of this Act available, except as otherwise provided, for (1) allowances and differentials authorized by subchapter 59 of title 5, United States Code; (2) services authorized by section 3109 of title 5, United States Code; and (3) hire of passenger transportation pursuant to section 1343(b) of title 31, United States Code.

This section requires any department or agency receiving funds under this Act to submit to the Appropriations Committees, not later than 30 days after the end of each fiscal quarter, a report accounting for cumulative unobligated balances and obligated but unexpended balances of all such funds received in FY2026 or any prior fiscal year. The report must disaggregate balances by program, project, and activity; Treasury Account Fund Symbol; and fiscal year of receipt, and specify by account the amounts obligated pursuant to bilateral agreements that have not been further sub-obligated.

This section limits expenditures of appropriations under title I of this Act for consulting services procured through contracts pursuant to 5 U.S.C. § 3109 to those contracts where such expenditures are a matter of public record and available for public inspection, except as otherwise provided under existing law or an existing executive order issued pursuant to existing law.

This section (1) permits construction projects for U.S. facilities to include office space or accommodations for U.S. Marine Corps members, notwithstanding capital security cost-sharing requirements under the Secure Embassy Construction and Counterterrorism Act of 1999; (2) subjects FY2026 funds appropriated for Department of State, foreign operations, and related programs for overseas U.S. diplomatic facility property acquisition or construction contracts to prior consultation with and notification procedures of the Committees on Appropriations, including early consultations on out-year projects and quarterly reports on contingency savings; (3) authorizes such funds, following consultation with the appropriate congressional committees, to address security vulnerabilities (e.g., physical security upgrades and local guard staffing) at interim and temporary U.S. diplomatic facilities abroad and subjects their opening, closure, or significant modification to prior consultation and notification (waivable for security risks); (4) authorizes such funds for security upgrades to soft targets (e.g., schools, recreational facilities, residences, and places of worship) used by U.S. diplomatic personnel and dependents; and (5) prohibits such funds from being used to relocate the U.S. embassy to Israel from Jerusalem or to establish a U.S. Embassy, Consulate General, or other diplomatic facility in Jerusalem besides the U.S. Embassy to Israel.

This section requires departments and agencies funded under title I to absorb, within their title I budgetary resources, any costs from personnel actions (e.g., furloughs or reductions in force) taken in response to funding reductions in this Act. It provides additional authority to transfer funds between appropriations accounts to execute this requirement and treats such transfers as reprogrammings under section 7015 of this Act.

This section prohibits the use of any funds appropriated by this Act for publicity or propaganda purposes within the United States unless authorized by Congress prior to the Act's enactment. It allows an exception of up to $25,000 to carry out section 316 of the International Security and Development Cooperation Act of 1980 (22 U.S.C. 2151a note).

This section prohibits the obligation or expenditure of funds appropriated in titles III through VI of this Act for direct assistance or reparations to the governments of Cuba, North Korea, or Iran, including direct loans, credits, insurance, and guarantees of the Export-Import Bank or its agents.

This section prohibits the obligation or expenditure of funds appropriated under titles III through VI to provide direct assistance to the government of any country whose duly elected head of government is deposed by military coup d'état or decree, or—after enactment—a coup d'état or decree in which the military plays a decisive role. Assistance may resume if the Secretary of State certifies to the Appropriations Committees that a democratically elected government has taken office; the prohibition does not apply to funds for democratic elections, public participation in democratic processes, or democratic transitions; and the Secretary may waive the prohibition on a program-by-program basis, following interagency consultation, if vital to U.S. national security interests. Funds under these exceptions and waivers are subject to prior consultation with and regular notification procedures of the Appropriations Committees.

This section authorizes transfers of up to 5% of Department of State appropriations under title I of the Act between such appropriations, with no single appropriation increased by more than 10% and none to Representation Expenses. It further permits (1) transfers among funds appropriated for Diplomatic Programs (including Worldwide Security Protection), Embassy Security, Construction, and Maintenance, and Emergencies in the Diplomatic and Consular Service if needed to implement Benghazi Accountability Review Board recommendations, for emergency evacuations, or to address security situations, subject to prior consultation and regular notification procedures; (2) transfers of up to $50 million from Diplomatic Programs Worldwide Security Protection to Emergencies in the Diplomatic and Consular Service for emergency evacuations and rewards; and (3) transfers of prior appropriations for Administration of Foreign Affairs and Operating Expenses to implement congressionally authorized reorganizations, subject to prior consultation and regular notification, with all such transfers treated as reprogrammings under section 7015 of the Act. This section prohibits transfers of funds under titles II through V to other U.S. government agencies except as specified in the Act or other appropriations acts or pursuant to Foreign Assistance Act sections 109, 610, and 632 or BUILD Act section 1434(j); requires notification for certain agreements under Foreign Assistance Act section 632 valued over $2 million involving specified accounts; limits BUILD Act section 1434(j) transfers to the U.S. International Development Finance Corporation to title III funds, subject to prior consultation, regular notification, and coordination with State Department programs; and requires the President to consult with and provide written justification to the Committees on Appropriations at least five days prior to transferring funds under any Foreign Assistance Act authority to a non-appropriated account.

This section restricts the use of appropriated funds as follows: (1) prohibits first-class travel by employees of agencies funded by the Act except as permitted by 41 C.F.R. §§ 301–10.122 through 301–10.124; (2) requires agency computer networks to block access to sexually explicit websites, with exceptions for law enforcement, prosecutions, administrative discipline, and official monitoring; (3) prohibits specified Department of State funds from supporting email accounts or servers outside the .gov domain that contravene the Presidential and Federal Records Act Amendments of 2014; (4) directs specified agencies to ensure representation and entertainment expenses further official business and U.S. foreign policy by focusing on relations outside the Executive Branch, protocol meals and events, excluding employee-only or substantially recreational activities; and (5) prohibits funds under specified headings from paying for alcoholic beverages or substantially recreational entertainment (e.g., sporting events, theatrical productions, amusement parks).

This section requires the Secretary of State, not later than 180 days after enactment, to develop and submit to the appropriate congressional committees a multi-year strategy to improve the effectiveness of U.S. government foreign assistance, including (1) methods to determine effectiveness; (2) analysis of using outcomes to inform assistance allocation; (3) results of impact evaluations from the prior 12 months and plans to incorporate them into future programs; (4) analysis of partnerships with local organizations, including faith-based organizations; and (5) estimated implementation costs. The section further directs the Secretary to convene an expert panel for recommendations to be included in a strategy appendix and to consult with the Appropriations Committees within 45 days of enactment. This section requires funds appropriated for monitoring and evaluation under "National Security Investment Programs" and "International Humanitarian Assistance" to support regular beneficiary feedback collection, with Secretary oversight to ensure implementing partners use it to maximize cost-effectiveness. This section earmarks not less than $25 million from funds appropriated under titles III and IV for impact evaluations (including ex-post) of foreign assistance programs, in addition to other such funds. This section subjects obligations exceeding $2 million from deobligated prior-year balances to regular Appropriations Committee notification procedures. This section makes funds appropriated under title I and for title III independent agencies available, as appropriate, to enhance information on U.S. foreign assistance via ForeignAssistance.gov, with all funded agencies required to provide timely data upon State Department request.

This section prohibits the use of appropriations under titles III through VI to furnish assistance to the government of any country in default for more than one calendar year on principal or interest payments to the United States on loans made under programs funded by this Act, unless the President determines, after consulting the Committees on Appropriations, that such assistance is in the national interest of the United States.

This section prohibits obligation of funds appropriated under titles III through VI for assistance to a foreign country under a new bilateral agreement unless the agreement exempts such assistance from all foreign taxes or provides for reimbursement by the foreign government. (Bilateral agreement refers to a framework agreement on privileges and immunities for U.S. assistance generally or an individual agreement specifying tax treatment.) It further requires withholding from FY2027 and prior fiscal year assistance funds allocated to a foreign country's central government (or the West Bank and Gaza program, as applicable) an amount equal to 200% of taxes assessed in FY2026 on funds appropriated by this Act and prior Department of State, foreign operations, and related programs Acts—directly or through grantees, contractors, or subcontractors—unless reimbursed by September 30, 2027 (with de minimis taxes excepted). (1) Withheld funds must be reprogrammed for assistance to countries that do not assess taxes on U.S. assistance, have effective reimbursement arrangements, and can accommodate the assistance responsibly; and (2) the Secretary of State may exempt a foreign government or entity via report to the Appropriations Committees if it has a substantial reimbursement arrangement or U.S. foreign policy interests outweigh the section's purpose, following at least 15 days' prior consultation with the committees. Taxes and taxation include value added taxes and customs duties but exclude individual income taxes on local staff.

