H.R. 4846 — ROAD Act

This section establishes an affirmative defense in criminal or civil actions for damages from personal injury, wrongful death, or property damage involving a motor vehicle if such injury or damage was sustained by a participant acting in furtherance of a riot (i.e., as evidenced by the participant's conviction under 18 U.S.C. §2101 or proof of the offense by a preponderance of the evidence). In civil actions where this defense is raised, the court must stay proceedings pending the related criminal action unless a conviction therein would not support the defense.
