This section modifies exceptions to the prohibition on constructing vessels for the U.S. armed forces, or major components of such vessels' hulls or superstructures, in foreign shipyards by (1) limiting presidential national security waivers to cases where the foreign shipyard is located in a North Atlantic Treaty Organization member country or an Indo-Pacific country that is a party to a mutual defense treaty with the United States and the construction cost is less than if performed in a domestic shipyard; and (2) requiring the Secretary of the Navy to certify to Congress, before construction of a naval vessel or major hull or superstructure component commences at a foreign shipyard pursuant to such a waiver, that the shipyard is not owned or operated by a Chinese company or a multinational company domiciled in the People's Republic of China. (As background, the prohibition enforces domestic construction requirements for military vessels.)