This section provides that funding ceilings and specifically designated funding levels in this Act do not apply to funds appropriated by subsequent Acts unless those Acts expressly state otherwise, and that funding levels or minimum requirements in other Acts do not apply to funds appropriated by this Act.

This section prohibits the obligation of funds appropriated under titles I, II, and VI; for the Peace Corps; or for the Millennium Challenge Corporation—including prior-year carryover, fee collections, and transfers—for creating new programs; suspending or eliminating programs, projects, or activities; closing, suspending, opening, or reopening missions or posts; creating, closing, reorganizing, downsizing, or renaming bureaus, centers, or offices; or contracting out or privatizing functions performed by federal employees unless previously justified to or notified 15 days in advance to the Appropriations Committees. This section further prohibits reprogrammings of such funds exceeding $1 million or 10% (whichever is less) that (1) augment or change existing programs, projects, or activities; (2) relocate an existing office or employees; (3) reduce by 10% any existing program, project, activity, or personnel as approved by Congress; or (4) result from general savings changing approved programs unless notified 15 days in advance. This section requires 15 days advance notification to the Appropriations Committees prior to obligating funds under specified accounts—including Global Health Programs, National Security Investment Programs, Democracy Fund, Peace Corps, Millennium Challenge Corporation, International Narcotics Control and Law Enforcement, Nonproliferation, Anti-terrorism, Demining and Related Programs, Peacekeeping Operations, International Military Education and Training, Foreign Military Financing Program, United States International Development Finance Corporation, and Trade and Development Agency—for unjustified programs, projects, activities, materiel assistance, countries, or operations or in excess of justified amounts; and prior to presidential commitments under section 23 of the Arms Export Control Act for major defense equipment (other than conventional ammunition) or major defense items (aircraft, ships, missiles, or combat vehicles) not previously justified or exceeding justified quantities by 20%. (The notification requirement does not apply to reprogrammings of less than 10% of the amount previously justified under titles III through VI.) This section requires the Secretary of State, in consultation with the Secretary of Defense, to justify to the Appropriations Committees any support for programs initially funded under DOD authority (title 10, U.S. Code, or DOD appropriations); subjects DOD transfers to State for foreign assistance to regular notification procedures; and requires DOD notifications for excess defense articles under specified authorities prior to provision or sale.

This section prohibits funds appropriated by the Act under titles III through VI from being used by nongovernmental organizations, including contractors, that fail to provide requested documents necessary for Department of State audits. This section requires federal agencies receiving funds under the Act to post reports submitted to Congress on their public websites in a central location within 45 days of congressional receipt, except for reports where the agency head determines disclosure would compromise national security or reveal proprietary information (with notice to the Appropriations Committees) or those exempted by the Act's accompanying report; such posting occurs only after availability to the Appropriations Committees. This section directs the Secretary of State to (1) review and update policies for preserving federal records (including emails, instant messaging, and online tools) in compliance with federal statutes and executive orders; (2) use funds under Diplomatic Programs and Capital Investment Fund to improve records management under the Federal Records Act; (3) notify departing employees, including senior officials, that federal records belong to the government; (4) substantially reduce (compared to the prior fiscal year) response times for retrieving federal records, including Freedom of Information Act requests; and (5) strengthen cybersecurity by mitigating vulnerabilities from non-.gov email, removing inactive accounts, updating national security information controls, and implementing applicable Office of Inspector General recommendations.

This section requires the head of the relevant federal agency to notify the Committees on Appropriations in writing within 5 days of the President's determination not to comply with any provision of this Act on constitutional grounds, including the basis for such determination and any resulting changes to program or policy.

This section prohibits funds made available under part I of the Foreign Assistance Act of 1961 (i.e., bilateral economic and development assistance programs) from being used (1) to pay for abortions as a method of family planning or to motivate or coerce any person to practice abortions; (2) to pay for involuntary sterilizations as a method of family planning or to coerce or provide financial incentives for persons to undergo sterilizations; (3) for biomedical research related, in whole or in part, to methods of or the performance of abortions or involuntary sterilizations as family planning; or (4) for any country or organization if the President certifies that such use would violate these provisions.

This section requires funds appropriated under titles III through V to be allocated in amounts specified in tables included in the accompanying congressional report, which serve as the allocation report required by section 653(a) of the Foreign Assistance Act of 1961 and are available notwithstanding the report's transmittal date. It limits deviations from those amounts to 10 percent by the Secretary of State, absent case-by-case written determinations of necessity due to significant, exigent, or unforeseen events or national security interests—with prior consultation and notification to the Appropriations Committees—and prohibits such deviations for amounts in the section 653(a) report until after its submission. It exempts expired funds and minimum funding requirements from these rules; requires specified reports as described in the accompanying report; and excludes International Humanitarian Assistance funds from country-specific designations unless specified as the source.

This section prohibits the use of funds appropriated by this Act to pledge future-year funding for any multilateral or bilateral program funded in titles III through VI unless the pledge meets requirements specified in the accompanying report.

This section prohibits funds appropriated under titles III through VI from being made available to any foreign government that provides lethal military equipment to a country designated by the Secretary of State as supporting international terrorism under section 1754(c) of the Export Control Reform Act of 2018 (50 U.S.C. 4813(c)), with the prohibition terminating 12 months after such provision ceases and applicable to contracts entered into after October 1, 1997. It authorizes the President to waive the prohibition if vital to the U.S. national interest and requires a report to the Appropriations Committees detailing the assistance, estimated dollar amount, and national interest rationale. The section further limits such funds—including from prior appropriations acts for the Department of State, foreign operations, and related programs—from being made available to any foreign government the President determines grants sanctuary to international terrorists, otherwise supports international terrorism, or is controlled by a terrorist organization designated under section 219 of the Immigration and Nationality Act (8 U.S.C. 1189), subject to a waiver for national security or humanitarian reasons published in the Federal Register with at least 15 days' prior notice to the Appropriations Committees including the justification.

This section makes available not less than $108 million from funds appropriated under the headings “National Security Investment Programs”, “International Narcotics Control and Law Enforcement”, “Nonproliferation, Anti-terrorism, Demining and Related Programs”, “Peacekeeping Operations”, and “Foreign Military Financing Program” for the Prevention and Stabilization Fund (PSF). (As background, the PSF, established by the Global Fragility Act of 2019, supports U.S. activities to prevent conflict, stabilize fragile states, counter violent extremism, and promote 10-year plans under the U.S. Strategy to Prevent Conflict and Promote Stability.) Funds made available under the Foreign Military Financing Program heading pursuant to this section remain available until September 30, 2027.

This section defines “program, project, and activity” for titles II through VI of the Act as the appropriations Act account level, including all appropriations and authorizations Acts funding directives, ceilings, and limitations. For the National Security Investment Programs, International Narcotics Control and Law Enforcement, and Foreign Military Financing Program accounts, the definition also includes country-, regional-, and central program-level funding within each account, either as (1) justified to Congress or (2) allocated by the Executive Branch in accordance with the report required by section 653(a) of the Foreign Assistance Act of 1961 or as modified pursuant to section 7019 of this Act.

This section limits funds appropriated by this Act and prior acts for Department of State, foreign operations, and related programs to counter foreign propaganda and disinformation to efforts targeting such activities by foreign state and non-state actors abroad. The section further prohibits such funds from being used in contravention of Executive Order 14149 (Restoring Freedom of Speech and Ending Federal Censorship) or to (1) characterize U.S. independent news media companies as creators of disinformation, misinformation, or malinformation; (2) advocate to, or act to, censor, filter, or remove content from a U.S. entity on social media platforms; or (3) take any action designed to influence consumer or advertising behavior toward U.S. media companies or social network platforms.

