H.R. 5094 — Protect Patients from Costly Care Act

This section repeals Section 71120 of P.L. 119-21, which modified Medicaid cost sharing requirements (i.e., copayments, coinsurance, premiums, and deductibles for certain beneficiaries), and applies title XIX of the Social Security Act as if that section and its amendments had not been enacted. The section also rescinds amounts appropriated under Section 71120(c) of P.L. 119-21.

This section repeals Section 71203 of P.L. 119-21, which modified the exclusion for orphan drugs under the Medicare Drug Price Negotiation Program. (Thus, title XI of the Social Security Act is restored to its state prior to those changes, excluding orphan drugs—i.e., those designated under section 526 of the Federal Food, Drug, and Cosmetic Act for rare diseases or conditions—from the program's selected drugs eligible for price negotiation.)
