This section establishes the Unaccompanied Alien Child Anti-Trafficking Program, to be administered by the Secretary of Health and Human Services (HHS) in coordination with the Secretary of Homeland Security, requiring enrollment of all unaccompanied alien children (UACs) released from HHS custody on or after enactment (and those previously released but present in the U.S.), with enrollment ending upon removal order, age 18, or obtaining lawful immigration status. The program directs HHS to (1) vet sponsors per specified procedures and bar release to ineligible sponsors; (2) require continuous GPS monitoring of each UAC and sponsor; (3) mandate monthly telephonic reporting by sponsors and UACs aged 4 or older; (4) collect DNA from each UAC, sponsor, and adult household members, using it to verify claimed biological relationships; (5) immediately retake custody of any UAC believed at risk of exploitation, abuse, or unsafe conditions, notifying DHS; and (6) conduct pre-release home inspections plus at least six unannounced in-person visits in the first year and four per year thereafter. Sponsor vetting requires initial biometric collection and comprehensive background checks—including in-person interviews, public records, FBI criminal history, interagency vetting, sex offender registry, and immigration status—conducted in consultation with the Attorney General, with quarterly supplementary checks thereafter. Sponsors (or adult household members) are ineligible if unlawfully present (unless the UAC's parent, legal guardian, or biological relative); associates of transnational criminal organizations, gangs, racketeering enterprises, foreign terrorist organizations, or specially designated global terrorists; registered sex offenders; convicted of specified U.S. crimes carrying sentences of one year or more (or lesser crimes within prior 10 years); convicted of violent crimes abroad; or charged with pending U.S. crimes.