This section prohibits the obligation or expenditure of funds appropriated by the Act pursuant to titles III through VI for direct assistance, or otherwise made available to the Export-Import Bank or the U.S. International Development Finance Corporation, to finance loans, assistance, or financial commitments for establishing or expanding production of any commodity for export by a foreign country if the commodity is likely in surplus on world markets when the capacity becomes operative and the assistance will cause substantial injury to U.S. producers of the same, similar, or competing commodity. It provides exceptions for (1) Export-Import Bank financing if its Board of Directors determines benefits to U.S. industry and employment outweigh the injury and notifies the Committees on Appropriations; (2) activities in countries eligible for International Development Association assistance but not International Bank for Reconstruction and Development assistance that do not consistently export the relevant commodity; and (3) activities in countries the President determines are recovering from widespread conflict, humanitarian crisis, or complex emergency. This section further prohibits funds appropriated to carry out chapter 1 of part I of the Foreign Assistance Act of 1961 (i.e., bilateral development assistance) from supporting testing, breeding feasibility studies, variety improvement or introduction, consultancies, publications, conferences, or training related to growth or production in a foreign country of an agricultural commodity for export that competes with a U.S. commodity, subject to parallel exceptions for (1) food security activities in developing countries with no significant impact on U.S. agricultural exports; (2) research primarily benefiting U.S. producers; and (3) and (4) the low-income and crisis-recovery countries described above. This section directs the Secretary of the Treasury to instruct the U.S. executive director of each international financial institution to use the U.S. voice and vote to oppose any assistance using funds appropriated or made available by the Act for production or extraction for export of any commodity or mineral in surplus on world markets that will cause substantial injury to U.S. producers of the same, similar, or competing commodity.

This section requires separate accounts for local currencies generated from assistance agreements under chapters 1 and 10 of part I or chapter 4 of part II of the Foreign Assistance Act of 1961 (FAA), with the Secretary of State to (1) require deposit into such accounts established by the foreign government, (2) agree with that government on amounts generated and uses limited to FAA project/sector assistance, debt/deficit financing, or U.S. administrative costs, (3) monitor deposits and disbursements, (4) ensure programming accountability, and (5) dispose of unencumbered balances upon assistance termination as mutually agreed. The section further requires countries receiving cash transfer or nonproject sector assistance under the same FAA chapters to maintain funds in separate accounts without commingling, mandates at least 15 days' prior notification to the Appropriations Committees detailing proposed uses and U.S. interests served (including economic policy reforms), and permits exemptions for nonproject assistance through regular Appropriations Committee notification procedures.

This section waives restrictions on assistance to countries— (1) for programs of nongovernmental organizations using funds appropriated by this Act for specified authorities of the Foreign Assistance Act of 1961 (chapters 1, 10, 11, and 12 of part I and chapter 4 of part II), the FREEDOM Support Act (P.L. 102-511), and the Support for East European Democracy (SEED) Act of 1989 (P.L. 101-179), subject to prior notification to the Committees on Appropriations; and (2) during FY2026 under the Food for Peace Act (P.L. 83-480; 7 U.S.C. 1721 et seq.), subject to notification procedures for title I funds. This section does not apply to prohibitions on assistance to countries that support international terrorism or violate internationally recognized human rights.

This section directs the Secretary of State, consistent with section 704 of the Championing American Business Through Diplomacy Act of 2019, to prioritize funds appropriated under “Diplomatic Programs” for Chief of Mission diplomatic engagement to foster commercial relations and safeguard U.S. economic and business interests worldwide, including through Mission Resource Requests and Bureau Resource Requests. The section further requires the Secretary, consistent with section 705 of that Act, to annually assess training needs across economic and commercial diplomacy issue areas and ensure current course offerings meet those needs based on attendance and evaluations. Finally, the section directs the Secretary to instruct each Chief of Mission to advance U.S. commercial relations and business interests in the Integrated Country Strategy and Mission Resource Request for each country receiving bilateral assistance under this Act.

This section prohibits funds appropriated under title V from being paid to any international financial institution (IFI) if the U.S. executive director's total compensation exceeds the rate for level IV of the Executive Schedule (5 U.S.C. 5315) or an alternate U.S. executive director's compensation exceeds the rate for level V (5 U.S.C. 5316); directs the Secretary of the Treasury to instruct U.S. executive directors at IFIs to promote human rights due diligence, oppose loans or assistance to the People's Republic of China (PRC) at multilateral development banks (MDBs), include anti-fraud and anti-corruption measures in financing agreements, encourage collection and publication of beneficial ownership information for non-public corporations and limited liability companies receiving IFI funds, and support an "all-of-the-above" energy policy (including civil nuclear power) at specified MDBs with related capacity building; restricts U.S. contributions to Treasury-overseen financial intermediary funds from supporting the PRC or U.S.-sanctioned countries or regions; and prohibits such funds from supporting new IFI capital increases absent a presidential budget request and Treasury certification that the increase advances institutional objectives with reforms and does not increase China's voting power. It further requires the Secretary to report to the Appropriations Committees within 120 days of enactment on prior-year funding by Treasury-overseen financial intermediary funds to the PRC or sanctioned countries or regions.

This section makes available funds appropriated under the heading “National Security Investment Programs” for the Economic Resilience Initiative to enhance the economic security and stability of the United States and partner countries, including through efforts to counter economic coercion, subject to consultation with and regular notification procedures of the Committees on Appropriations. Such funds support (1) strategic infrastructure investments administered by the Secretary of State in consultation with other relevant federal agencies, with additional transfer authority to funds for the Export-Import Bank of the United States (“Program Account”), United States International Development Finance Corporation (“Corporate Capital Account”), and Trade and Development Agency, subject to regular notification procedures; (2) activities to enhance critical mineral supply chain security; and (3) the Cyberspace, Digital Connectivity, and Related Technologies Fund in accordance with Chapter 10 of Part II of the Foreign Assistance Act of 1961, with section 592(f) authority applicable and funds available for the Digital Connectivity and Cybersecurity Partnership consistent with section 6306 of the Department of State Authorization Act of 2023.

This section limits direct government-to-government assistance from funds appropriated by this Act to recipients meeting specified anti-corruption and fiscal requirements from prior law (specifically, section 7031(a)(1)(A)-(E) of P.L. 116-6), taking steps to reduce corruption, and— for assistance exceeding $10 million or involving cash transfers, budget support, or payments to individuals—subject to prior consultation with and notification to the Appropriations Committees explaining compliance; requires suspension of such assistance upon credible information of material misuse unless continuation is reported as in the U.S. national interest or misuse is addressed; and prohibits use of funds by recipient governments for debt service payments to international financial institutions or China. The section further requires the Secretary of State to update and strengthen minimum fiscal transparency requirements for recipient governments (as previously identified under section 7031(b) of P.L. 113-76), make or update public determinations of significant progress or no significant progress within 180 days of enactment, and post an annual Fiscal Transparency Report on the Department of State website. It also renders ineligible for U.S. entry foreign government officials and immediate family members credibly involved in significant corruption (including natural resource extraction) or gross human rights violations (including wrongful detention of U.S. mission staff or U.S. citizens/nationals), with concurrent referrals to Treasury's Office of Foreign Assets Control for potential sanctions and public or private designations; provides exceptions for U.S. law enforcement objectives or UN Headquarters Agreement obligations, and discretionary waivers for compelling national interests or changed circumstances; and requires reports to specified congressional committees every 90 days through September 30, 2027 (with classified annexes if needed), listing ineligible or designated individuals, waivers, and justifications, with unclassified portions posted online (clarifying that relevant visa records are not confidential).

This section provides $2,320,000,000 for democracy programs in adversarial or anti-American countries, countries posing a U.S. national security threat, or countries seeking to strengthen democratic institutions from funds appropriated under the headings “National Security Investment Programs,” “Democracy Fund,” and “International Narcotics Control and Law Enforcement.” It makes such funds and funds under the heading “National Endowment for Democracy” (NED) available notwithstanding any other provision of law or, for NED, any regulation; authorizes NED funds pursuant to the National Endowment for Democracy Act, including all beneficiary selection decisions; prohibits foreign governments from requiring prior approval of organizations implementing such assistance, the nature of the assistance, or program participants; and bars new bilateral agreements with undemocratic governments or those harassing democracy programs from requiring disclosure of implementing partners' names (with the Secretary of State directed to amend existing agreements as necessary).

