H.R. 4810 — BUILD Housing Act

This section authorizes the Secretary of Housing and Urban Development (HUD) to designate assistance administered by HUD as funds for a special project under section 305(c) of the Multifamily Housing Property Disposition Reform Act of 1994 (i.e., allowing streamlined environmental reviews, such as a single review document for multiple similar actions) for purposes of compliance with the National Environmental Policy Act of 1969 (NEPA) and related laws. (Thus, HUD may expedite NEPA reviews for its programs, except for assistance where another environmental review procedure is specified in law.)

This section authorizes federally recognized Indian tribes, in addition to states and units of general local government, to assume the Department of Housing and Urban Development's (HUD) environmental review responsibilities under the National Environmental Policy Act (NEPA) for dispositions of multifamily housing properties acquired by HUD (e.g., through foreclosure). (Thus, qualifying tribes may certify completion of required environmental reviews, allowing HUD to rely on those certifications and streamlining property sales or transfers.) It defines "Indian Tribe" for this purpose by cross-reference to the Native American Housing Assistance and Self-Determination Act of 1996.
