H.R. 5330 — SAFE Driving Laws Act

This section directs the Secretary of Transportation to withhold 50% of a state's apportionments under 23 U.S.C. §104(b)(1) (National Highway Performance Program) and §104(b)(2) (Surface Transportation Block Grant Program)—the primary sources of federal-aid highway funding—beginning on the first day of each fiscal year starting with FY2027 if the state fails to comply with specified requirements. To comply, a state (1) must enact a law prohibiting issuance of a driver's license or commercial driver's license to an individual lacking proof of U.S. citizenship or lawful permanent residence and (2) must not prohibit or restrict a state or local government entity or official from collecting, sending to, or receiving from the Department of Homeland Security immigration enforcement information (i.e., an individual's citizenship or immigration status or the date, time, and location of release from detention, jail, or prison). The Secretaries of Transportation and Homeland Security must determine each state's compliance and maintain a publicly available website database of such status.