This section directs the availability of funds appropriated by the Act for international religious freedom purposes as follows: (1) funds under the heading “Diplomatic Programs” for the Office of International Religious Freedom in the Department of State; (2) not less than $50 million from funds under the headings “National Security Investment Programs” and “Democracy Fund” for international religious freedom programs, under the responsibility of the Ambassador-at-Large for International Religious Freedom in consultation with other U.S. government officials; (3) funds under the heading “International Humanitarian Assistance” for humanitarian assistance to vulnerable and persecuted ethnic and religious minorities, including victims of genocide designated by the Secretary of State and groups that have suffered crimes against humanity or ethnic cleansing; and (4) funds under the heading “National Security Investment Programs” for assistance to ethnic and religious minorities in Iraq and Syria, notwithstanding any other provision of law.

This section provides various directives and authorities for the Department of State and related programs. **(a) Directives and authorities**—(1) authorizes funds appropriated under National Security Investment Programs for contributions to establish and maintain genocide victims memorial sites, subject to notification procedures of the Committees on Appropriations; (2) prohibits use of funds to modify the Exchange Visitor Program except through formal rulemaking under the Administrative Procedure Act, with consultation and notification to the Committees on Appropriations at least 30 days prior to Federal Register publication on impacts to public diplomacy and U.S. economy; and (3) exempts financing for civil nuclear facilities, materials, technologies, and related transactions, including under the China and Transformational Exports program, from certain Export-Import Bank requirements. **(b)** Authorizes the Secretary of State to restrict, terminate, or cancel contracts, grants, cooperative agreements, or sub-awards based on partner vetting program information. **(c)** Directs the Secretary of State to withhold title III assistance funds from central governments of countries not complying with the Hague Convention on International Child Abductions, with a report to the Committees on Appropriations within 15 days of withholding. **(d)** Authorizes transfer and merger of up to $50 million in unobligated expired FY2026 Diplomatic Programs funds to Protection of Foreign Missions and Officials, no later than the end of the fifth fiscal year after availability. **(e)** Continues in effect during FY2026 section 7056 of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2021 (on impact on jobs). **(f) Extension of authorities**—(1) continues section 7081(h) of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2017, during FY2026; (2) continues section 7071 of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2022, during FY2026 and applies it to funds appropriated by this Act (on protective services); and (3) extends loan guarantees to Israel through September 30, 2031 (from September 30, 2030). **(g)** Expands the HIV/AIDS Working Capital Fund to pharmaceuticals and products for child survival, malaria, and tuberculosis on the same terms as HIV/AIDS products; authorizes the Secretary of State to exercise related transfer authority, subject to notification procedures; and requires an accounting of the fund in the congressional budget justification. **(h)** Defines "appropriate congressional committees," clarifies "contribution, grant, or other payment" to the United Nations to include voluntary and assessed contributions and payments (including to the UN Regular Budget), and defines "funds appropriated by this Act and prior Acts."

This section permits funds under titles III and IV of the Act for community-based civilian police assistance— notwithstanding FAA §660, which generally prohibits such aid—for training and technical assistance in human rights, rule of law, anti-corruption, strategic planning, democratic governance, conflict prevention, disaster response, violence against women and girls, and community relations. It also makes available funds under Peacekeeping Operations and Foreign Military Financing Program (FMF) for combat casualty care training and equipment above prior fiscal year levels and requires the Secretary of State to offer such training and equipment as part of any lethal assistance package funded by the Act for countries in conflict, unless the Secretary determines the country has adequate functioning systems meeting Tactical Combat Casualty Care standards (with provision through open competition). This section further (1) deems assistance under FAA §660(b)(6) for reconstituting civilian police authority in nations emerging from instability to also include sub-national entities; (2) continues prior-year authority for disarmament, demobilization, and reintegration programs through FY2026; (3) subject to notification, authorizes commercial leasing of certain defense articles (excluding most Major Defense Equipment) for Israel, Egypt, NATO, and major non-NATO allies if compelling foreign policy or national security reasons exist; (4) authorizes obligation of up to $900 million for the Special Defense Acquisition Fund through September 30, 2028, subject to Secretary of State concurrence; (5) exempts FY2026 war reserve stockpiles in Israel from FAA §514(b) storage limits; (6) permits inclusion of U.S. Armed Forces salaries under 10 U.S.C. §341 (State Partnership Program) in pricing for non-repayable FMF procurements under Arms Export Control Act §23 using FY2026 funds; and (7) continues FY2026 authority for FMF direct loans and loan guarantees previously enacted in FY2022. This section states that funds should not support military training or operations involving child soldiers and (1) authorizes grant disposal of U.S. demining equipment for humanitarian landmine and unexploded ordnance clearance and (2) prohibits military assistance, export licenses, sales, or transfers of cluster munitions unless submunitions result in no more than 1% unexploded ordnance across intended environments.

This section makes available not less than $175 million from funds appropriated under the headings “National Security Investment Programs” and “International Narcotics Control and Law Enforcement” for programs to counter the flow of fentanyl, fentanyl precursors, and other synthetic drugs into the United States, in addition to funds otherwise available for such purposes. Funds shall support (1) efforts to stop the flow of such drugs and precursors from and through the People's Republic of China, Mexico, and other countries; (2) law enforcement cooperation and capacity building to disrupt and dismantle transnational criminal organizations involved in their production and trafficking; (3) implementation of the Fighting Emerging Narcotics Through Additional Nations to Yield Lasting Results Act (part 7 of subtitle C of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023, Public Law 117–263); and (4) multilateral engagement, including through the Global Coalition to Address Synthetic Drug Threats, to address related public health and security threats.

This section prohibits funds appropriated under titles III through VI from being used to support a Palestinian state unless the Secretary of State certifies to the appropriate congressional committees that the governing entity (1) demonstrates a firm commitment to peaceful coexistence with Israel and takes measures to counter terrorism and terrorist financing in the West Bank and Gaza and (2) works with regional countries toward a just, lasting, and comprehensive Middle East peace enabling Israel and a Palestinian state to exist within full and normal relations—including termination of belligerency, respect for sovereignty and territorial integrity, secure boundaries, freedom of navigation, and a refugee settlement framework. It expresses the sense of Congress that the governing entity enact a constitution assuring rule of law, an independent judiciary, and human rights, along with laws for transparent governance. The President may waive the prohibition if vital to U.S. national security interests, and the prohibition does not apply to assistance reforming the Palestinian Authority or governing entity to meet these requirements (consistent with sec. 7040).

This section prohibits the use of funds appropriated or otherwise made available by this Act to provide equipment, technical support, consulting services, or any other form of assistance to the Palestinian Broadcasting Corporation.

This section requires, prior to obligating FY2026 funds appropriated under the heading "National Security Investment Programs" for the bilateral West Bank and Gaza program, (1) a certification by the Secretary of State to the Committees on Appropriations that procedures ensure Comptroller General access to relevant financial information; (2) vetting to prevent assistance to individuals, entities, or educational institutions involved in or advocating terrorist activity, with termination of aid if determined; and (3) a report on benchmarks for security assistance, Palestinian compliance, and steps by the Palestinian Authority to end torture of detainees. The section further prohibits such funds from recognizing acts of terrorism or supporting institutions named after terrorists; directs the Department of State to conduct annual audits of contractors and grantees, with up to $1.4 million available to the Office of Inspector General for such activities; requires a Comptroller General audit of FY2026 program funds for compliance and examination of all activities; and subjects funds to standard Appropriations Committee notification procedures.

