H.R. 5095 — HOMEFRONT Act of 2025

This section exempts most military family housing and military unaccompanied housing (as defined in 10 U.S.C. §2871) from the National Historic Preservation Act (NHPA) and prohibits nondisclosure agreements (NDAs) in privatized military housing under the Military Housing Privatization Initiative (MHPI). Specifically, with respect to the NHPA, this section amends 54 U.S.C. §307104 to exempt any Department of Defense (DOD) facility used as military family or unaccompanied housing as of the date of enactment, except that (1) the Secretary of Defense may exclude units from the exemption pursuant to regulations, not to exceed 0.1% of total such units under DOD jurisdiction; and (2) any DOD facility listed on the National Register of Historic Places as of January 20, 2025, may not be excluded. (Thus, DOD generally need not consider historic preservation impacts for most military housing construction, improvement, or demolition under NHPA section 106 review processes.) With respect to privatized military housing, this section amends 10 U.S.C. §2890(f) to prohibit landlords from requesting NDAs from tenants or prospective tenants in connection with entering, continuing, terminating leases, or providing related services—rendering any such agreement against tenant interests invalid, except for NDAs executed in litigation settlements—and applies the prohibition retroactively to all covered NDAs regardless of execution date.
