H.R. 4835 — Strategic Resources Non-discrimination Act

This section amends the Defense Production Act of 1950 (DPA) as follows: (1) in DPA section 101(c)(1) (50 U.S.C. 4511(c)(1)), which authorizes the President to require allocation of or priority performance on contracts relating to materials, equipment, and services to maximize domestic energy supplies upon specified findings, limits such authority by excluding purposes of environmental protection; and (2) in DPA Title III (50 U.S.C. 4531 et seq.), which authorizes loans, loan guarantees, purchases, and purchases commitments to expand productive capacity and supplies, adds a new section 306 prohibiting the President from denying financial support under DPA sections 301, 302, or 303—other than for the production of energy—based on a person's engagement in the exploration, development, production, utilization, transportation, or sale of fossil fuel-based energy.
