§3. Definitions
This section defines key terms for purposes of the Act. It defines (1) “eligible claim” as a claim asserted in an eligible complaint on behalf of all eligible claimants; (2) “eligible claimant” as a plaintiff, class member, or putative class member in an eligible complaint who filed a proof of claim in the In re Motors Liquidation Company bankruptcy case (No. 09–50026, Bankr. S.D.N.Y.) for death or personal injuries caused by alleged defects in pre-June 1, 2009, General Motors vehicles or components; (3) “eligible complaint” as the July 9, 2015, complaint in Campbell et al. v. United States (No. 15–717, Ct. Fed. Cl.) alleging a Fifth Amendment takings violation in connection with the July 10, 2009, acquisition by NGMCO, Inc., of General Motors Corporation assets; and (4) “just compensation” as a lump-sum payment equal to 2.5 times the allowed amount on the June 3, 2021, final claims register in that bankruptcy case, plus interest from July 10, 2009, to settlement effective date at 3.5% per annum compounded quarterly, plus reasonable court-approved counsel fees and costs for the eligible complaint, all without offset.
