H.R. 534 — CONTAINER Act

This section authorizes a border state (i.e., a state adjacent to the U.S. northern border with Canada or southern border with Mexico) to place a movable, temporary structure on specified federal land (i.e., land under the jurisdiction of the Bureau of Indian Affairs, Bureau of Land Management, Bureau of Reclamation, Forest Service, U.S. Fish and Wildlife Service, or National Park Service that is adjacent to such borders) for border security purposes without a special use authorization, if the state provides 45 days' notice to the secretary concerned (i.e., the Secretary of the Interior or Agriculture, as applicable). Such placement is permitted for up to one year and may be extended in 90-day increments upon approval by the secretary concerned, who must consult the Commissioner of U.S. Customs and Border Protection and approve the extension if the commissioner determines that operational control of the border (as defined in the Secure Fence Act of 2006) has not been achieved.
