H.R. 5045 — HEALTH AI Act

This section directs the Secretary of Health and Human Services to establish a grant program awarding grants to eligible entities—including institutions of higher education, tax-exempt nonprofits, and federal, state, local, or tribal government agencies—for research on using generative artificial intelligence (i.e., AI that produces text, media, code, or other content in response to a prompt; AI defined per 15 U.S.C. 9401) in health care. Permissible research includes improving clinicians' note-taking or questioning during patient appointments, reducing administrative burdens, expediting health insurance claims, enhancing customer service efficiency and quality, or other health care improvements as determined by the Secretary. In awarding grants, the Secretary must prioritize entities that encourage generative AI adoption in health care, invest in clinician and administrator workforce development, mitigate health care worker burnout, reduce gender, racial, and ethnic disparities in health outcomes, or improve patient care availability for medically underserved populations (as defined in 42 U.S.C. 254b(b)).
