§2. Increased penalties for assaulting, resisting, or impeding ICE officers or employees
This section establishes enhanced criminal penalties under 18 U.S.C. § 111 for assaults, resistance, or interference with U.S. Immigration and Customs Enforcement (ICE) officers or employees by doubling the applicable maximum term of imprisonment—to 2 years (from 1 year) for simple assault, 16 years (from 8 years) for acts involving physical contact or intent to commit another felony, and 40 years (from 20 years) for those using a deadly or dangerous weapon or inflicting bodily injury—and adjusting the maximum fine accordingly. (Thus, these violations against ICE personnel, who enforce federal immigration laws, receive the highest penalties available under the statute.)
