This section establishes ineligibility for Edward Byrne Memorial Justice Assistance Grant (Byrne JAG) awards—formula grants to states and localities for law enforcement, prosecution, courts, corrections, and related criminal justice purposes—to any state or unit of local government with a policy or law that substantially limits cash bail as a potential condition for every individual charged with a covered offense, defined as a violent or sexual crime (e.g., murder, rape, sexual assault, carjacking, robbery, burglary, assault) or public disorder offense (e.g., looting, vandalism, rioting, inciting to riot, fleeing law enforcement), beginning in the fiscal year commencing on the first October 1 after enactment and each fiscal year thereafter.
