H.R. 4843 — CLEAR ID Act

This section states congressional findings on increased incidents of individuals illegally impersonating U.S. Immigration and Customs Enforcement (ICE) officers—including specific cases in Chicago (June 14, 2025), Philadelphia (June 8, 2025), Bay County (April 10, 2025), Sullivan’s Island (January 29, 2025), and Raleigh (January 26, 2025)—and that such impersonation violates federal, state, and local laws and erodes public trust in law enforcement.

This section limits the use of federal funds by the Department of Homeland Security for civil immigration enforcement actions unless covered immigration officers—defined as U.S. Customs and Border Protection (CBP) and U.S. Immigration and Customs Enforcement (ICE) personnel or other federal, state, or local personnel authorized by the DHS Secretary—(1) forgo masks or facial coverings that conceal their identity, (2) use only agency-identified vehicles, and (3) verbally and visibly identify themselves with badges and uniforms. Exceptions apply if a mask is medically necessary or required to preserve an approved undercover operation, which must weigh specified criteria such as risks of personal injury, civil liability, privacy invasion, unlawful conduct, and suitability of government involvement.
