H.R. 5026 — ALCATRAZ Act

This section establishes in the Department of Homeland Security the Detention and Logistics Program to reimburse states and local governments for costs incurred on or after January 20, 2025, relating to migrant detention at facilities in such states. The Secretary of Homeland Security must transfer all unobligated balances from the Shelter and Services Program (SSP)—administered by the Federal Emergency Management Agency to provide grants for migrant shelter and services—to DHS accounts to fund the new program. (As background, SSP funds nongovernmental organizations and state/local governments to deliver emergency shelter, food, and other services amid migrant surges at the border.) Within 90 days of enactment, the Secretary must report to the House Committee on Homeland Security and the Senate Committee on Homeland Security and Governmental Affairs on (1) a plan to coordinate with states on rapidly constructing new migrant detention facilities and identifying suitable federal or state properties, and (2) underutilized, wasteful, or redundant DHS accounts whose funding could support the program.