This section prohibits funds appropriated by this Act under chapter 4 of part II of the Foreign Assistance Act of 1961 (i.e., Economic Support Fund) from being obligated or expended for the Palestinian Authority (PA), subject to presidential waiver if certified as important to U.S. national security interests. The waiver is effective for no more than six months at a time and not beyond 12 months after enactment; requires a presidential report to the Appropriations Committees justifying the waiver, detailing fund uses and accounting, and PA actions to arrest terrorists, confiscate weapons, and dismantle terrorist infrastructure; and requires a Secretary of State certification prior to obligation that the PA maintains a single treasury account with no parallel mechanisms, a single civil service roster and payroll, and acts to counter anti-Israel incitement while supporting peace and security cooperation with Israel. This section further prohibits funds appropriated in titles III through VI from being used for salaries of PA personnel located in Gaza or for assistance to Hamas, any Hamas-controlled entity, any Hamas-affiliated power-sharing government, or that results from a Hamas agreement; permits assistance to a power-sharing government only upon presidential certification and report that it accepts and complies with Foreign Assistance Act §620K(b)(1)(A) and (B) (i.e., recognizes Israel, renounces violence, and accepts prior agreements); authorizes use of §620K(e) inverted presumption of Hamas control; requires follow-up reports from the Secretary of State within 120 days and quarterly thereafter on compliance, assistance details, and accounting; and prohibits such funds for the Palestine Liberation Organization.

This section specifies minimum assistance amounts and conditions for Egypt, Israel, Jordan, and Lebanon and directs funds and activities related to Iran. (1) **Egypt.**—Makes available not less than $1.425 billion for assistance for Egypt, including $125 million from National Security Investment Programs and $1.3 billion from Foreign Military Financing Program (FMF) funds (available through September 30, 2027, and transferable to an interest-bearing account in the Federal Reserve Bank of New York), plus an additional $75 million from FMF. Requires a Secretary of State certification and report to congressional appropriations committees that the Egyptian government is sustaining the U.S. strategic relationship and meeting its obligations under the 1979 Egypt-Israel Peace Treaty (waiving other assistance restrictions except subsection (a) and section 620M of the Foreign Assistance Act of 1961). (2) **Iran.**—Directs funds appropriated under Diplomatic Programs, National Security Investment Programs, and Nonproliferation, Anti-terrorism, Demining, and Related Programs to prevent Iran's nuclear weapon capability, respond to UN Security Council violations or nuclear advances, enforce sanctions for nuclear development, terrorism, human rights abuses, and ballistic missile proliferation, and support Iranian democracy programs. Requires (A) a semi-annual report pursuant to section 135(d)(4) of the Atomic Energy Act of 1954 and (B) a sanctions impact and revenue assessment report, due 180 days after enactment, from the Secretaries of State and Treasury. Prohibits funds from implementing or renewing the Joint Comprehensive Plan of Action in contravention of the Iran Nuclear Agreement Review Act of 2015, providing assistance to Iran-sanctioned entities, or revoking the Islamic Revolutionary Guard Corps' Foreign Terrorist Organization designation. (3) **Israel.**—Makes available not less than $3.3 billion from FMF for grants only (disbursable within 30 days of enactment), including for advanced weapons systems as agreed by the United States and Israel, of which not less than $250.3 million is for procurement in Israel of defense articles, services, and research and development. (4) **Jordan.**—Makes available not less than $1.65 billion from titles III and IV for assistance for Jordan, including $845.1 million for budget support and $425 million from FMF; plus an additional $400 million from National Security Investment Programs for budget support and $50 million from FMF. (5) **Lebanon.**—Prohibits funds for the Lebanese Internal Security Forces or Armed Forces if controlled by a foreign terrorist organization.

This section directs funds appropriated by this Act for regional economic integration and investment in the Great Lakes Region of Africa to prioritize sectors critical to U.S. national security and economic interests, including mining and other natural resources, and requires implementation consistent with the June 2025 peace accords between the Democratic Republic of the Congo and Rwanda. The section withholds such funds under titles III and IV for the Government of South Africa unless the Secretary of State certifies and reports to the Committees on Appropriations that conditions in the Act's accompanying report—on cessation of cooperation with U.S. adversaries and adherence to the rule of law—have been met. The section prohibits such funds under title IV for the central Government of Sudan.

This section authorizes funds appropriated under the heading “National Security Investment Programs” for assistance for Burma consistent with section 5575 of the Burma Act of 2022 and section 7043(a) of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2023 (division K of Public Law 117-328), and applies the authorities, limitations, and conditions of the latter except for minimum funding requirements and paragraph (1)(B). This section requires not less than $1,800,000,000 from funds appropriated under titles III and IV to support implementation of the Indo-Pacific Strategy. This section establishes a Countering PRC Influence Fund with not less than $400,000,000 from funds appropriated under the headings “National Security Investment Programs,” “International Narcotics Control and Law Enforcement,” “Nonproliferation, Anti-terrorism, Demining and Related Programs,” and “Foreign Military Financing Program” to counter the influence of the Government of the People’s Republic of China, the Chinese Communist Party, and related entities globally, subject to prior consultation with the Committees on Appropriations. Such funds are in addition to other amounts for similar purposes; up to 10 percent may be reserved for unanticipated opportunities; Foreign Military Financing Program funds for the fund remain available until September 30, 2027; and funds from the specified headings (except National Security Investment Programs) may be transferred to and merged with funds under those headings subject to regular notification procedures. This section prohibits funds appropriated by this Act and prior similar acts from supporting or promoting (1) the Belt and Road Initiative or any dual-use infrastructure projects of the People’s Republic of China or (2) use of specified Chinese technology unless the Secretary of State determines, in consultation with other agency heads as appropriate, that it does not adversely impact U.S. national security. This section also prohibits funds made available by this Act from creating, procuring, or displaying maps that inaccurately depict the territory and social and economic system of Taiwan and islands administered by Taiwan authorities. This section prohibits funds appropriated by this Act or prior similar acts from being made available for assistance for the central government of any country the Secretary of State determines engages in significant transactions materially contributing to North Korea’s malicious cyber-intrusion capabilities, subject to a national security waiver; requires a report under section 209 of the North Korea Sanctions and Policy Enhancement Act of 2016; requires funds under “International Broadcasting Operations and Capital Improvements” to maintain broadcasting hours into North Korea at prior fiscal year levels; requires funds under “National Security Investment Programs” and “Democracy Fund” for human rights promotion in North Korea subject to specified authorities; and prohibits funds under “National Security Investment Programs” for assistance for the Government of North Korea. This section requires funds under “Diplomatic Programs” to expand the U.S. diplomatic and development presence in Pacific Islands countries, including facilities and personnel. This section also requires not less than $175,000,000 from funds under “National Security Investment

This section prohibits the use of funds appropriated by this Act and prior Acts for assistance for Afghanistan from being made available to the Taliban. It directs funds appropriated under the heading “National Security Investment Programs” for (1) modified learning opportunities for women and girls in Afghanistan, including efforts to expand internet access, online schooling, and distribution of educational content; (2) programs to investigate and document human rights abuses against women in Afghanistan; and (3) a program for Afghan women-led organizations to support education, human rights, and economic livelihoods in Afghanistan, to be co-designed by women in Afghanistan.

This section prioritizes funds appropriated by this Act under titles III and IV for Latin America and the Caribbean countries and programs that counter fentanyl and narcotics trafficking, respect democracy and human rights, counter authoritarian threats, and offset migration and human trafficking from the Western Hemisphere. For Central America (including Panama and Costa Rica), the section makes such funds available to address each country's unique circumstances in support of U.S. security interests and limits obligation of 50% of assistance to the central governments of El Salvador, Guatemala, and Honduras until the Secretary of State certifies their cooperation on countering drug and human trafficking, facilitating migrant repatriation, securing borders, combating corruption, improving rule of law, and fostering business conditions (with exceptions for judicial anti-corruption efforts, human rights investigations, women's empowerment, violence prevention, and border/migration-related security assistance). For Colombia, the section requires a pre-obligation report to congressional committees on bilateral relations and U.S. interests (e.g., migration, rule of law, counternarcotics); withholds 30% of International Narcotics Control and Law Enforcement funds until certification of reduced coca cultivation/production/trafficking, joint counternarcotics operations, and extradition cooperation; prohibits such funds (including prior-year funds) for reparations, alternative development on illegal substance properties, peace agreement combatant compensation, or agrarian cash subsidies; provides up to $1 million under National Security Investment Programs for related oversight; and authorizes aircraft for drug eradication and interdiction transport. For Cuba, the section requires not less than $35 million under National Security Investment Programs for democracy programs and civil society, including support for political prisoners.

