This section amends the Administrative Procedure Act (APA) to delay agency rule effective dates and expand congressional and judicial oversight as follows: (1) In section 553 (rulemaking procedures), (A) requires a comment period of not less than 60 days; (B) extends the minimum period before a substantive rule takes effect to 6 months (from 30 days); and (C) requires agencies to (i) submit finalized rules to Congress for committee referral not later than 6 months prior to the effective date, (ii) publish notice in the Federal Register on the rule's effective date, and (iii) post final or proposed rules on the agency website at least 24 hours before Federal Register publication. (2) In section 702 (judicial review), expands venue for APA challenges to the U.S. district court where the plaintiff resides or the agency has an office. (3) In section 801 (Congressional Review Act), (A) requires agencies to submit rules to Congress not later than 6 months prior to the effective date and (B) extends the congressional review period to 6 months (from 60 days), unless Congress enacts a joint resolution or other measure explicitly approving the rule. (Thus, rules generally cannot take effect until at least 12 months after proposal due to combined delays.)
