H.R. 5005 — Sanctuary Penalty and Public Protection Act of 2025

This section establishes a public database of "sanctuary jurisdictions" (i.e., state and local government entities with laws, regulations, policies, or practices that (1) conflict with or violate 8 U.S.C. 1373(a) or (b), 1324(a)(1)(A)(iii), or 1327; (2) prohibit or restrict compliance with immigration detainers under 8 U.S.C. 1226(c)(3) or arrests under 8 U.S.C. 1252c; or (3) prohibit federal officials from interviewing incarcerated individuals about alien status or suspected crimes), to be jointly developed by the Secretary of Homeland Security (through the ICE Director) and the Attorney General not later than 90 days after enactment and updated quarterly. The section further prohibits the obligation or expenditure of federal funds with respect to sanctuary jurisdictions after the date of enactment.