This section waives restrictions under sec. 907 of the FREEDOM Support Act (i.e., generally prohibiting assistance to the government of Azerbaijan)—(1) for activities supporting democracy or assistance under title V of that Act (22 U.S.C. 5851 et seq.), sec. 1424 of the Defense Against Weapons of Mass Destruction Act of 1996 (50 U.S.C. 2333), or non-proliferation assistance; (2) Trade and Development Agency assistance under sec. 661 of the Foreign Assistance Act of 1961; (3) activities by U.S. and Foreign Commercial Service members in their official capacity; (4) assistance from the U.S. International Development Finance Corporation under the BUILD Act of 2018; (5) Export-Import Bank financing; and (6) humanitarian assistance. This section prohibits FY2026 funds for assistance to any Independent State of the former Soviet Union that directs actions violating the territorial integrity or national sovereignty of another such state (per the Helsinki Final Act), with a national security interest waiver by the President after consultation with the Appropriations Committees. This section continues in effect during FY2026, and applies FY2026 funds to, the limitations in sec. 7046(c) and (d) of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2024 (division F, P.L. 118-47).

This section prohibits funds appropriated by the Act from being used for assistance to the central government of Russia. This section further prohibits such funds from being used for assistance to the central government of any country that the Secretary of State determines has supported Russia's annexation of Crimea or other Ukrainian territory, subject to a national interest waiver; limits funds from recognizing Russian sovereignty over such territory, facilitating certain U.S. investments involving Russian entities, or providing assistance involving such entities; directs the Secretary of the Treasury to oppose international financial institution (IFI) assistance violating Ukraine's sovereignty or territorial integrity; and terminates these measures upon Ukraine's reestablishment of sovereignty over the territories. This section additionally prohibits such funds from being used for assistance to the central government of any country that the Secretary of State determines has recognized the independence of or established diplomatic relations with Russia's occupied Georgian territories of Abkhazia or Tskhinvali Region/South Ossetia, subject to a national interest waiver and with a required State Department website listing; limits funds from supporting the Russian occupation; and directs the Secretary of the Treasury to oppose IFI assistance violating Georgia's sovereignty or territorial integrity. This section makes available not less than $300 million from funds appropriated under this Act and prior Acts under specified Department of State, foreign operations, and related programs accounts—including National Security Investment Programs, International Narcotics Control and Law Enforcement, International Military Education and Training, and Foreign Military Financing Program—for the Countering Russian Influence Fund authorized by the Countering Russian Influence in Europe and Eurasia Act of 2017 (22 U.S.C. 9543), notwithstanding the Fund's country limitation and for programs to enhance law enforcement and security forces capacity, with Foreign Military Financing Program funds available until September 30, 2027.

This section imposes restrictions and reporting requirements on U.S. funding and engagement with the United Nations (UN) and related entities. Specifically, it (1) directs the Secretary of State, when considering bilateral assistance to foreign governments, to review their UN voting practices in relation to U.S. strategic interests and to consult the U.S. Permanent Representative to the UN prior to submitting the annual foreign aid report required under section 653(a) of the Foreign Assistance Act of 1961; (2) withholds 15% of funds appropriated for UN contributions (including the Department of Peacekeeping Operations), international organizations, or UN agencies until the Secretary certifies and reports to congressional committees that the entity posts public audits with U.S. access, enforces U.S.-level whistleblower protections (i.e., against retaliation for disclosures, specified burdens of proof, statutes of limitation, independent adjudication, and remedies), restricts first- and business-class travel, combats anti-Israel bias, discloses fund diversions to donors, and vets staff for terrorist affiliations; (3) prohibits funds for U.S. delegations to any UN specialized agency, body, or commission chaired by a country determined to support international terrorism under specified laws, and prohibits contributions to any UN organization, agency, commission, or program similarly chaired; (4) prohibits funds appropriated by this Act or prior acts for the Department of State, foreign operations, and related programs from being made available to the UN Human Rights Council (UNHRC), including its International Commission of Inquiry on the Occupied Palestinian Territory, including East Jerusalem, and Israel; (5) prohibits such funds from being made available to the United Nations Relief and Works Agency (UNRWA) or used to solicit contributions for UNRWA from other sources; and (6) prohibits specified foreign assistance funds from paying any UN member assessments, arrearages, or dues, or the participation costs of other countries' delegations at UN-auspices conferences funded under chapter 1 of part I of the Foreign Assistance Act of 1961. Finally, this section requires the Secretary to report within 45 days of enactment, with updates, on FY2026 funds withheld from UN or international programs due to any law, including any reprogramming of such funds.

This section establishes the America First Opportunity Fund by making up to $1,700,000,000 available from funds appropriated under the headings “National Security Investment Programs,” “International Narcotics Control and Law Enforcement,” “Peacekeeping Operations,” and “Foreign Military Financing Program” to provide assistance responding to crises, engaging proactively with strategic partners, and countering threats from adversaries. The section (1) authorizes transfers of funds from the latter three headings made available for the fund to, and merger with, funds under those headings, in addition to other transfer authorities and subject to regular Appropriations Committee notification procedures; (2) provides that funds made available under the “Foreign Military Financing Program” heading remain available until September 30, 2027; and (3) requires the Secretary of State to consult with the Appropriations Committees on fund allocation not later than 30 days prior to the initial obligation of funds.

This section makes available not less than $94 million from funds appropriated by this Act for programs to promote Internet freedom globally (i.e., technologies and initiatives to counter internet censorship, enhance digital security for activists, and support open access abroad), consistent with section 9707 of the Department of State Authorization Act of 2022.

This section prohibits the use of funds provided by this Act to support or justify the use of torture and other cruel, inhuman, or degrading treatment or punishment by any official or contract employee of the United States Government.

This section authorizes the transfer of aircraft procured with funds appropriated under specified Department of State, foreign operations, and related programs headings—“Diplomatic Programs,” “International Narcotics Control and Law Enforcement,” “Andean Counterdrug Initiative,” and “Andean Counterdrug Programs”—to any other program or region, subject to a Secretary of State determination that the aircraft are no longer needed in their original location and notification to the Appropriations Committees. The section further (1) requires coordination of such aircraft under the relevant Chief of Mission and permits their use to transport, on a reimbursable or non-reimbursable basis, Federal and non-Federal personnel supporting Department of State programs or other agencies' official travel (including on a space-available basis), with related funds credited to the Department's Working Capital Fund for aircraft expenses; (2) limits these requirements to aircraft whose primary purpose is personnel transport; and (3) directs recipient countries to bear operations and maintenance costs, including fuel, to the maximum extent practicable.

This section applies to this Act the terms and conditions of section 7055 of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2010 (P.L. 111-117)—which conditions U.S. assistance to Mexico, including Mérida Initiative funds for counternarcotics cooperation and rule-of-law programs, on certifications related to human rights, anti-corruption, and judicial reform—substituting "September 30, 2025" for "September 30, 2009" in subsection (f)(2)(B).

This section (1) applies to this Act the terms and conditions of sections 7086(b)(1) and (2)—requiring U.S. loans to Pakistan to be repaid within one year after completion with interest at a rate set by the Secretary of the Treasury—and 7090(a)—directing the U.S. executive director at the IMF to oppose financial assistance to Pakistan until such loans are repaid—of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2010 (division F of P.L. 111-117), and (2) directs the Secretary of the Treasury to instruct the U.S. executive director of the IMF to seek to ensure that any IMF loan is repaid before other private or multilateral creditors. (Thus, IMF loans receive repayment priority in potential debt restructurings or defaults.)

This section prohibits the use of funds appropriated by this Act to provide assistance to the central government of a country that notifies the Department of State of its refusal to extradite to the United States any individual indicted for a criminal offense punishable by life imprisonment without parole or for killing a law enforcement officer, as specified in a U.S. extradition request. The prohibition applies only to countries with which the United States maintains diplomatic relations and an extradition treaty that the country is violating. The Secretary of State may waive the prohibition on a case-by-case basis upon certifying to the Committees on Appropriations that such waiver is important to the U.S. national interest.

