H.R. 5173 — No Social Media at School Act

This section requires a social media company to use geofencing to block access to its platform on a K–12 education campus during the regular school day (as determined by the local educational agency), except for push notifications containing weather alerts, amber alerts, or uses by emergency responders for public safety purposes. It prohibits requiring social media companies to collect personal data on user age beyond normal business practices or to implement age gating or verification. This section treats violations as unfair or deceptive acts or practices under section 18(a)(1)(B) of the Federal Trade Commission Act (15 U.S.C. 57a(a)(1)(B)), enforceable by the Federal Trade Commission using its standard authorities and by state attorneys general (with prior notice to the FTC, except in exigent circumstances, and FTC intervention rights); state actions may seek injunctions, compliance, damages, or other relief. It defines key terms, including "geofencing" (a virtual boundary maintained by a social media platform), "K–12 education" (elementary or secondary schools, as defined in the Elementary and Secondary Education Act of 1965), and "social media company" (excluding nonprofits and educational agencies or institutions).
