This section defines "trafficked fentanyl" in 18 U.S.C. 1111(c)(7) to include specified illicit activities related to producing, manufacturing, distributing, selling, financing, or transporting illicit fentanyl, fentanyl precursors, active pharmaceutical ingredients or chemicals used in fentanyl production, or related controlled substance violations (e.g., under 21 U.S.C. 841(a)(1) or 846) and adds subsection (d) deeming any individual found to have trafficked fentanyl to have attempted to perpetrate murder under subsection (a), subjecting the individual to first-degree murder penalties of death or life imprisonment within the special maritime and territorial jurisdiction of the United States. (Thus, fentanyl traffickers face capital punishment or life imprisonment for such conduct in federal enclaves, territorial waters, and certain other federal jurisdictions.)