This section prohibits the obligation of funds appropriated under titles III through VI for Enterprise Funds unless the appropriate congressional committees are notified at least 15 days in advance. The section further requires the President, prior to (1) distributing assets from any liquidation, dissolution, or winding up of an Enterprise Fund; or (2) transitioning to or operating any private equity fund or other parallel investment fund under an existing Enterprise Fund, to submit a plan for such distribution or transition or operation to the appropriate congressional committees.

This section prohibits funds appropriated by this Act from being made available (1) for the United Nations Population Fund and (2) for global health assistance to, or for implementation by, any foreign nongovernmental organization—including those receiving subawards from U.S. nongovernmental organizations—that promotes or performs abortions, except in cases of rape, incest, or danger to the life of the mother.

This section permits funds appropriated by titles III and IV for bilateral assistance for child survival activities and disease programs—including research on, and prevention, treatment, and control of, HIV/AIDS—to be used notwithstanding any other provision of law, except for Global Health Programs heading provisions and the United States Leadership Against HIV/AIDS, Tuberculosis, and Malaria Act of 2003 (22 U.S.C. 7601 et seq.), as amended. It limits family planning/reproductive health funding to $461 million. **(c) Pandemics and Infectious Disease Outbreaks**—This subsection (1) directs Global Health Programs funds for global health security to build country capacity to prevent, detect, and respond to infectious disease outbreaks (including zoonotic diseases), subject to a 60-day consultation with the Committees on Appropriations; (2) authorizes up to $200 million aggregate from Global Health Programs, National Security Investment Programs, International Humanitarian Assistance, Democracy Fund, and Millennium Challenge Corporation accounts for extraordinary measures against a severe international outbreak or Public Health Emergency of International Concern (as determined by the Secretary of State), transferable and mergeable for such purposes; (3) makes up to $50 million from Global Health Programs available for the Emergency Reserve Fund established in FY2017; and (4) requires prior consultation with congressional committees and regular Appropriations Committee notifications. This section prohibits any funds from supporting, directly or indirectly, (1) the Wuhan Institute of Virology; (2) EcoHealth Alliance, Inc.; (3) any laboratory owned or controlled by the governments of the People's Republic of China, Cuba, Iran, North Korea, Russia, Venezuela (under Nicolás Maduro), or other foreign adversaries (as determined by the Secretary of State); or (4) gain-of-function research. It requires the Secretary of State, within 120 days of enactment, to submit to congressional committees a multiyear strategy for transitioning programs under the President's Emergency Plan for AIDS Relief (PEPFAR)—the primary U.S. global initiative to combat HIV/AIDS—to country-led ownership, resulting in reduced U.S. assistance consistent with the joint explanatory statement accompanying this Act.

This section directs funds appropriated by this Act for U.S. diplomatic and development programs promoting the equality and empowerment of women and girls worldwide, including the following: (1) $160 million from title III for women's economic empowerment through women-owned enterprises, property rights, financial access, economic decision-making, and global participation, including implementation of the Women's Entrepreneurship and Economic Empowerment Act of 2018, subject to consultation with the Appropriations Committees; (2) not less than $40 million from title III for the Madeleine K. Albright Women's Leadership Program to increase women's leadership opportunities in countries where women face discrimination due to law, policy, or practice; (3) not less than $200 million from titles III and IV to prevent and respond to violence against women and girls (including child marriage, rape, and female genital cutting and mutilation), with training funds for foreign police, judicial, and military personnel required to address such violence, trafficking in persons, and women's integration into security forces where appropriate; and (4) $120 million from "National Security Investment Programs" and "International Narcotics Control and Law Enforcement" for a multi-year strategy on women, peace, and security in conflict-affected and politically transitioning countries. This section also prohibits funds appropriated by this Act from being made available for the Gender Equity and Equality Action Fund.

This section makes available not less than the following amounts from funds appropriated under title III of this Act, unless otherwise specified: **(a) Education.** $737,600,000 for the Nita M. Lowey Basic Education Fund (which supports primary and secondary education activities in developing countries); $152,000,000 for contributions to multilateral education partnerships; and $216,800,000 for higher education assistance, including $50,000,000 for programs specified in section 7060(a)(3) of the Department of State, Foreign Operations, and Related Programs Appropriations Act, 2021 (division K of P.L. 116-260). **(b) Conservation.** $292,600,000 for biodiversity conservation programs; $100,000,000 for a contribution to the United States Foundation for International Conservation; and $95,000,000 from titles III and IV funds to combat wildlife poaching and trafficking (prohibiting title IV funds for training or assistance to implicated foreign military units unless in the U.S. national security interest, as determined by the Secretary of State). **(c) Food security.** $768,000,000 for food security and agricultural development programs under the Global Food Security Act of 2016 (P.L. 114-195), including Feed the Future Innovation Labs and a contribution authorized by the Food, Conservation, and Energy Act of 2008, as amended. **(d) Trafficking in persons.** $111,000,000 from "National Security Investment Programs" and "International Narcotics Control and Law Enforcement" headings ($89,500,000 from the latter) for international anti-trafficking activities, including the Program to End Modern Slavery. (Such funds must align with Trafficking in Persons Report recommendations, coordinate with the Department of State's Office to Monitor and Combat Trafficking in Persons, and support standardized training for U.S. embassy personnel abroad on recognizing and reporting trafficking; funds under "Diplomatic Programs" for that Office are additional.) Funds for international conferences are restricted in Trafficking in Persons Report Tier 3 countries unless anti-trafficking-related or in the U.S. national interest (subject to prior consultation). The Secretary of State must certify within 60 days of enactment that all Department employees receive Counter Trafficking in Persons training in FY2026 and that FY2025 funding documents included such stipulations (exempting certain commercial contractors); report within 90 days on prior-year grant and contract compliance with the Trafficking Victims Protection Act of 2000; and up to $1,000,000 from "National Security Investment Programs" is available to the State Department Inspector General for related oversight.

This section prohibits the use of funds appropriated by this Act, in contravention of Executive Order 14162 (Putting America First in International Environmental Agreements), for contributions, grants, or payments to the Green Climate Fund, Clean Technology Fund, or Loss and Damages Fund, or for loss and damages compensation attributed to climate change, or to implement the Paris Agreement; bars the Secretary of State from using such funds to impede hydrocarbon transmission by pipeline under the U.S.-Canada Transit Pipelines Agreement of 1977; and directs the Comptroller General of the United States to study appropriations for Department of State, foreign operations, and related programs from FY2020 through FY2024 made available for climate change programs, assessing whether such funds had a direct and measurable impact on lowering global temperatures or projections thereof using plausible models and scenarios.

This section requires each department, agency, or organization funded in titles I, II, III (Department of the Treasury and Independent Agencies), and VI to submit to the Committees on Appropriations, not later than 45 days after enactment, an operating plan for funds appropriated in such titles or otherwise available for obligation in FY2026 that details uses at the program, project, and activity level—including comparisons to congressional budget justification levels, directives, or approved funding levels—and subjects any funding changes to reprogramming requirements under section 7015. This section further requires (1) the Secretary of State to submit a spend plan for funds made available by this Act for assistance to Pacific Islands countries and Colombia; the Caribbean Basin Security Initiative, Central America Regional Security Initiative, Middle East Partnership Initiative, Indo-Pacific Strategy and Countering PRC Influence Fund, and Power Africa; assistance under specified sections (7030, 7032, 7033, 7036, 7047(d) on a country-by-country basis, 7059, and each subsection of 7060); International Narcotics Control and Law Enforcement demand reduction programs; and Global Fragility Act implementation; and (2) the Secretary of the Treasury, not later than 90 days after enactment, to submit a spend plan for funds under “Department of the Treasury, International Affairs Technical Assistance” in title III and “Treasury International Assistance Programs” in title V. (Such spend plans do not satisfy other notification requirements in this Act or under section 634A of the Foreign Assistance Act of 1961.) This section also requires the congressional budget justification for Department of State operations and foreign operations to be provided to the Committees on Appropriations concurrent with the President’s FY2027 budget request, with appendices provided not later than 10 calendar days thereafter.

