H.R. 5047 — No Woke Indoctrination of Military Kids Act

This section prohibits the obligation or expenditure of funds appropriated for the Department of Defense Education Activity (DoDEA)—which operates domestic and overseas schools for dependents of military personnel and DoD civilians—for any fiscal year to (1) teach or promote critical race theory (CRT) in student classroom instruction, training, or extracurricular activities; (2) require, encourage, or coerce students to affirm or adopt CRT-rooted beliefs; (3) implement CRT-related training programs; or (4) develop, purchase, or distribute CRT-incorporating curricula. The section defines CRT as any theory or ideology teaching that any race is inherently superior or inferior; individuals are inherently racist, sexist, oppressed, or oppressive by virtue of race or sex; individuals should receive adverse or favorable treatment based on race or sex; the U.S. is fundamentally racist or sexist; individuals bear collective racial or sexual guilt for past actions; meritocracy is inherently racist or sexist; the Declaration of Independence or Constitution is fundamentally racist; moral character is determined by race; or individuals should feel psychological distress on account of race or sex.

This section prohibits the Director of the Department of Defense Education Activity (DoDEA)—which operates K-12 schools for dependents of service members and DoD civilians—from (1) maintaining DEI or accessibility offices or similar offices; (2) employing a chief diversity officer or similar position; (3) developing, implementing, distributing, or publishing DEI or equity plans, reports, or surveys; (4) developing or maintaining resource or affinity groups based on race, color, ethnicity, national origin, sexual orientation, or gender identity; (5) developing or maintaining an agency equity team or similar; (6) developing, implementing, distributing, publishing, establishing, or purchasing trainings on diversity, equity, inclusion, critical race or gender theories, intersectionality, or similar topics; (7) developing or maintaining a DEI data dashboard; or (8) employing personnel in DEI-related positions. The prohibitions do not apply to Equal Employment Opportunity offices or Americans with Disabilities Act enforcement offices as historically organized and operated within DoDEA.

This section establishes enforcement mechanisms for the Act within Department of Defense schools operated by the Department of Defense Education Activity (DoDEA). Specifically, it (1) directs the Secretary of Defense to ensure compliance by the DoDEA director, schools, and personnel; (2) subjects any DoD employee or contractor who willfully violates the Act to disciplinary action as determined by the Secretary, which may include suspension or termination; and (3) requires the Secretary to establish a process for a parent or legal guardian of a DoDEA student to file a formal complaint regarding suspected violations.
