H.R. 5339 — Susan E. Lukas 9/11 Servicemember Fairness Act

This section establishes a presumption of service connection for specified diseases in covered veterans who performed active military, naval, air, or space service at a duty station on the Pentagon Reservation from September 11, 2001, through November 19, 2001. Specified diseases include (1) asthma; (2) chronic obstructive pulmonary disease; (3) emphysema; (4) tracheomalacia; (5) cancer of any type; (6) any cardiovascular disease; (7) any skin disease; (8) any respiratory disease; and (9) any other illness the Secretary determines is positively associated with toxins identified under VA airborne hazard regulations. (Thus, such veterans qualify for VA disability compensation without proving the disease was incurred or aggravated by service, subject to rebuttal.)
