H.R. 5266 — 5G UPGRADE Act of 2025

This section amends the eligible facilities request provision, which requires state and local governments to approve modifications to existing wireless towers or base stations involving collocation, removal, or replacement of transmission equipment that do not substantially change physical dimensions, by (1) extending the prohibition on denial to such governments' instrumentalities; (2) broadening the exception for National Historic Preservation Act and National Environmental Policy Act requirements to the entire subsection (from paragraph (1)); and (3) adding a 60-day review timeframe, after which a request is deemed approved unless the government provides written notice determining it is ineligible (with cited reasons) or tolls the clock for incompleteness (initially up to 30 days, subsequently 10 days per notice, subject to limitations) or by mutual agreement, plus a definition of request submission date as the first procedural step taken. (Thus, this implements a "shot clock" with deemed approval to expedite wireless infrastructure deployment such as 5G small cells.)
