H.R. 514 — SWAMP Act

This section prohibits the headquarters of an Executive agency (i.e., as defined in 5 U.S.C. §105, excluding the Executive Office of the President, Department of Defense, Department of Energy, Department of Homeland Security, Department of State, Office of the Director of National Intelligence, and Central Intelligence Agency) from being located in the Washington metropolitan area (i.e., the District of Columbia and specified counties in Maryland and Virginia), except that agencies with headquarters there on the date of enactment may retain them subject to restrictions barring new construction, major renovations, lease renewals, or new leases thereafter. (Thus, affected agencies must eventually relocate.) It further directs the Administrator of General Services, not later than one year after enactment, to establish a competitive bidding process—open to proposals from any state or political subdivision, with public notice and comment—for selecting relocation sites based on economic and workforce impacts, relevant expertise, and national security considerations; authorizes use of proceeds from federal property sales to offset costs; and requires implementation using only existing funds.
