H.R. 5059 — Specialty Crop Domestic Market Promotion and Development Program Act of 2025

This section establishes a specialty crop domestic market promotion and development program under which the Secretary of Agriculture, acting through the Administrator of the Agricultural Marketing Service, awards grants to eligible organizations (i.e., U.S. agricultural trade organizations, regional state-related organizations, cooperatives, state agencies, qualifying private organizations, or federal marketing order organizations that promote U.S.-produced specialty crops) for advertising and demand-oriented domestic promotion activities. Grant applications must include a marketing plan describing planned activities, fund expenditures, market goals, and a certification that federal funds will supplement non-Federal funds; grants require non-Federal matching funds of at least 25% (which may include in-kind support), are justifiable in writing by the Secretary, and may be provided on a multiyear basis subject to annual reviews, with termination authorized for noncompliance. The Secretary must evaluate grant expenditures and marketing plan effectiveness beginning 15 months after the first grant and conduct audits as needed; grant funds may not support promotion of foreign products or direct assistance to non-small business for-profit corporations (as defined in section 3(a) of the Small Business Act, 15 U.S.C. 632(a)), except for cooperatives, associations under 7 U.S.C. 291, or nonprofit trade associations. The section authorizes $75 million annually for FY2026 and each fiscal year thereafter.
