H.R. 5302 — No Funds for Foreign Abortions Act

This section prohibits the obligation or expenditure of funds made available under any Act authorizing or appropriating funds for foreign assistance to (1) the government of any foreign country that, during the preceding fiscal year, provided public funds—directly or indirectly—for the performance of abortions, referrals or active promotion of abortion, items to procure abortions, coercion or financial incentives for abortions or involuntary sterilization, or related biomedical research; and (2) any foreign nongovernmental organization, international organization, or multilateral entity that engages in such activities, regardless of funding source. The prohibitions apply whether or not U.S. funds support the activities (i.e., even if U.S. funds enable, offset, or supplement other funds used for prohibited purposes) and extend to activities conducted abroad by U.S.-based entities. The section defines "abortion" to exclude procedures to remove a dead unborn child or ectopic pregnancy, pre-viability separations necessary to save the mother's life, or post-viability procedures to produce live birth; "actively promotes abortion" to include advocacy, counseling, lobbying, materials, or training; and other terms such as "indirectly," "public funds," and "multilateral entity" (e.g., World Health Organization, United Nations Population Fund).
