This section authorizes a civil action in an appropriate U.S. district court for damages against a judge or government entity that releases a covered defendant on bail pending trial if the defendant harms another person (or the family member of a deceased victim) during that release. It eliminates judicial immunity as a defense and defines a covered defendant as an individual charged with a crime of violence, as defined in 18 U.S.C. §16 (i.e., an offense that has as an element the use, attempted use, or threatened use of physical force against the person or property of another, or any felony that by its nature involves a substantial risk that physical force against the person or property of another may be used), who has a prior conviction for a crime of violence; the term judge includes federal and state judges.
