H.R. 5022 — No Advanced Chips for the CCP Act of 2025.

This section prohibits any person from exporting, reexporting, or transferring an advanced AI semiconductor to China unless (1) the Secretary of Commerce approves the action following an interagency review with the Secretaries of Defense, Energy, and State and the Director of National Intelligence—considering national security impacts, U.S. technological leadership, risks of Chinese military applications or human rights abuses, availability of alternatives, and economic effects on U.S. companies and workers—and determines it serves U.S. national security and foreign policy interests; and (2) Congress enacts a joint resolution approving it after receiving a Commerce Department report within 30 days detailing the semiconductor, recipient, intended use, review analysis, and determination basis. The section exempts such exports, reexports, or transfers (1) for humanitarian purposes as determined by Commerce, (2) necessary for U.S. diplomatic or consular facilities in China, or (3) of semiconductors lawfully exported to China before enactment that are returned for repair or replacement.

This section defines, for purposes of the Act, (1) "advanced AI semiconductor" as a semiconductor exceeding specified performance thresholds (a total processing performance of 2,400 or a performance density of 1.6 or more; DRAM bandwidth exceeding 4,100 GB/s; interconnect bandwidth exceeding 1,100 GB/s; or a sum of DRAM bandwidth and interconnect bandwidth exceeding 5,100 GB/s); (2) "People’s Republic of China" as its territory, including Hong Kong and Macau, or any entity owned or controlled by, or acting on behalf of, its government or the Chinese Communist Party; and (3) "person" as any individual, corporation, partnership, association, or other legal entity, wherever located.
