H.R. 4797 — EATS Act of 2025

This section makes ineligible for the Supplemental Nutrition Assistance Program (SNAP) any bona fide students enrolled at least half-time in any recognized school, training program, or institution of higher education by (1) adding them to the list of ineligible individuals excluded from SNAP household composition in section 3(m)(5) of the Food and Nutrition Act of 2008 and (2) striking from section 6(d)(2)(C) the exception rendering higher education students ineligible absent compliance with subsection (e) and striking subsection (e) entirely. (As background, under current law, only students enrolled at least half-time in an institution of higher education are ineligible for SNAP unless they meet criteria in section 6(e), such as working 20 hours per week, participating in work-study, or caring for a dependent child under age 6 or enrolled in school; thus, this change eliminates those exceptions and expands ineligibility to a broader category of students.)