This section prohibits the Department of State and other federal departments, agencies, or organizations funded by this Act from using appropriated funds—including those from this Act, prior Department of State, foreign operations, and related programs appropriations Acts, or any other Act—to implement any reorganization, redesign, or other plan described in subsection (b) without prior consultation with the appropriate congressional committees and subject to the regular notification procedures of the Committees on Appropriations, including a detailed justification for any proposed action. (Congressional notifications submitted in prior fiscal years pursuant to similar provisions may satisfy these requirements.) Subsection (b) describes such plans as (1) expanding, eliminating, consolidating, or downsizing covered departments, agencies, organizations, bureaus, or offices, including transfers of authorities and responsibilities; (2) taking similar actions regarding the U.S. official presence overseas at diplomatic facilities and other platforms; or (3) expanding or reducing the size of the Department of State's permanent Civil Service, Foreign Service, eligible family member, and locally employed staff workforce from fiscal year 2026 levels previously justified to the Committees on Appropriations.

This section imposes requirements and limitations on Department of State funds as follows: (1) subjects funds appropriated for payments to the Working Capital Fund (i.e., a revolving fund for shared services) for new service centers to the regular notification procedures of the Committees on Appropriations; (2) requires the Secretary of State, not later than 45 days after the initial obligation of funds under titles III (State programs) and IV (other international programs) of the act to relevant bureaus or offices, to certify compliance with Department and federal financial and grants management policies—considering capacities to account for funds at country and program levels, identify risks and mitigation plans, establish performance measures, review activities, and assess results—and, if unable to certify, to submit a plan and timeline for compliance; (3) authorizes credits to the Diplomatic Programs account of up to $5 million from fees received from English teaching, library, motion pictures, publication, educational advising, counseling, and exchange visitor programs, and $15,000 from Blair House facility reimbursements, surcharges, and fees; (4) makes Diplomatic Programs funds available for acquisition by exchange or purchase of passenger motor vehicles as authorized by law and for field examinations of title I (export and related programs) activities in the United States; (5) allows up to $25 million of Diplomatic Programs funds for U.S. participation in international fairs and expositions abroad, including construction and operation of a U.S. pavilion; and (6) prohibits Diplomatic Programs funds from supporting special envoys, representatives, coordinators, advisors, or similar positions—including their office personnel and bureau-managed funds—unless expressly authorized by statute or affirmatively receiving Senate advice and consent.

This section establishes oversight, reporting, monitoring, and limitation requirements for funds appropriated by this Act (and prior acts, as applicable) made available for assistance for Gaza (and the West Bank, as specified). Specifically, it requires (1) certification by the Secretary of State within 15 days of enactment that Department of State oversight policies, processes, and procedures are established and in use to prevent diversion of such assistance to Hamas, other terrorist or extremist entities, and criminal gangs (including through international organizations) and have been developed in coordination with bilateral/multilateral donors and Israel; (2) concurrent submission of a written description of such policies, including responses to diversion and Israel's oversight role; (3) prompt notification to congressional committees of any instances of diversion, misuse, or destruction; (4) availability of funds for third-party monitoring (including end-use monitoring) following consultation with congressional committees; (5) quarterly reports to congressional committees beginning 90 days after initial obligation (and every 90 days thereafter until funds are expended) detailing the amount, purpose, and implementing entities for Gaza assistance; (6) quarterly assessments submitted to congressional committees beginning 90 days after enactment (and every 90 days thereafter until September 30, 2027), in consultation with the Director of National Intelligence, on whether West Bank and Gaza assistance has been diverted to or destroyed by such entities (possibly in classified form); (7) consultation with Appropriations Committees within 30 days of enactment but prior to initial obligation of Gaza humanitarian assistance funds; (8) Inspector General investigations of implementing partners (including multilateral organizations and logistical support entities) for credible allegations of employing or contracting with members or affiliates of U.S.-designated terrorist organizations or participation in terrorist acts (including on or after October 7, 2023), with referrals for enforcement as appropriate; and (9) prohibition on using title III funds to support admission or resettlement in the United States of foreign nationals from Gaza.

This section prohibits the obligation or expenditure of funds appropriated by this Act or prior Acts for the Department of State, foreign operations, and related programs for the Secretariat of the United Nations or any affiliated offices or programs until the Secretary of State certifies and reports to the Committees on Appropriations that (1) the Department has received a fully unredacted copy of the United Nations Office of Internal Oversight Services report on individuals affiliated with the United Nations Relief and Works Agency for Palestine Refugees (UNRWA) implicated in the October 7, 2023, events, including the killing of U.S. citizens; (2) findings by the Office of Inspector General implicating UNRWA staff in such deaths have been referred to the Department of Justice for criminal, civil, or other enforcement action; (3) proceedings for suspension and debarment of implicated individuals or entities have been initiated pursuant to applicable regulations and policies and are being expedited; and (4) the UN Secretary-General has provided written assurance that privileges, exemptions, and immunities will not be asserted for UNRWA or other UN entity staff, consultants, or contractors in cases involving gross human rights violations, acts of terrorism, material support to U.S.-designated foreign terrorist organizations, or other serious crimes under U.S. or international law (including corruption) outside the scope of official duties.

This section prohibits the obligation or expenditure of funds appropriated by this Act for the Department of State, foreign operations, and related programs for multiple purposes, including the following: (1) flying or displaying any flag over a State Department facility other than specified flags (i.e., U.S. flag; Foreign Service flag; POW/MIA flag; Hostage and Wrongful Detainee flag; flags of states, insular areas, or the District of Columbia at domestic locations; flags of Indian Tribal governments; official branded flags of U.S. agencies; or sovereign flags of other countries); (2) drag queen workshops, performances, or documentaries; (3) any program, project, or activity—including foreign public diplomacy—that teaches or trains specified concepts related to race, sex, discrimination, psychological distress, racial superiority, systemic racism or sexism, inherent racism or oppression, moral character determined by race or sex, responsibility for past actions of others of the same race or sex, or meritocracy as racist or sexist; (4) activities contravening Executive Order 14151 (Ending Radical and Wasteful Government DEI Programs and Preferencing); (5) activities contravening Executive Order 14170 (Reforming the Federal Hiring Process and Restoring Merit to Government Service, including hiring based on gender, religion, political affiliation, or race) or Executive Order 14173 (Ending Illegal Discrimination and Restoring Merit-Based Opportunity); (6) activities contravening Executive Order 14187 (Protecting Children From Chemical and Surgical Mutilation), including transfers to NGOs or programs offering counseling on, promoting, or conducting sex change surgeries; promoting puberty blockers or sexual development halt for minors; or promoting transgenderism; (7) implementing, administering, or enforcing COVID-19 mask or vaccine mandates, including for international travelers; (8) activities contravening Executive Order 14172 (Restoring Names That Honor American Greatness), including creating, procuring, or displaying maps inaccurately depicting the Gulf of Mexico; and (9) discriminatory actions against persons acting in accordance with sincerely held religious or moral beliefs that marriage is a union of one man and one woman, including adverse federal tax treatment, denial of deductions, grants, contracts, benefits, entitlements, property access, or other specified actions.

This section permanently rescinds specified unobligated or unexpended balances from prior appropriations for the Department of State, foreign operations, and related programs as follows: (1) $775 million from Consular and Border Security Programs; (2) $98 million from Educational and Cultural Exchange Programs; (3) $96.24 million from Contributions to International Organizations; (4) $1.3 billion from Development Assistance; (5) $753.482 million from Economic Support Fund; (6) $168 million from Assistance for Europe, Eurasia, and Central Asia; (7) $11.975 million from Debt Restructuring; (8) $300 million from International Narcotics Control and Law Enforcement; and (9) $50 million from Peacekeeping Operations. This section further prohibits such rescissions from amounts previously designated by Congress as an emergency requirement pursuant to a concurrent resolution on the budget or section 251(b)(2)(A)(i) of the Balanced Budget and Emergency Deficit Control Act of 1985.
