This section establishes a new chapter 5 in Title 9, U.S. Code (Federal Arbitration Act), providing that—at the election of the person alleging an age discrimination dispute (or the named representative of a class or collective action)—predispute arbitration agreements and predispute joint-action waivers are invalid and unenforceable in cases filed under Federal, Tribal, or State law (including local law). An age discrimination dispute involves alleged conduct prohibited under applicable law—such as disparate treatment, disparate impact, harassment, or retaliation—against a person 40 years of age or older; applicability of the chapter is determined under Federal law by a court, rather than an arbitrator.
