H.R. 4944 — Ending Qualified Immunity for ICE Agents Act

This section amends 42 U.S.C. 1983—the civil rights statute authorizing suits against state and local officials for constitutional violations—by adding a provision barring U.S. Immigration and Customs Enforcement (ICE) agents from asserting as a defense or immunity in actions under that section or other federal laws that (1) the agent acted in good faith or believed their conduct was lawful or (2) the rights violated were not clearly established or the law was unclear as to lawfulness. (Thus, this eliminates qualified immunity defenses for ICE agents, a judicial doctrine that otherwise protects officials from liability absent violation of clearly established law.)
